A, title V, § 535, Oct. 28, 2009, 123 Stat. 2292.)","seq_in_title":344,"parent_identifier":"/us/usc/t20/ch25A","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch25A","level":"chapter","num":"CHAPTER 25A—","heading":"OVERSEAS DEFENSE DEPENDENTS’ EDUCATION","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id80dbf026-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s923a\"><num value=\"923a\">§ 923a.</num><heading> Enrollment of certain additional children on tuition-free basis</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id80dbf027-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s923a/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Enrollment authorized</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Under regulations to be prescribed by the Secretary of Defense, the Secretary may authorize the enrollment in schools of the defense dependents’ education system on a tuition-free basis of—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id80dbf028-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s923a/a/1\"><num value=\"1\">(1)</num><content> the children of full-time, locally-hired employees of the Department of Defense in an overseas area if such employees are citizens or nationals of the United States; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id80dbf029-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s923a/a/2\"><num value=\"2\">(2)</num><content> the children of a foreign military member assigned to the Supreme Headquarters Allied Powers, Europe, but only in a school of the defense dependents’ education system in Mons, Belgium.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id80dbf02a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s923a/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Funding</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may use funds available for the defense dependents’ education system to provide for the education of children enrolled in the defense dependents’ education system under subsection (a).</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id80dbf02b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s923a/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Special rules regarding enrollment of dependents of foreign military members assigned to Supreme Headquarters Allied Powers, Europe</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id80dbf02c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s923a/c/1\"><num value=\"1\">(1)</num><content> In the regulations required by subsection (a), the Secretary shall prescribe a methodology based on the estimated total number of dependents of sponsors under <ref href=\"/us/usc/t20/s932/2\">section 932(2) of this title</ref> enrolled in schools of the defense dependents’ education system in Mons, Belgium, to determine the number of children described in paragraph (2) of subsection (a) who will be authorized to enroll under such subsection. The Secretary shall prescribe such methodology with the advice and assistance of the commander of the geographic combatant command with jurisdiction over Mons, Belgium.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id80dbf02d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s923a/c/2\"><num value=\"2\">(2)</num><content> If the number of children described in paragraph (2) of subsection (a) who seek enrollment in schools of the defense dependents’ education system in Mons, Belgium, exceeds the number authorized by the Secretary under paragraph (1), the Secretary may enroll the additional children on a space-available, tuition-free basis notwithstanding <ref href=\"/us/usc/t20/s923/d/2\">section 923(d)(2) of this title</ref>.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id80dbf02e-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/95/561/tXIV/s1404A\">Pub.
