<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id80dbf04a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s927"><num value="927">§ 927.</num><heading> Allotment formula</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id80dbf04b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s927/a"><num value="a" class="bold">(a)</num><heading class="bold"> Establishment by regulation of minimum allotment formula; criteria</heading><chapeau style="-uslm-lc:I11" class="indent0">The Director shall by regulation establish a formula for determining the minimum allotment of funds necessary for the operation of each school in the defense dependents’ education system. In establishing such formula, the Director shall take into consideration—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id80dbf04c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s927/a/1"><num value="1">(1)</num><content> the number of students served by a school and the size of the school;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id80dbf04d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s927/a/2"><num value="2">(2)</num><chapeau> special cost factors for a school, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id80dbf04e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s927/a/2/A"><num value="A">(A)</num><content> geographic isolation of the school,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id80dbf04f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s927/a/2/B"><num value="B">(B)</num><content> a need for special staffing, transportation, or educational programs at the school, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id80dbf050-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s927/a/2/C"><num value="C">(C)</num><content> unusual food and housing costs,</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id80dbf051-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s927/a/3"><num value="3">(3)</num><content> the cost of providing academic services of a high quality as required by <ref href="/us/usc/t20/s921/b/1">section 921(b)(1) of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id80dbf052-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s927/a/4"><num value="4">(4)</num><content> such other factors as the Director considers appropriate.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id80dbf053-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s927/b"><num value="b" class="bold">(b)</num><heading class="bold"> Issuance, etc., of regulations</heading><content><p style="-uslm-lc:I11" class="indent0">Any regulation under subsection (a) shall be issued, and shall become effective, in accordance with the procedures applicable to regulations required to be issued by the Secretary of Education in accordance with <ref href="/us/usc/t20/s1232">section 1232 of this title</ref>.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id80dbf054-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s927/c"><num value="c" class="bold">(c)</num><heading class="bold"> Applicability of certain provisions</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id80dbf055-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s927/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Children with disabilities</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding the provisions of <ref href="/us/usc/t20/s921/b/3">section 921(b)(3) of this title</ref>, the provisions of part B of the Individuals with Disabilities Education Act [<ref href="/us/usc/t20/s1411">20 U.S.C. 1411</ref> et seq.], other than the funding and reporting provisions, shall apply to all schools operated by the Department of Defense under this chapter, including the requirement that children with disabilities, aged 3 to 5, inclusive, receive a free appropriate public education.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id80dbf056-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s927/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Infants and toddlers with disabilities</heading><content><p style="-uslm-lc:I12" class="indent1">The responsibility to provide comparable early intervention services to infants and toddlers with disabilities and their families in accordance with individualized family service plans described in section 636 of the Individuals with Disabilities Education Act [<ref href="/us/usc/t20/s1436">20 U.S.C. 1436</ref>] and to comply with the procedural safeguards set forth in part C of such Act [<ref href="/us/usc/t20/s1431">20 U.S.C. 1431</ref> et seq.] shall apply with respect to all eligible dependents overseas.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id80dbf057-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s927/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Implementation</heading><content><p style="-uslm-lc:I12" class="indent1">In carrying out paragraph (2), the Secretary shall have in effect a comprehensive, coordinated, multidisciplinary program of early intervention services for infants and toddlers with disabilities among Department of Defense entities involved in the provision of such services to such individuals.</p>
