<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id83a289c3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9517"><num value="9517">§ 9517.</num><heading> Commissioners of the National Education Centers</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83a289c4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9517/a"><num value="a" class="bold">(a)</num><heading class="bold"> Appointment of Commissioners</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83a289c5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9517/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Except as provided in subsection (b), each of the National Education Centers shall be headed by a Commissioner appointed by the Director. In appointing Commissioners, the Director shall seek to promote continuity in leadership of the National Education Centers and shall consider individuals recommended by the Board. The Director may appoint a Commissioner to carry out the functions of a National Education Center without regard to the provisions of title 5 governing appointments in the competitive service, and the provisions of chapter 51 and subchapter III of chapter 53 of such title relating to classification and General Schedule pay rates.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83a289c6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9517/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Pay and qualifications</heading><chapeau style="-uslm-lc:I12" class="indent1">Except as provided in subsection (b), each Commissioner shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83a289c7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9517/a/2/A"><num value="A">(A)</num><content> receive the rate of basic pay for level IV of the Executive Schedule; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83a289c8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9517/a/2/B"><num value="B">(B)</num><content> be highly qualified in the field of education research or evaluation.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83a289c9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9517/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Service</heading><chapeau style="-uslm-lc:I12" class="indent1">Except as provided in subsection (b), each Commissioner shall report to the Director. A Commissioner shall serve for a period of not more than 6 years, except that a Commissioner—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83a289ca-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9517/a/3/A"><num value="A">(A)</num><content> may be reappointed by the Director; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83a289cb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9517/a/3/B"><num value="B">(B)</num><content> may serve after the expiration of that Commissioner’s term, until a successor has been appointed, for a period not to exceed 1 additional year.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83a289cc-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9517/b"><num value="b" class="bold">(b)</num><heading class="bold"> Appointment of Commissioner for Education Statistics</heading><chapeau style="-uslm-lc:I11" class="indent0">The National Center for Education Statistics shall be headed by a Commissioner for Education Statistics who shall be appointed by the President and who shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id83a289cd-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9517/b/1"><num value="1">(1)</num><content> have substantial knowledge of programs assisted by the National Center for Education Statistics;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a289ce-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9517/b/2"><num value="2">(2)</num><content> receive the rate of basic pay for level IV of the Executive Schedule; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a289cf-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9517/b/3"><num value="3">(3)</num><content> serve for a term of 6 years, with the term to expire every sixth June 21, beginning in 2003.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83a289d0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9517/c"><num value="c" class="bold">(c)</num><heading class="bold"> Coordination</heading><content><p style="-uslm-lc:I11" class="indent0">Each Commissioner of a National Education Center shall coordinate with each of the other Commissioners of the National Education Centers in carrying out such Commissioner’s duties under this subchapter.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83a289d1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9517/d"><num value="d" class="bold">(d)</num><heading class="bold"> Supervision and approval</heading><content><p style="-uslm-lc:I11" class="indent0">Each Commissioner, except the Commissioner for Education Statistics, shall carry out such Commissioner’s duties under this subchapter under the supervision and subject to the approval of the Director.</p>
