<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id83a9b627-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b"><num value="9567b">§ 9567b.</num><heading> Duties</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83a9b628-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/a"><num value="a" class="bold">(a)</num><heading class="bold"> General duties</heading><chapeau style="-uslm-lc:I11" class="indent0">The Special Education Research Center shall carry out research activities under this part consistent with the mission described in <ref href="/us/usc/t20/s9567/b">section 9567(b) of this title</ref>, such as activities that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b629-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/a/1"><num value="1">(1)</num><chapeau> improve services provided under the Individuals with Disabilities Education Act [<ref href="/us/usc/t20/s1400">20 U.S.C. 1400</ref> et seq.] in order to improve—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83a9b62a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/a/1/A"><num value="A">(A)</num><content> academic achievement, functional outcomes, and educational results for children with disabilities; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83a9b62b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/a/1/B"><num value="B">(B)</num><content> developmental outcomes for infants or toddlers with disabilities;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b62c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/a/2"><num value="2">(2)</num><content> identify scientifically based educational practices that support learning and improve academic achievement, functional outcomes, and educational results for all students with disabilities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b62d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/a/3"><num value="3">(3)</num><content> examine the special needs of preschool aged children, infants, and toddlers with disabilities, including factors that may result in developmental delays;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b62e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/a/4"><num value="4">(4)</num><content> identify scientifically based related services and interventions that promote participation and progress in the general education curriculum and general education settings;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b62f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/a/5"><num value="5">(5)</num><content> improve the alignment, compatibility, and development of valid and reliable assessments, including alternate assessments, as required by <ref href="/us/usc/t20/s6311/b">section 6311(b) of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b630-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/a/6"><num value="6">(6)</num><content> examine State content standards and alternate assessments for students with significant cognitive impairment in terms of academic achievement, individualized instructional need, appropriate education settings, and improved post-school results;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b631-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/a/7"><num value="7">(7)</num><content> examine the educational, developmental, and transitional needs of children with high incidence and low incidence disabilities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b632-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/a/8"><num value="8">(8)</num><content> examine the extent to which overidentification and underidentification of children with disabilities occurs, and the causes thereof;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b633-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/a/9"><num value="9">(9)</num><content> improve reading and literacy skills of children with disabilities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b634-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/a/10"><num value="10">(10)</num><content> examine and improve secondary and postsecondary education and transitional outcomes and results for children with disabilities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b635-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/a/11"><num value="11">(11)</num><content> examine methods of early intervention for children with disabilities, including children with multiple or complex developmental delays;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b636-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/a/12"><num value="12">(12)</num><content> examine and incorporate universal design concepts in the development of standards, assessments, curricula, and instructional methods to improve educational and transitional results for children with disabilities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b637-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/a/13"><num value="13">(13)</num><content> improve the preparation of personnel, including early intervention personnel, who provide educational and related services to children with disabilities to increase the academic achievement and functional performance of students with disabilities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b638-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/a/14"><num value="14">(14)</num><content> examine the excess costs of educating a child with a disability and expenses associated with high cost special education and related services;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b639-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/a/15"><num value="15">(15)</num><content> help parents improve educational results for their children, particularly related to transition issues;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b63a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/a/16"><num value="16">(16)</num><content> address the unique needs of children with significant cognitive disabilities; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b63b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/a/17"><num value="17">(17)</num><content> examine the special needs of limited English proficient children with disabilities.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83a9b63c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/b"><num value="b" class="bold">(b)</num><heading class="bold"> Standards</heading><chapeau style="-uslm-lc:I11" class="indent0">The Special Education Research Commissioner shall ensure that activities assisted under this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b63d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/b/1"><num value="1">(1)</num><content> conform to high standards of quality, integrity, accuracy, validity, and reliability;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b63e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/b/2"><num value="2">(2)</num><content> are carried out in accordance with the standards for the conduct and evaluation of all research and development established by the National Center for Education Research; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b63f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/b/3"><num value="3">(3)</num><content> are objective, secular, neutral, and nonideological, and are free of partisan political influence, and racial, cultural, gender, regional, or disability bias.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83a9b640-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/c"><num value="c" class="bold">(c)</num><heading class="bold"> Plan</heading><chapeau style="-uslm-lc:I11" class="indent0">The Special Education Research Commissioner shall propose to the Director a research plan, developed in collaboration with the Assistant Secretary for Special Education and Rehabilitative Services, that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b641-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/c/1"><num value="1">(1)</num><content> is consistent with the priorities and mission of the Institute and the mission of the Special Education Research Center;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b642-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/c/2"><num value="2">(2)</num><content> is carried out, updated, and modified, as appropriate;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b643-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/c/3"><num value="3">(3)</num><content> is consistent with the purposes of the Individuals with Disabilities Education Act [<ref href="/us/usc/t20/s1400">20 U.S.C. 1400</ref> et seq.];</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b644-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/c/4"><num value="4">(4)</num><content> contains an appropriate balance across all age ranges and types of children with disabilities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b645-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/c/5"><num value="5">(5)</num><content> provides for research that is objective and uses measurable indicators to assess its progress and results; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b646-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/c/6"><num value="6">(6)</num><content> is coordinated with the comprehensive plan developed under section 681 of the Individuals with Disabilities Education Act [<ref href="/us/usc/t20/s1481">20 U.S.C. 1481</ref>].</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83a9b647-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/d"><num value="d" class="bold">(d)</num><heading class="bold"> Grants, contracts, and cooperative agreements</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83a9b648-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">In carrying out the duties under this section, the Director may award grants to, or enter into contracts or cooperative agreements with, eligible applicants.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83a9b649-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Eligible applicants</heading><content><p style="-uslm-lc:I12" class="indent1">Activities carried out under this subsection through contracts, grants, or cooperative agreements shall be carried out only by recipients with the ability and capacity to conduct scientifically valid research.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83a9b64a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Applications</heading><content><p style="-uslm-lc:I12" class="indent1">An eligible applicant that wishes to receive a grant, or enter into a contract or cooperative agreement, under this section shall submit an application to the Director at such time, in such manner, and containing such information as the Director may require.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83a9b64b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/e"><num value="e" class="bold">(e)</num><heading class="bold"> Dissemination</heading><chapeau style="-uslm-lc:I11" class="indent0">The Special Education Research Center shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b64c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/e/1"><num value="1">(1)</num><content> synthesize and disseminate, through the National Center for Education Evaluation and Regional Assistance, the findings and results of special education research conducted or supported by the Special Education Research Center; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83a9b64d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/e/2"><num value="2">(2)</num><content> assist the Director in the preparation of a biennial report, as described in <ref href="/us/usc/t20/s9519">section 9519 of this title</ref>.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83a9b64e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9567b/f"><num value="f" class="bold">(f)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I11" class="indent0">There are authorized to be appropriated to carry out this part such sums as may be necessary for each of fiscal years 2005 through 2010.</p>
