<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id83ba57e8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9904"><num value="9904">§ 9904.</num><heading> Grant oversight and administration</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83ba57e9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9904/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">The Director may execute a contract for program oversight and fiscal management with an organization at an institution of higher education, a non-profit organization, or other entity that demonstrates capacity for and experience in—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id83ba57ea-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9904/a/1"><num value="1">(1)</num><content> replicating 1 or more similar programs at regional or national levels;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83ba57eb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9904/a/2"><num value="2">(2)</num><content> providing programmatic and technical implementation assistance for the program;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83ba57ec-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9904/a/3"><num value="3">(3)</num><content> performing data collection and analysis to ensure proper implementation and continuous program improvement; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83ba57ed-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9904/a/4"><num value="4">(4)</num><content> providing accountability for results by measuring and monitoring achievement of programmatic milestones.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83ba57ee-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9904/b"><num value="b" class="bold">(b)</num><heading class="bold"> Oversight responsibilities</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83ba57ef-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9904/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Mandatory duties</heading><chapeau style="-uslm-lc:I12" class="indent1">If the Director executes a contract under subsection (a) with an organization for program oversight and fiscal management, the organization shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83ba57f0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9904/b/1/A"><num value="A">(A)</num><content> ensure that a grant recipient faithfully replicates and implements the program or programs for which the grant is awarded;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83ba57f1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9904/b/1/B"><num value="B">(B)</num><content> ensure that grant funds are used for the purposes authorized and that a grant recipient has a system in place to track and account for all Federal grant funds provided;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83ba57f2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9904/b/1/C"><num value="C">(C)</num><content> provide technical assistance to grant recipients;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83ba57f3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9904/b/1/D"><num value="D">(D)</num><chapeau> collect and analyze data and report to the Director annually on the effects of the program on—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id83ba57f4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9904/b/1/D/i"><num value="i">(i)</num><content> the progress of participating students in achieving teaching competence and teaching certification;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id83ba57f5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9904/b/1/D/ii"><num value="ii">(ii)</num><content> the participation of students in the program by major, compared with local and State needs on secondary teachers by discipline; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id83ba57f6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9904/b/1/D/iii"><num value="iii">(iii)</num><content> the participation of students in the program by demographic subgroup;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83ba57f7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9904/b/1/E"><num value="E">(E)</num><content> collect and analyze data and report to the Director annually on the effects of the program on the academic achievement of elementary and secondary school students taught by graduates of programs funded by grants under this chapter; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83ba57f8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9904/b/1/F"><num value="F">(F)</num><content> submit an annual report to the Director demonstrating compliance with the requirements of subparagraphs (A) through (E).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83ba57f9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9904/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Discretionary duties</heading><content><p style="-uslm-lc:I12" class="indent1">At the request of the Director, the organization under contract under subsection (a) may assist the Director in evaluating grant applications.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83ba57fa-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9904/c"><num value="c" class="bold">(c)</num><heading class="bold"> Reports to Congress</heading><content><p style="-uslm-lc:I11" class="indent0">The Director shall submit a copy of the annual report required by subsection (b)(1)(F) to the Senate Committee on Commerce, Science, and Transportation, the Senate Committee on Health, Education, Labor, and Pensions, the House of Representatives Committee on Science and Technology, and the House of Representatives Committee on Education and Labor.</p>
