value=\"1401\">§ 1401.</num><heading> Pesticide monitoring and enforcement information</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idecaa92cf-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Data management systems</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idecaa92d0-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/a/1\"><num value=\"1\">(1)</num><chapeau> Not later than 480 days after <date date=\"1988-08-23\">August 23, 1988</date>, the Secretary of Health and Human Services shall place in effect computerized data management systems for the Food and Drug Administration under which the Administration will—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idecaa92d1-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/a/1/A\"><num value=\"A\">(A)</num><content> record, summarize, and evaluate the results of its program for monitoring food products for pesticide residues,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idecaa92d2-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/a/1/B\"><num value=\"B\">(B)</num><content> identify gaps in its pesticide monitoring program in the monitoring of (i) pesticides, (ii) food products, and (iii) food from specific countries and from domestic sources,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idecaa92d3-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/a/1/C\"><num value=\"C\">(C)</num><content> detect trends in the presence of pesticide residues in food products and identify public health problems emerging from the occurrence of pesticide residues in food products,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idecaa92d4-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/a/1/D\"><num value=\"D\">(D)</num><content> focus its testing resources for monitoring pesticide residues in food on detecting those residues which pose a public health concern,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idecaa92d5-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/a/1/E\"><num value=\"E\">(E)</num><content> prepare summaries of the information listed in subsection (b), and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idecaa92d6-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/a/1/F\"><num value=\"F\">(F)</num><content> provide information to assist the Environmental Protection Agency in carrying out its responsibilities under the Federal Insecticide, Fungicide, and Rodenticide Act [<ref href=\"/us/usc/t7/s136\">7 U.S.C. 136</ref> et seq.] and the Federal Food, Drug, and Cosmetic Act [<ref href=\"/us/usc/t21/s301\">21 U.S.C. 301</ref> et seq.].</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idecaa92d7-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/a/2\"><num value=\"2\">(2)</num><content> As soon as practicable, the Secretary of Health and Human Services shall develop a means to enable the computerized data management systems placed into effect under paragraph (1) to make the summary described in subsection (c).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idecaa92d8-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/a/3\"><num value=\"3\">(3)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idecaa92d9-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/a/3/A\"><num value=\"A\">(A)</num><chapeau> Paragraph (1) does not limit the authority of the Food and Drug Administration to—</chapeau><clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idecaa92da-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/a/3/A/i\"><num value=\"i\">(i)</num><content> use the computerized data management systems placed in effect under paragraph (1), or</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idecaa92db-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/a/3/A/ii\"><num value=\"ii\">(ii)</num><content> develop additional data management systems,</content>\n</clause>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">to facilitate the regulation of any substance or product covered under the requirements of the Federal Food, Drug, and Cosmetic Act [<ref href=\"/us/usc/t21/s301\">21 U.S.C. 301</ref> et seq.].</continuation>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idecaa92dc-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/a/3/B\"><num value=\"B\">(B)</num><content> In placing into effect the computerized data management systems under paragraph (1) and in carrying out paragraph (2), the Secretary shall comply with applicable regulations governing computer system design and procurement.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idecaa92dd-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Information</heading><chapeau>The Food and Drug Administration shall use the computerized data management systems placed into effect under subsection (a)(1) to prepare a summary of—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idecaa92de-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/b/1\"><num value=\"1\">(1)</num><chapeau> information on—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idecaa92df-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/b/1/A\"><num value=\"A\">(A)</num><content> the types of imported and domestically produced food products analyzed for compliance with the requirements of the Federal Food, Drug, and Cosmetic Act [<ref href=\"/us/usc/t21/s301\">21 U.S.C. 301</ref> et seq.] regarding the presence of pesticide residues,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idecaa92e0-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/b/1/B\"><num value=\"B\">(B)</num><content> the number of samples of each such food product analyzed for such compliance by country of origin,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idecaa92e1-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/b/1/C\"><num value=\"C\">(C)</num><content> the pesticide residues which may be detected using the testing methods employed,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idecaa92e2-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/b/1/D\"><num value=\"D\">(D)</num><content> the pesticide residues in such food detected and the levels detected,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idecaa92e3-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/b/1/E\"><num value=\"E\">(E)</num><content> the compliance status of each sample of such food tested and the violation rate for each country-product combination, and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idecaa92e4-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/b/1/F\"><num value=\"F\">(F)</num><content> the action taken with respect to each sample of such food found to be in violation of the Federal Food, Drug, and Cosmetic Act [<ref href=\"/us/usc/t21/s301\">21 U.S.C. 301</ref> et seq.] and its ultimate disposition, and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idecaa92e5-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/b/2\"><num value=\"2\">(2)</num><chapeau> information on—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idecaa92e6-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/b/2/A\"><num value=\"A\">(A)</num><content> the country of origin of each imported food product referred to in paragraph (1)(A), and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idecaa92e7-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/b/2/B\"><num value=\"B\">(B)</num><content> the United States district of entry for each such imported food product.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idecaa92e8-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Volume data</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Food and Drug Administration shall use the computerized data management systems placed into effect under subsection (a)(1) to summarize the volume of each type of food product subject to the requirements of the Federal Food, Drug, and Cosmetic Act [<ref href=\"/us/usc/t21/s301\">21 U.S.C. 301</ref> et seq.] which is imported into the United States and which has an entry value which exceeds an amount established by the Secretary of Health and Human Services. The summary shall be made by country of origin and district of entry. Information with respect to volumes of food products to be included in the summary shall, to the extent feasible, be obtained from data bases of other Federal agencies.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idecaa92e9-0c74-11e6-b5d4-9376778ac99d\" identifier=\"/us/usc/t21/s1401/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Compilation</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Not later than 90 days after the expiration of 1 year after the data management systems are placed into effect under subsection (a) and annually thereafter, the Secretary of Health and Human Services shall compile a summary of the information described in subsection (b) with respect to the previous year. When the Food and Drug Administration is able to make summaries under subsection (c), the Secretary shall include in the compilation under the preceding sentence a compilation of the information described in subsection (c). and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><chapeau> for each violation of such requirements during each such fiscal year—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> the covered products with respect to which such violation occurred;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> the residue in or on such product in violation of such requirements;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iii\">“(iii)</num><content> the country exporting such product;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iv\">“(iv)</num><content> the actions taken in response to such violation and the reasons for such actions; and</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"v\">“(v)</num><content> the level of testing conducted by the countries exporting such products;</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> describing any research conducted by the Secretary to develop improved methods to detect residues subject to such requirements in or on covered products;
