L. 105–230, § 2, Aug. 13, 1998, 112 Stat. 1519.)","seq_in_title":598,"parent_identifier":"/us/usc/t21/ch21","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch21","level":"chapter","num":"CHAPTER 21—","heading":"BIOMATERIALS ACCESS ASSURANCE","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" id=\"id1e24126b-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601\"><num value=\"1601\">§ 1601.</num><heading> Findings</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"blockIndent0\">The Congress finds that—</chapeau><paragraph class=\"indent1\" id=\"id1e24126c-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/1\"><num value=\"1\">(1)</num><content> each year millions of citizens of the United States depend on the availability of lifesaving or life-enhancing medical devices, many of which are permanently implantable within the human body;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e24397d-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/2\"><num value=\"2\">(2)</num><content> a continued supply of raw materials and component parts is necessary for the invention, development, improvement, and maintenance of the supply of the devices;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e24397e-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/3\"><num value=\"3\">(3)</num><chapeau> most of the medical devices are made with raw materials and component parts that—</chapeau><subparagraph class=\"indent2\" id=\"id1e24397f-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/3/A\"><num value=\"A\">(A)</num><content> move in interstate commerce;</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1e243980-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/3/B\"><num value=\"B\">(B)</num><content> are not designed or manufactured specifically for use in medical devices; and</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1e243981-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/3/C\"><num value=\"C\">(C)</num><content> come in contact with internal human tissue;</content>\n</subparagraph>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e243982-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/4\"><num value=\"4\">(4)</num><content> the raw materials and component parts also are used in a variety of nonmedical products;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e243983-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/5\"><num value=\"5\">(5)</num><content> because small quantities of the raw materials and component parts are used for medical devices, sales of raw materials and component parts for medical devices constitute an extremely small portion of the overall market for the raw materials and component parts;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e243984-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/6\"><num value=\"6\">(6)</num><content> under the Federal Food, Drug, and Cosmetic Act (<ref href=\"/us/usc/t21/s301\">21 U.S.C. 301</ref> et seq.) manufacturers of medical devices are required to demonstrate that the medical devices are safe and effective, including demonstrating that the products are properly designed and have adequate warnings or instructions;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e246095-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/7\"><num value=\"7\">(7)</num><chapeau> notwithstanding the fact that raw materials and component parts suppliers do not design, produce, or test a final medical device, the suppliers have been the subject of actions alleging inadequate—</chapeau><subparagraph class=\"indent2\" id=\"id1e246096-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/7/A\"><num value=\"A\">(A)</num><content> design and testing of medical devices manufactured with materials or parts supplied by the suppliers; or</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1e246097-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/7/B\"><num value=\"B\">(B)</num><content> warnings related to the use of such medical devices;</content>\n</subparagraph>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e246098-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/8\"><num value=\"8\">(8)</num><content> even though suppliers of raw materials and component parts have very rarely been held liable in such actions, such suppliers have ceased supplying certain raw materials and component parts for use in medical devices for a number of reasons, including concerns about the costs of such litigation;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e246099-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/9\"><num value=\"9\">(9)</num><content> unless alternate sources of supply can be found, the unavailability of raw materials and component parts for medical devices will lead to unavailability of lifesaving and life-enhancing medical devices;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e24609a-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/10\"><num value=\"10\">(10)</num><content> because other suppliers of the raw materials and component parts in foreign nations are refusing to sell raw materials or component parts for use in manufacturing certain medical devices in the United States, the prospects for development of new sources of supply for the full range of threatened raw materials and component parts for medical devices are remote;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e2487ab-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/11\"><num value=\"11\">(11)</num><content> it is unlikely that the small market for such raw materials and component parts in the United States could support the large investment needed to develop new suppliers of such raw materials and component parts;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e2487ac-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/12\"><num value=\"12\">(12)</num><content> attempts to develop such new suppliers would raise the cost of medical devices;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e2487ad-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/13\"><num value=\"13\">(13)</num><chapeau> courts that have considered the duties of the suppliers of the raw materials and component parts have generally found that the suppliers do not have a duty—</chapeau><subparagraph class=\"indent2\" id=\"id1e2487ae-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/13/A\"><num value=\"A\">(A)</num><content> to evaluate the safety and efficacy of the use of a raw material or component part in a medical device; or</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1e2487af-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/13/B\"><num value=\"B\">(B)</num><content> to warn consumers concerning the safety and effectiveness of a medical device;</content>\n</subparagraph>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e2487b0-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/14\"><num value=\"14\">(14)</num><content> because medical devices and the raw materials and component parts used in their manufacture move in interstate commerce, a shortage of such raw materials and component parts affects interstate commerce;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e24aec1-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/15\"><num value=\"15\">(15)</num><chapeau> in order to safeguard the availability of a wide variety of lifesaving and life-enhancing medical devices, immediate action is needed—</chapeau><subparagraph class=\"indent2\" id=\"id1e24aec2-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/15/A\"><num value=\"A\">(A)</num><content> to clarify the permissible bases of liability for suppliers of raw materials and component parts for medical devices; and</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1e24aec3-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/15/B\"><num value=\"B\">(B)</num><content> to provide expeditious procedures to dispose of unwarranted suits against the suppliers in such manner as to minimize litigation costs;</content>\n</subparagraph>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e24aec4-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/16\"><num value=\"16\">(16)</num><content> the several States and their courts are the primary architects and regulators of our tort system; Congress, however, must, in certain circumstances involving the national interest, address tort issues, and a threatened shortage of raw materials and component parts for lifesaving medical devices is one such circumstance; and</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e24aec5-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1601/17\"><num value=\"17\">(17)</num><content> the protections set forth in this chapter are needed to assure the continued supply of materials for lifesaving medical devices, although such protections do not protect negligent suppliers.</content>\n</paragraph>\n<sourceCredit id=\"id1e24d5d6-f63b-11e2-8470-abc29ba29c4d\">\n(<ref href=\"/us/pl/105/230/s2\">Pub.
