<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id5f5f8fbf-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602"><num value="1602">§ 1602.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0"> As used in this chapter:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5f5f8fc0-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/1"><num value="1" class="bold">(1)</num><heading class="bold"> Biomaterials supplier</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5f5f8fc1-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The term “biomaterials supplier” means an entity that directly or indirectly supplies a component part or raw material for use in the manufacture of an implant.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5f5f8fc2-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Persons included</heading><chapeau>Such term includes any person who—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id5f5f8fc3-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/1/B/i"><num value="i">(i)</num><content> has submitted master files to the Secretary for purposes of premarket approval of a medical device; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5f5fb6d4-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/1/B/ii"><num value="ii">(ii)</num><content> licenses a biomaterials supplier to produce component parts or raw materials.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5f5fb6d5-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/2"><num value="2" class="bold">(2)</num><heading class="bold"> Claimant</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5f5fb6d6-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The term “claimant” means any person who brings a civil action, or on whose behalf a civil action is brought, arising from harm allegedly caused directly or indirectly by an implant, including a person other than the individual into whose body, or in contact with whose blood or tissue, the implant is placed, who claims to have suffered harm as a result of the implant.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5f5fb6d7-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Action brought on behalf of an estate</heading><content><p style="-uslm-lc:I13" class="indent2">With respect to an action brought on behalf of or through the estate of a deceased individual into whose body, or in contact with whose blood or tissue the implant was placed, such term includes the decedent that is the subject of the action.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5f5fb6d8-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Action brought on behalf of a minor or incompetent</heading><content><p style="-uslm-lc:I13" class="indent2">With respect to an action brought on behalf of or through a minor or incompetent, such term includes the parent or guardian of the minor or incompetent.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5f5fb6d9-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/2/D"><num value="D" class="bold">(D)</num><heading class="bold"> Exclusions</heading><chapeau>Such term does not include—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id5f5fb6da-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/2/D/i"><num value="i">(i)</num><chapeau> a provider of professional health care services in any case in which—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id5f5fb6db-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/2/D/i/I"><num value="I">(I)</num><content> the sale or use of an implant is incidental to such services; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id5f5fb6dc-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/2/D/i/II"><num value="II">(II)</num><content> the essence of the professional health care services provided is the furnishing of judgment, skill, or services;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5f5fb6dd-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/2/D/ii"><num value="ii">(ii)</num><content> a person acting in the capacity of a manufacturer, seller, or biomaterials supplier; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5f5fb6de-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/2/D/iii"><num value="iii">(iii)</num><chapeau> a person alleging harm caused by either the silicone gel or the silicone envelope utilized in a breast implant containing silicone gel, except that—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id5f5fb6df-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/2/D/iii/I"><num value="I">(I)</num><content> neither the exclusion provided by this clause nor any other provision of this chapter may be construed as a finding that silicone gel (or any other form of silicone) may or may not cause harm; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id5f5fb6e0-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/2/D/iii/II"><num value="II">(II)</num><chapeau> the existence of the exclusion under this clause may not—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id5f5fb6e1-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/2/D/iii/II/aa"><num value="aa">(aa)</num><content> be disclosed to a jury in any civil action or other proceeding; and</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id5f5fb6e2-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/2/D/iii/II/bb"><num value="bb">(bb)</num><content> except as necessary to establish the applicability of this chapter, otherwise be presented in any civil action or other proceeding.</content>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5f5fb6e3-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/3"><num value="3" class="bold">(3)</num><heading class="bold"> Component part</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5f5fb6e4-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The term “component part” means a manufactured piece of an implant.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5f5fb6e5-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Certain components</heading><chapeau>Such term includes a manufactured piece of an implant that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id5f5fb6e6-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/3/B/i"><num value="i">(i)</num><content> has significant non-implant applications; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5f5fb6e7-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/3/B/ii"><num value="ii">(ii)</num><content> alone, has no implant value or purpose, but when combined with other component parts and materials, constitutes an implant.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5f5fb6e8-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/4"><num value="4" class="bold">(4)</num><heading class="bold"> Harm</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5f5fb6e9-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau>The term “harm” means—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id5f5fb6ea-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/4/A/i"><num value="i">(i)</num><content> any injury to or damage suffered by an individual;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5f5fb6eb-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/4/A/ii"><num value="ii">(ii)</num><content> any illness, disease, or death of that individual resulting from that injury or damage; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5f5fb6ec-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/4/A/iii"><num value="iii">(iii)</num><content> any loss to that individual or any other individual resulting from that injury or damage.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5f5fddfd-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Exclusion</heading><content><p style="-uslm-lc:I13" class="indent2">The term does not include any commercial loss or loss of or damage to an implant.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5f5fddfe-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/5"><num value="5" class="bold">(5)</num><heading class="bold"> Implant</heading><chapeau>The term “implant” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id5f5fddff-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/5/A"><num value="A">(A)</num><chapeau> a medical device that is intended by the manufacturer of the device—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id5f5fde00-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/5/A/i"><num value="i">(i)</num><content> to be placed into a surgically or naturally formed or existing cavity of the body for a period of at least 30 days; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5f5fde01-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/5/A/ii"><num value="ii">(ii)</num><content> to remain in contact with bodily fluids or internal human tissue through a surgically produced opening for a period of less than 30 days; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5f5fde02-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/5/B"><num value="B">(B)</num><content> suture materials used in implant procedures.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5f5fde03-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/6"><num value="6" class="bold">(6)</num><heading class="bold"> Manufacturer</heading><chapeau>The term “manufacturer” means any person who, with respect to an implant—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id5f5fde04-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/6/A"><num value="A">(A)</num><content> is engaged in the manufacture, preparation, propagation, compounding, or processing (as defined in <ref href="/us/usc/t21/s360/a/1">section 360(a)(1) of this title</ref>) of the implant; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5f5fde05-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/6/B"><num value="B">(B)</num><chapeau> is required—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id5f5fde06-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/6/B/i"><num value="i">(i)</num><content> to register with the Secretary pursuant to <ref href="/us/usc/t21/s360">section 360 of this title</ref> and the regulations issued under such section; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5f5fde07-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/6/B/ii"><num value="ii">(ii)</num><content> to include the implant on a list of devices filed with the Secretary pursuant to <ref href="/us/usc/t21/s360/j">section 360(j) of this title</ref> and the regulations issued under such section.</content>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5f5fde08-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/7"><num value="7" class="bold">(7)</num><heading class="bold"> Medical device</heading><content><p style="-uslm-lc:I12" class="indent1">The term “medical device” means a device, as defined in <ref href="/us/usc/t21/s321/h">section 321(h) of this title</ref>, and includes any device component of any combination product as that term is used in <ref href="/us/usc/t21/s353/g">section 353(g) of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5f5fde09-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/8"><num value="8" class="bold">(8)</num><heading class="bold"> Raw material</heading><chapeau>The term “raw material” means a substance or product that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id5f5fde0a-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/8/A"><num value="A">(A)</num><content> has a generic use; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5f5fde0b-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/8/B"><num value="B">(B)</num><content> may be used in an application other than an implant.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5f5fde0c-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/9"><num value="9" class="bold">(9)</num><heading class="bold"> Secretary</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Secretary” means the Secretary of Health and Human Services.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5f5fde0d-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/10"><num value="10" class="bold">(10)</num><heading class="bold"> Seller</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5f5fde0e-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/10/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The term “seller” means a person who, in the course of a business conducted for that purpose, sells, distributes, leases, packages, labels, or otherwise places an implant in the stream of commerce.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5f5fde0f-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/10/B"><num value="B" class="bold">(B)</num><heading class="bold"> Exclusions</heading><chapeau>The term does not include—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id5f5fde10-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/10/B/i"><num value="i">(i)</num><content> a seller or lessor of real property;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5f5fde11-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/10/B/ii"><num value="ii">(ii)</num><chapeau> a provider of professional health care services in any case in which—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id5f5fde12-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/10/B/ii/I"><num value="I">(I)</num><content> the sale or use of the implant is incidental to such services; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id5f5fde13-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/10/B/ii/II"><num value="II">(II)</num><content> the essence of the professional health care services provided is the furnishing of judgment, skill, or services; or</content>

<clause style="-uslm-lc:I14" class="indent3" id="id5f5fde14-ceff-11e7-ac08-9eab3197d358" identifier="/us/usc/t21/s1602/10/B/iii"><num value="iii">(iii)</num><content> any person who acts in only a financial capacity with respect to the sale of an implant.</content>
