<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" id="id1e2635b1-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604"><num value="1604">§ 1604.</num><heading> Liability of biomaterials suppliers</heading><subsection class="indent0" id="id1e2635b2-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/a"><num value="a">(a)</num><heading> In general</heading>
<chapeau style="-uslm-lc:I11" class="blockIndent0">Except as provided in <ref href="/us/usc/t21/s1606">section 1606 of this title</ref>, a biomaterials supplier shall not be liable for harm to a claimant caused by an implant unless such supplier is liable—</chapeau><paragraph class="indent1" id="id1e2635b3-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/a/1"><num value="1">(1)</num><content> as a manufacturer of the implant, as provided in subsection (b) of this section;</content>
</paragraph>
<paragraph class="indent1" id="id1e2635b4-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/a/2"><num value="2">(2)</num><content> as a seller of the implant, as provided in subsection (c) of this section; or</content>
</paragraph>
<paragraph class="indent1" id="id1e2635b5-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/a/3"><num value="3">(3)</num><content> for furnishing raw materials or component parts for the implant that failed to meet applicable contractual requirements or specifications, as provided in subsection (d) of this section.</content>
</paragraph>
</subsection>
<subsection class="indent0" id="id1e2635b6-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/b"><num value="b">(b)</num><heading> Liability as manufacturer</heading><paragraph class="indent1" id="id1e2635b7-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/b/1"><num value="1">(1)</num><heading> In general</heading><content><p style="-uslm-lc:I12" class="indent1">A biomaterials supplier may, to the extent required and permitted by any other applicable law, be liable for harm to a claimant caused by an implant if the biomaterials supplier is the manufacturer of the implant.</p>

</paragraph>
<paragraph class="indent1" id="id1e265cc8-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/b/2"><num value="2">(2)</num><heading> Grounds for liability</heading>
<chapeau style="-uslm-lc:I12" class="blockIndent1">The biomaterials supplier may be considered the manufacturer of the implant that allegedly caused harm to a claimant only if the biomaterials supplier—</chapeau><subparagraph class="indent2" id="id1e265cc9-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/b/2/A"><num value="A">(A)</num><clause class="indent2" id="id1e265cca-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/b/2/A/i"><num value="i">(i)</num><content> registered or was required to register with the Secretary pursuant to <ref href="/us/usc/t21/s360">section 360 of this title</ref> and the regulations issued under such section; and</content>
</clause>
<clause class="indent2" id="id1e265ccb-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/b/2/A/ii"><num value="ii">(ii)</num><content> included or was required to include the implant on a list of devices filed with the Secretary pursuant to <ref href="/us/usc/t21/s360/j">section 360(j) of this title</ref> and the regulations issued under such section;</content>
</clause>
</subparagraph>
<subparagraph class="indent2" id="id1e265ccc-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/b/2/B"><num value="B">(B)</num><chapeau> is the subject of a declaration issued by the Secretary pursuant to paragraph (3) that states that the supplier, with respect to the implant that allegedly caused harm to the claimant, was required to—</chapeau><clause class="indent3" id="id1e265ccd-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/b/2/B/i"><num value="i">(i)</num><content> register with the Secretary under <ref href="/us/usc/t21/s360">section 360 of this title</ref>, and the regulations issued under such section, but failed to do so; or</content>
</clause>
<clause class="indent3" id="id1e2683de-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/b/2/B/ii"><num value="ii">(ii)</num><content> include the implant on a list of devices filed with the Secretary pursuant to <ref href="/us/usc/t21/s360/j">section 360(j) of this title</ref> and the regulations issued under such section, but failed to do so; or</content>
</clause>
</subparagraph>
<subparagraph class="indent2" id="id1e2683df-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/b/2/C"><num value="C">(C)</num><content> is related by common ownership or control to a person meeting all the requirements described in subparagraph (A) or (B), if the court deciding a motion to dismiss in accordance with <ref href="/us/usc/t21/s1605/c/3/B/i">section 1605(c)(3)(B)(i) of this title</ref> finds, on the basis of affidavits submitted in accordance with <ref href="/us/usc/t21/s1605">section 1605 of this title</ref>, that it is necessary to impose liability on the biomaterials supplier as a manufacturer because the related manufacturer meeting the requirements of subparagraph (A) or (B) lacks sufficient financial resources to satisfy any judgment that the court feels it is likely to enter should the claimant prevail.</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id1e2683e0-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/b/3"><num value="3">(3)</num><heading> Administrative procedures</heading><subparagraph class="indent2" id="id1e26aaf1-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/b/3/A"><num value="A">(A)</num><heading> In general</heading>
<chapeau style="-uslm-lc:I13" class="blockIndent2">The Secretary may issue a declaration described in paragraph (2)(B) on the motion of the Secretary or on petition by any person, after providing—</chapeau><clause class="indent3" id="id1e26aaf2-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/b/3/A/i"><num value="i">(i)</num><content> notice to the affected persons; and</content>
</clause>
<clause class="indent3" id="id1e26aaf3-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/b/3/A/ii"><num value="ii">(ii)</num><content> an opportunity for an informal hearing.</content>
</clause>
</subparagraph>
<subparagraph class="indent2" id="id1e26aaf4-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/b/3/B"><num value="B">(B)</num><heading> Docketing and final decision</heading><content><p style="-uslm-lc:I13" class="indent2">Immediately upon receipt of a petition filed pursuant to this paragraph, the Secretary shall docket the petition. Not later than 120 days after the petition is filed, the Secretary shall issue a final decision on the petition.</p>
</content>
</subparagraph>
<subparagraph class="indent2" id="id1e26aaf5-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/b/3/C"><num value="C">(C)</num><heading> Applicability of statute of limitations</heading><content><p style="-uslm-lc:I13" class="indent2">Any applicable statute of limitations shall toll during the period from the time a claimant files a petition with the Secretary under this paragraph until such time as either (i) the Secretary issues a final decision on the petition, or (ii) the petition is withdrawn.</p>
</content>
</subparagraph>
<subparagraph class="indent2" id="id1e26aaf6-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/b/3/D"><num value="D">(D)</num><heading> Stay pending petition for declaration</heading><content><p style="-uslm-lc:I13" class="indent2">If a claimant has filed a petition for a declaration with respect to a defendant, and the Secretary has not issued a final decision on the petition, the court shall stay all proceedings with respect to that defendant until such time as the Secretary has issued a final decision on the petition.</p>

</subparagraph>

</subsection>
<subsection class="indent0" id="id1e26d207-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/c"><num value="c">(c)</num><heading> Liability as seller</heading>
<chapeau style="-uslm-lc:I11" class="blockIndent0">A biomaterials supplier may, to the extent required and permitted by any other applicable law, be liable as a seller for harm to a claimant caused by an implant only if—</chapeau><paragraph class="indent1" id="id1e26d208-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/c/1"><num value="1">(1)</num><chapeau> the biomaterials supplier—</chapeau><subparagraph class="indent2" id="id1e26d209-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/c/1/A"><num value="A">(A)</num><content> held title to the implant and then acted as a seller of the implant after its initial sale by the manufacturer; or</content>
</subparagraph>
<subparagraph class="indent2" id="id1e26d20a-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/c/1/B"><num value="B">(B)</num><content> acted under contract as a seller to arrange for the transfer of the implant directly to the claimant after the initial sale by the manufacturer of the implant; or</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id1e26d20b-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/c/2"><num value="2">(2)</num><content> the biomaterials supplier is related by common ownership or control to a person meeting all the requirements described in paragraph (1), if a court deciding a motion to dismiss in accordance with <ref href="/us/usc/t21/s1605/c/3/B/ii">section 1605(c)(3)(B)(ii) of this title</ref> finds, on the basis of affidavits submitted in accordance with <ref href="/us/usc/t21/s1605">section 1605 of this title</ref>, that it is necessary to impose liability on the biomaterials supplier as a seller because the related seller meeting the requirements of paragraph (1) lacks sufficient financial resources to satisfy any judgment that the court feels it is likely to enter should the claimant prevail.</content>
</paragraph>
</subsection>
<subsection class="indent0" id="id1e26f91c-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/d"><num value="d">(d)</num><heading> Liability for failure to meet applicable contractual requirements or specifications</heading>
<chapeau style="-uslm-lc:I11" class="blockIndent0">A biomaterials supplier may, to the extent required and permitted by any other applicable law, be liable for harm to a claimant caused by an implant if the claimant in an action shows, by a preponderance of the evidence, that—</chapeau><paragraph class="indent1" id="id1e26f91d-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/d/1"><num value="1">(1)</num><chapeau> the biomaterials supplier supplied raw materials or component parts for use in the implant that either—</chapeau><subparagraph class="indent2" id="id1e26f91e-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/d/1/A"><num value="A">(A)</num><content> did not constitute the product described in the contract between the biomaterials supplier and the person who contracted for the supplying of the product; or</content>
</subparagraph>
<subparagraph class="indent2" id="id1e26f91f-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/d/1/B"><num value="B">(B)</num><chapeau> failed to meet any specifications that were—</chapeau><clause class="indent3" id="id1e26f920-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/d/1/B/i"><num value="i">(i)</num><content> accepted, pursuant to applicable law, by the biomaterials supplier;</content>
</clause>
<clause class="indent3" id="id1e272031-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/d/1/B/ii"><num value="ii">(ii)</num><content> published by the biomaterials supplier;</content>
</clause>
<clause class="indent3" id="id1e272032-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/d/1/B/iii"><num value="iii">(iii)</num><content> provided by the biomaterials supplier to the person who contracted for such product;</content>
</clause>
<clause class="indent3" id="id1e272033-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/d/1/B/iv"><num value="iv">(iv)</num><content> contained in a master file that was submitted by the biomaterials supplier to the Secretary and that is currently maintained by the biomaterials supplier for purposes of premarket approval of medical devices; or</content>
</clause>
<clause class="indent3" id="id1e272034-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/d/1/B/v"><num value="v">(v)</num><content> included in the submissions for purposes of premarket approval or review by the Secretary under section 360, 360c, 360e, or 360j of this title, and received clearance from the Secretary if such specifications were accepted, pursuant to applicable law, by the biomaterials supplier; and</content>
</clause>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id1e272035-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s1604/d/2"><num value="2">(2)</num><content> such failure to meet applicable contractual requirements or specifications was an actual and proximate cause of the harm to the claimant.</content>
