<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id7de2eab3-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605"><num value="1605">§ 1605.</num><heading> Procedures for dismissal of civil actions against biomaterials suppliers</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7de2eab4-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/a"><num value="a" class="bold">(a)</num><heading class="bold"> Motion to dismiss</heading><chapeau style="-uslm-lc:I11" class="indent0">A defendant may, at any time during which a motion to dismiss may be filed under applicable law, move to dismiss an action against it on the grounds that the defendant is a biomaterials supplier and one or more of the following:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7de2eab5-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/a/1"><num value="1">(1)</num><content> The defendant is not liable as a manufacturer, as provided in <ref href="/us/usc/t21/s1604/b">section 1604(b) of this title</ref>.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7de2eab6-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/a/2"><num value="2">(2)</num><content> The defendant is not liable as a seller, as provided in <ref href="/us/usc/t21/s1604/c">section 1604(c) of this title</ref>.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id7de311c7-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/a/3"><num value="3">(3)</num><content> The defendant is not liable for furnishing raw materials or component parts for the implant that failed to meet applicable contractual requirements or specifications, as provided in <ref href="/us/usc/t21/s1604/d">section 1604(d) of this title</ref>.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id7de311c8-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/a/4"><num value="4">(4)</num><content> The claimant did not name the manufacturer as a party to the action, as provided in subsection (b).</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7de311c9-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/b"><num value="b" class="bold">(b)</num><heading class="bold"> Manufacturer of implant shall be named a party</heading><chapeau style="-uslm-lc:I11" class="indent0">In any civil action covered by this chapter, the claimant shall be required to name the manufacturer of the implant as a party to the action, unless—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7de311ca-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/b/1"><num value="1">(1)</num><content> the manufacturer is subject to service of process solely in a jurisdiction in which the biomaterials supplier is not domiciled or subject to a service of process; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7de311cb-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/b/2"><num value="2">(2)</num><content> a claim against the manufacturer is barred by applicable law or rule of practice.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7de311cc-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/c"><num value="c" class="bold">(c)</num><heading class="bold"> Proceeding on motion to dismiss</heading><chapeau style="-uslm-lc:I11" class="indent0">The following rules shall apply to any proceeding on a motion to dismiss filed by a defendant under this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7de311cd-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Effect of motion to dismiss on discovery</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7de311ce-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/c/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Except as provided in subparagraph (B), if a defendant files a motion to dismiss under subsection (a), no discovery shall be permitted in connection with the action that is the subject of the motion, other than discovery necessary to determine a motion to dismiss for lack of jurisdiction, until such time as the court rules on the motion to dismiss.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7de338df-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/c/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Discovery</heading><chapeau style="-uslm-lc:I13" class="indent2">If a defendant files a motion to dismiss under subsection (a)(3) on the grounds that it did not furnish raw materials or component parts for the implant that failed to meet applicable contractual requirements or specifications, the court may permit discovery limited to issues that are directly relevant to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7de338e0-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/c/1/B/i"><num value="i">(i)</num><content> the pending motion to dismiss; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7de338e1-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/c/1/B/ii"><num value="ii">(ii)</num><content> the jurisdiction of the court.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7de338e2-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Affidavits</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7de338e3-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/c/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Defendant</heading><content><p style="-uslm-lc:I13" class="indent2">A defendant may submit affidavits supporting the grounds for dismissal contained in its motion to dismiss under subsection (a). If the motion is made under subsection (a)(1), the defendant may submit an affidavit demonstrating that the defendant has not included the implant on a list, if any, filed with the Secretary pursuant to <ref href="/us/usc/t21/s360/j">section 360(j) of this title</ref>.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7de338e4-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/c/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Claimant</heading><chapeau style="-uslm-lc:I13" class="indent2">In response to a motion to dismiss, the claimant may submit affidavits demonstrating that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7de338e5-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/c/2/B/i"><num value="i">(i)</num><content> the Secretary has, with respect to the defendant and the implant that allegedly caused harm to the claimant, issued a declaration pursuant to <ref href="/us/usc/t21/s1604/b/2/B">section 1604(b)(2)(B) of this title</ref>; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7de35ff6-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/c/2/B/ii"><num value="ii">(ii)</num><content> the defendant is a seller of the implant who is liable under <ref href="/us/usc/t21/s1604/c">section 1604(c) of this title</ref>.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7de35ff7-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Basis of ruling on motion to dismiss</heading><chapeau style="-uslm-lc:I12" class="indent1">The court shall rule on a motion to dismiss filed under subsection (a) solely on the basis of the pleadings and affidavits of the parties made pursuant to this subsection. The court shall grant a motion to dismiss filed under subsection (a)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7de35ff8-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/c/3/A"><num value="A">(A)</num><content> unless the claimant submits a valid affidavit that demonstrates that the defendant is not a biomaterials supplier;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7de35ff9-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/c/3/B"><num value="B">(B)</num><chapeau> unless the court determines, to the extent raised in the pleadings and affidavits, that one or more of the following apply:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7de35ffa-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/c/3/B/i"><num value="i">(i)</num><content> the defendant may be liable as a manufacturer, as provided in <ref href="/us/usc/t21/s1604/b">section 1604(b) of this title</ref>;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7de35ffb-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/c/3/B/ii"><num value="ii">(ii)</num><content> the defendant may be liable as a seller, as provided in <ref href="/us/usc/t21/s1604/c">section 1604(c) of this title</ref>; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7de35ffc-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/c/3/B/iii"><num value="iii">(iii)</num><content> the defendant may be liable for furnishing raw materials or component parts for the implant that failed to meet applicable contractual requirements or specifications, as provided in <ref href="/us/usc/t21/s1604/d">section 1604(d) of this title</ref>; or</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7de35ffd-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/c/3/C"><num value="C">(C)</num><content> if the claimant did not name the manufacturer as a party to the action, as provided in subsection (b).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7de35ffe-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/c/4"><num value="4" class="bold">(4)</num><heading class="bold"> Treatment of motion as motion for summary judgment</heading><content><p style="-uslm-lc:I12" class="indent1">The court may treat a motion to dismiss as a motion for summary judgment subject to subsection (d) in order to determine whether the pleadings and affidavits, in connection with such action, raise genuine issues of material fact concerning whether the defendant furnished raw materials or component parts of the implant that failed to meet applicable contractual requirements or specifications as provided in <ref href="/us/usc/t21/s1604/d">section 1604(d) of this title</ref>.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7de3870f-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/d"><num value="d" class="bold">(d)</num><heading class="bold"> Summary judgment</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7de38710-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7de38711-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/d/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Basis for entry of judgment</heading><content><p style="-uslm-lc:I13" class="indent2">If a motion to dismiss of a biomaterials supplier is to be treated as a motion for summary judgment under subsection (c)(4) or if a biomaterials supplier moves for summary judgment, the biomaterials supplier shall be entitled to entry of judgment without trial if the court finds there is no genuine issue of material fact for each applicable element set forth in paragraphs (1) and (2) of <ref href="/us/usc/t21/s1604/d">section 1604(d) of this title</ref>.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7de38712-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/d/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Issues of material fact</heading><content><p style="-uslm-lc:I13" class="indent2">With respect to a finding made under subparagraph (A), the court shall consider a genuine issue of material fact to exist only if the evidence submitted by the claimant would be sufficient to allow a reasonable jury to reach a verdict for the claimant if the jury found the evidence to be credible.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7de3ae23-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Discovery made prior to a ruling on a motion for summary judgment</heading><content><p style="-uslm-lc:I12" class="indent1">If, under applicable rules, the court permits discovery prior to a ruling on a motion for summary judgment governed by <ref href="/us/usc/t21/s1604/d">section 1604(d) of this title</ref>, such discovery shall be limited solely to establishing whether a genuine issue of material fact exists as to the applicable elements set forth in paragraphs (1) and (2) of <ref href="/us/usc/t21/s1604/d">section 1604(d) of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7de3ae24-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Discovery with respect to a biomaterials supplier</heading><content><p style="-uslm-lc:I12" class="indent1">A biomaterials supplier shall be subject to discovery in connection with a motion seeking dismissal or summary judgment on the basis of the inapplicability of <ref href="/us/usc/t21/s1604/d">section 1604(d) of this title</ref> or the failure to establish the applicable elements of <ref href="/us/usc/t21/s1604/d">section 1604(d) of this title</ref> solely to the extent permitted by the applicable Federal or State rules for discovery against nonparties.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7de3ae25-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/e"><num value="e" class="bold">(e)</num><heading class="bold"> Dismissal with prejudice</heading><content><p style="-uslm-lc:I11" class="indent0">An order granting a motion to dismiss or for summary judgment pursuant to this section shall be entered with prejudice, except insofar as the moving defendant may be rejoined to the action as provided in <ref href="/us/usc/t21/s1606">section 1606 of this title</ref>.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7de3ae26-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1605/f"><num value="f" class="bold">(f)</num><heading class="bold"> Manufacturer conduct of litigation</heading><content><p style="-uslm-lc:I11" class="indent0">The manufacturer of an implant that is the subject of an action covered under this chapter shall be permitted to conduct litigation on any motion for summary judgment or dismissal filed by a biomaterials supplier who is a defendant under this section on behalf of such supplier if the manufacturer and any other defendant in such action enter into a valid and applicable contractual agreement under which the manufacturer agrees to bear the cost of such litigation or to conduct such litigation.</p>
