L. 109–469, title I, § 102, title XI, § 1120, Dec. 29, 2006, 120 Stat. 3505, 3548.)","seq_in_title":560,"parent_identifier":"/us/usc/t21/ch22","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch22","level":"chapter","num":"CHAPTER 22—","heading":"NATIONAL DRUG CONTROL POLICY","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id2a294de6-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702\"><num value=\"1702\">§ 1702.</num><heading> Office of National Drug Control Policy</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2 bold\" id=\"id2a294de7-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/a\"><num value=\"a\">(a)</num><heading> Establishment of Office</heading><chapeau>There is established in the Executive Office of the President an Office of National Drug Control Policy, which shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2a294de8-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/a/1\"><num value=\"1\">(1)</num><content> develop national drug control policy;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2a294de9-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/a/2\"><num value=\"2\">(2)</num><content> coordinate and oversee the implementation of the national drug control policy;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2a294dea-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/a/3\"><num value=\"3\">(3)</num><content> assess and certify the adequacy of National Drug Control Programs and the budget for those programs; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2a294deb-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/a/4\"><num value=\"4\">(4)</num><content> evaluate the effectiveness of the national drug control policy and the National Drug Control Program agencies’ programs, by developing and applying specific goals and performance measurements.</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">When developing the national drug control policy, any policy of the Director relating to syringe exchange programs for intravenous drug users shall be based on the best available medical and scientific evidence regarding their effectiveness in promoting individual health and preventing the spread of infectious disease, and their impact on drug addiction and use. In making any policy relating to syringe exchange programs, the Director shall consult with the National Institutes of Health and the National Academy of Sciences.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2 bold\" id=\"id2a294dec-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/b\"><num value=\"b\">(b)</num><heading> Director of National Drug Control Policy and Deputy Directors</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2 bold\" id=\"id2a294ded-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/b/1\"><num value=\"1\">(1)</num><heading> Director</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">There shall be a Director of National Drug Control Policy who shall head the Office (referred to in this chapter as the “Director”) and shall hold the same rank and status as the head of an executive department listed in <ref href=\"/us/usc/t5/s101\">section 101 of title 5</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2 bold\" id=\"id2a294dee-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/b/2\"><num value=\"2\">(2)</num><heading> Deputy Director</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">There shall be a Deputy Director of National Drug Control Policy who shall report directly to the Director (referred to in this chapter as the “Deputy Director”).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2 bold\" id=\"id2a294def-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/b/3\"><num value=\"3\">(3)</num><heading> Other Deputy Directors</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2 bold\" id=\"id2a294df0-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/b/3/A\"><num value=\"A\">(A)</num><heading> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">There shall be a Deputy Director for Demand Reduction, a Deputy Director for Supply Reduction, and a Deputy Director for State, Local, and Tribal Affairs.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2 bold\" id=\"id2a294df1-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/b/3/B\"><num value=\"B\">(B)</num><heading> Reporting</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Deputy Director for Demand Reduction, the Deputy Director for Supply Reduction, and the Deputy Director for State, Local, and Tribal Affairs shall report directly to the Deputy Director of the Office of National Drug Control Policy.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2 bold\" id=\"id2a294df2-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/b/3/C\"><num value=\"C\">(C)</num><heading> Deputy Director for Demand Reduction</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Deputy Director for Demand Reduction shall be responsible for the activities in subparagraphs (A) through (H) of section 1701(1) <ref class=\"footnoteRef\" idref=\"fn002127\">1</ref><note type=\"footnote\" id=\"fn002127\"><num>1</num> See References in Text note below.</note> of this title.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2 bold\" id=\"id2a294df3-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/b/3/D\"><num value=\"D\">(D)</num><heading> Deputy Director for Supply Reduction</heading><chapeau>The Deputy Director for Supply Reduction shall—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2a294df4-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/b/3/D/i\"><num value=\"i\">(i)</num><content> have substantial experience and expertise in drug interdiction and other supply reduction activities; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2a294df5-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/b/3/D/ii\"><num value=\"ii\">(ii)</num><content> be responsible for the activities in subparagraphs (A) through (C) in <ref href=\"/us/usc/t21/s1701/11\">section 1701(11) of this title</ref>.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2 bold\" id=\"id2a294df6-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/b/3/E\"><num value=\"E\">(E)</num><heading> Deputy Director for State, Local, and Tribal Affairs</heading><chapeau>The Deputy Director for State, Local, and Tribal Affairs shall be responsible for the activities—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2a294df7-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/b/3/E/i\"><num value=\"i\">(i)</num><content> in subparagraphs (A) through (D) of <ref href=\"/us/usc/t21/s1701/10\">section 1701(10) of this title</ref>;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2a294df8-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/b/3/E/ii\"><num value=\"ii\">(ii)</num><content> in <ref href=\"/us/usc/t21/s1706\">section 1706 of this title</ref>, the High Intensity Drug Trafficking Areas Program; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2a294df9-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/b/3/E/iii\"><num value=\"iii\">(iii)</num><content> in <ref href=\"/us/usc/t21/s1707\">section 1707 of this title</ref>, the Counterdrug Technology Assessment Center.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2 bold\" id=\"id2a294dfa-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/c\"><num value=\"c\">(c)</num><heading> Access by Congress</heading><chapeau>The location of the Office in the Executive Office of the President shall not be construed as affecting access by Congress, or any committee of the House of Representatives or the Senate, to any—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2a294dfb-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/c/1\"><num value=\"1\">(1)</num><content> information, document, or study in the possession of, or conducted by or at the direction of the Director; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2a294dfc-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/c/2\"><num value=\"2\">(2)</num><content> personnel of the Office.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2 bold\" id=\"id2a294dfd-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/d\"><num value=\"d\">(d)</num><heading> Office of National Drug Control Policy Gift Fund</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2 bold\" id=\"id2a294dfe-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/d/1\"><num value=\"1\">(1)</num><heading> Establishment</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">There is established in the Treasury of the United States a fund for the receipt of gifts, both real and personal, for the purpose of aiding or facilitating the work of the Office under <ref href=\"/us/usc/t21/s1703/c\">section 1703(c) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2 bold\" id=\"id2a2bbeff-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/d/2\"><num value=\"2\">(2)</num><heading> Contributions</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Office may accept, hold, and administer contributions to the Fund.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2 bold\" id=\"id2a2bbf00-3271-11e3-81c9-db9a7820b8d4\" identifier=\"/us/usc/t21/s1702/d/3\"><num value=\"3\">(3)</num><heading> Use of amounts deposited</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Amounts deposited in the Fund are authorized to be appropriated, to remain available until expended for authorized purposes at the discretion of the Director.</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id2a2bbf01-3271-11e3-81c9-db9a7820b8d4\">(<ref href=\"/us/pl/105/277/s703\">Pub. There is approved for the Office of National Drug Control Policy in the Executive Office of the President an official seal described as follows:</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">On a blue disc the Arms of the United States proper above a curved gold scroll inscribed “OFFICE OF NATIONAL DRUG CONTROL POLICY” in blue letters, all within a white border edged in gold and inscribed “EXECUTIVE OFFICE OF THE PRESIDENT OF THE UNITED STATES” in blue letters.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">This design is appropriate for the Office of National Drug Control Policy. The dark blue in this seal is suggested by the Seal of the President and denotes the direct organizational link of the Office of National Drug Control Policy with the Presidential office. The Arms of the United States refer to the entire Nation and represent the involvement in drug control policies that are necessary to assist the President in his role as Chief Executive of the United States.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\"><inline class=\"small-caps\">Sec</inline>. 2.
