L. 116–74, § 2(a)(2), (4), Nov. 27, 2019, 133 Stat. 1155.)","seq_in_title":650,"parent_identifier":"/us/usc/t21/ch22","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch22","level":"chapter","num":"CHAPTER 22—","heading":"NATIONAL DRUG CONTROL POLICY","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id2325e023-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702\"><num value=\"1702\">§ 1702.</num><heading> Office of National Drug Control Policy</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id2325e024-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Establishment of Office</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">There is established in the Executive Office of the President an Office of National Drug Control Policy, which shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2325e025-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/a/1\"><num value=\"1\">(1)</num><content> lead the national drug control effort, including coordinating with the National Drug Control Program agencies;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2325e026-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/a/2\"><num value=\"2\">(2)</num><content> coordinate and oversee the implementation of the national drug control policy, including the National Drug Control Strategy;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2325e027-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/a/3\"><num value=\"3\">(3)</num><content> assess and certify the adequacy of National Drug Control Programs and the budget for those programs;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2325e028-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/a/4\"><num value=\"4\">(4)</num><content> evaluate the effectiveness of national drug control policy efforts, including the National Drug Control Program Agencies’ <ref class=\"footnoteRef\" idref=\"fn002167\">1</ref><note type=\"footnote\" id=\"fn002167\"><num>1</num> So in original. Probably should be “agencies’ ”.</note> programs, by developing and applying specific goals and performance measurements and monitoring the agencies’ program-level spending;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2325e029-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/a/5\"><num value=\"5\">(5)</num><content> identify and respond to emerging drug threats related to illicit drug use;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2325e02a-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/a/6\"><num value=\"6\">(6)</num><content> administer the Drug-Free Communities Program, the High Intensity Drug Trafficking Areas Program, and other grant programs directly authorized to be administered by the Office in furtherance of the National Drug Control Strategy; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2325e02b-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/a/7\"><num value=\"7\">(7)</num><content> facilitate broad-scale information sharing and data standardization among Federal, State, and local entities to support the national drug control efforts.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id2325e02c-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Repealed. <ref href=\"/us/pl/115/271/tVIII/s8222/1\">Pub. L. 115–271, title VIII, § 8222(1)</ref>, <date date=\"2018-10-24\">Oct. 24, 2018</date>, <ref href=\"/us/stat/132/4142\">132 Stat. 4142</ref></heading><content/>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id2325e02d-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Access by Congress</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The location of the Office in the Executive Office of the President shall not be construed as affecting access by Congress, or any committee of the House of Representatives or the Senate, to any—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2325e02e-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/c/1\"><num value=\"1\">(1)</num><content> information, document, or study in the possession of, or conducted by or at the direction of the Director; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2325e02f-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/c/2\"><num value=\"2\">(2)</num><content> personnel of the Office.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id2325e030-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Office of National Drug Control Policy Gift Fund</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2325e031-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Establishment</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">There is established in the Treasury of the United States a fund for the receipt of gifts, both real and personal, for the purpose of aiding or facilitating the work of the Office under <ref href=\"/us/usc/t21/s1703/c\">section 1703(c) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2325e032-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Contributions</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Office may accept, hold, and administer contributions to the Fund.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2325e033-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/d/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Use of amounts deposited</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Amounts deposited in the Fund are authorized to be appropriated, to remain available until expended for authorized purposes at the discretion of the Director.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2325e034-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/d/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Ethics guidelines</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Director shall establish written guidelines setting forth the criteria to be used in determining whether a gift or donation should be declined under this subsection because the acceptance of the gift or donation would—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2325e035-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/d/4/A\"><num value=\"A\">(A)</num><content> reflect unfavorably upon the ability of the Director or the Office, or any employee of the Office, to carry out responsibilities or official duties under this chapter in a fair and objective manner; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2325e036-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/d/4/B\"><num value=\"B\">(B)</num><content> compromise the integrity or the appearance of integrity of programs or services provided under this chapter or of any official involved in those programs or services.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2325e037-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/d/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Registry of gifts</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Director shall maintain a list of—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2325e038-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/d/5/A\"><num value=\"A\">(A)</num><content> the source and amount of each gift or donation accepted by the Office; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2325e039-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/d/5/B\"><num value=\"B\">(B)</num><content> the source and amount of each gift or donation accepted by a contractor to be used in its performance of a contract for the Office.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2325e03a-68b0-11ec-ace1-900962f451a9\" identifier=\"/us/usc/t21/s1702/d/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Report to Congress</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Director shall include in the annual assessment under <ref href=\"/us/usc/t21/s1705/g\">section 1705(g) of this title</ref> a copy of the registry maintained under paragraph (5).</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id2325e03b-68b0-11ec-ace1-900962f451a9\">(<ref href=\"/us/pl/105/277/dC/tVII\">Pub. The dark blue in this seal is suggested by the Seal of the President and denotes the direct organizational link of the Office of National Drug Control Policy with the Presidential office. The Arms of the United States refer to the entire Nation and represent the involvement in drug control policies that are necessary to assist the President in his role as Chief Executive of the United States.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\"><inline class=\"small-caps\">Sec</inline>. 2.
