L. 109–469, title I, § 104, Dec. 29, 2006, 120 Stat. 3510.)","seq_in_title":607,"parent_identifier":"/us/usc/t21/ch22","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch22","level":"chapter","num":"CHAPTER 22—","heading":"NATIONAL DRUG CONTROL POLICY","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" id=\"id1e31f5ad-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704\"><num value=\"1704\">§ 1704.</num><heading> Coordination with National Drug Control Program agencies in demand reduction, supply reduction, and State and local affairs</heading><subsection class=\"indent0\" id=\"id1e31f5ae-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/a\"><num value=\"a\">(a)</num><heading> Access to information</heading><paragraph class=\"indent1\" id=\"id1e31f5af-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/a/1\"><num value=\"1\">(1)</num><heading> In general</heading>\n<chapeau style=\"-uslm-lc:I12\" class=\"blockIndent1\">Upon the request of the Director, the head of any National Drug Control Program agency shall cooperate with and provide to the Director any statistics, studies, reports, and other information prepared or collected by the agency concerning the responsibilities of the agency under the National Drug Control Strategy that relate to—</chapeau><subparagraph class=\"indent2\" id=\"id1e321cc0-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/a/1/A\"><num value=\"A\">(A)</num><content> drug control; or</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1e321cc1-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/a/1/B\"><num value=\"B\">(B)</num><content> the manner in which amounts made available to that agency for drug control are being used by that agency.</content>\n</subparagraph>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e321cc2-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/a/2\"><num value=\"2\">(2)</num><heading> Protection of intelligence information</heading><subparagraph class=\"indent2\" id=\"id1e321cc3-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/a/2/A\"><num value=\"A\">(A)</num><heading> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The authorities conferred on the Office and the Director by this chapter shall be exercised in a manner consistent with provisions of the National Security Act of 1947 [<ref href=\"/us/usc/t50/s3001\">50 U.S.C. 3001</ref> et seq.]. The Director of National Intelligence shall prescribe such regulations as may be necessary to protect information provided pursuant to this chapter regarding intelligence sources and methods.</p>\n</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1e321cc4-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/a/2/B\"><num value=\"B\">(B)</num><heading> Duties of Director</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Director of National Intelligence and the Director of the Central Intelligence Agency shall, to the maximum extent practicable in accordance with subparagraph (A), render full assistance and support to the Office and the Director.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e3243d5-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/a/3\"><num value=\"3\">(3)</num><heading> Required reports</heading><subparagraph class=\"indent2\" id=\"id1e3243d6-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/a/3/A\"><num value=\"A\">(A)</num><heading> Secretaries of the Interior and Agriculture</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Not later than July 1 of each year, the Secretaries of Agriculture and the Interior shall jointly submit to the Director and the appropriate congressional committees an assessment of the quantity of illegal drug cultivation and manufacturing in the United States on lands owned or under the jurisdiction of the Federal Government for the preceding year.</p>\n</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1e3243d7-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/a/3/B\"><num value=\"B\">(B)</num><heading> Secretary of Homeland Security</heading>\n<chapeau style=\"-uslm-lc:I13\" class=\"blockIndent2\">Not later than July 1 of each year, the Secretary of Homeland Security shall submit to the Director and the appropriate congressional committees information for the preceding year regarding—</chapeau><clause class=\"indent3\" id=\"id1e3243d8-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/a/3/B/i\"><num value=\"i\">(i)</num><content> the number and type of seizures of drugs by each component of the Department of Homeland Security seizing drugs, as well as statistical information on the geographic areas of such seizures; and</content>\n</clause>\n<clause class=\"indent3\" id=\"id1e3243d9-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/a/3/B/ii\"><num value=\"ii\">(ii)</num><content> the number of air and maritime patrol hours primarily dedicated to drug supply reduction missions undertaken by each component of the Department of Homeland Security.</content>\n</clause>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1e326aea-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/a/3/C\"><num value=\"C\">(C)</num><heading> Secretary of Defense</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary of Defense shall, by July 1 of each year, submit to the Director and the appropriate congressional committees information for the preceding year regarding the number of air and maritime patrol hours primarily dedicated to drug supply reduction missions undertaken by each component of the Department of Defense.</p>\n</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1e326aeb-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/a/3/D\"><num value=\"D\">(D)</num><heading> Attorney General</heading>\n<chapeau style=\"-uslm-lc:I13\" class=\"blockIndent2\">The Attorney General shall, by July 1 of each year, submit to the Director and the appropriate congressional committees information for the preceding year regarding the number and type of—</chapeau><clause class=\"indent3\" id=\"id1e326aec-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/a/3/D/i\"><num value=\"i\">(i)</num><content> arrests for drug violations;</content>\n</clause>\n<clause class=\"indent3\" id=\"id1e326aed-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/a/3/D/ii\"><num value=\"ii\">(ii)</num><content> prosecutions for drug violations by United States Attorneys; and</content>\n</clause>\n<clause class=\"indent3\" id=\"id1e326aee-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/a/3/D/iii\"><num value=\"iii\">(iii)</num><content> seizures of drugs by each component of the Department of Justice seizing drugs, as well as statistical information on the geographic areas of such seizures.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection class=\"indent0\" id=\"id1e3291ff-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/b\"><num value=\"b\">(b)</num><heading> Certification of policy changes to Director</heading><paragraph class=\"indent1\" id=\"id1e329200-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/b/1\"><num value=\"1\">(1)</num><heading> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Subject to paragraph (2), the head of a National Drug Control Program agency shall, unless exigent circumstances require otherwise, notify the Director in writing regarding any proposed change in policies relating to the activities of that agency under the National Drug Control Program prior to implementation of such change. The Director shall promptly review such proposed change and certify to the head of that agency in writing whether such change is consistent with the National Drug Control Strategy.</p>\n</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e329201-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/b/2\"><num value=\"2\">(2)</num><heading> Exception</heading>\n<chapeau style=\"-uslm-lc:I12\" class=\"blockIndent1\">If prior notice of a proposed change under paragraph (1) is not practicable—</chapeau><subparagraph class=\"indent2\" id=\"id1e329202-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/b/2/A\"><num value=\"A\">(A)</num><content> the head of the National Drug Control Program agency shall notify the Director of the proposed change as soon as practicable; and</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1e329203-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/b/2/B\"><num value=\"B\">(B)</num><content> upon such notification, the Director shall review the change and certify to the head of that agency in writing whether the change is consistent with the National Drug Control Strategy.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection class=\"indent0\" id=\"id1e329204-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/c\"><num value=\"c\">(c)</num><heading> General Services Administration</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Administrator of General Services shall provide to the Director, on a reimbursable basis, such administrative support services as the Director may request.</p>\n</content>\n</subsection>\n<subsection class=\"indent0\" id=\"id1e32b915-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/d\"><num value=\"d\">(d)</num><heading> Accounting of funds expended</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"blockIndent0\">The Director shall—</chapeau><subparagraph class=\"indent1\" id=\"id1e32b916-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/d/A\"><num value=\"A\">(A)</num><content> require the National Drug Control Program agencies to submit to the Director not later than February 1 of each year a detailed accounting of all funds expended by the agencies for National Drug Control Program activities during the previous fiscal year, and require such accounting to be authenticated by the Inspector General for each agency prior to submission to the Director; and</content>\n</subparagraph>\n<subparagraph class=\"indent1\" id=\"id1e32b917-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1704/d/B\"><num value=\"B\">(B)</num><content> submit to Congress not later than April 1 of each year the information submitted to the Director under subparagraph (A).</content>\n</subparagraph>\n</subsection>\n<sourceCredit id=\"id1e32b918-f63b-11e2-8470-abc29ba29c4d\">\n(<ref href=\"/us/pl/105/277/s705\">Pub.
