<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idf52b16ed-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705"><num value="1705">§ 1705.</num><heading> Development, submission, implementation, and assessment of National Drug Control Strategy</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf52b16ee-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf52b16ef-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Statement of drug policy priorities</heading><content><p style="-uslm-lc:I12" class="indent1">The Director shall release a statement of drug control policy priorities in the calendar year of a Presidential inauguration following the inauguration, but not later than April 1.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf52b16f0-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> National Drug Control Strategy submitted by the President</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than the first Monday in February following the year in which the term of the President commences, and every 2 years thereafter, the President shall submit to Congress a National Drug Control Strategy.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf52b16f1-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/b"><num value="b" class="bold">(b)</num><heading class="bold"> Development of the National Drug Control Strategy</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf52b16f2-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Promulgation</heading><content><p style="-uslm-lc:I12" class="indent1">The Director shall promulgate the National Drug Control Strategy, which shall set forth a comprehensive plan to reduce illicit drug use and the consequences of such illicit drug use in the United States by limiting the availability of and reducing the demand for illegal drugs and promoting prevention, early intervention, treatment, and recovery support for individuals with substance use disorders.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf52b16f3-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> State and local commitment</heading><content><p style="-uslm-lc:I12" class="indent1">The Director shall seek the support and commitment of State, local, and Tribal officials in the formulation and implementation of the National Drug Control Strategy.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf52b16f4-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Strategy based on evidence</heading><content><p style="-uslm-lc:I12" class="indent1">The Director shall ensure the National Drug Control Strategy is based on the best available evidence regarding the policies that are most effective in reducing the demand for and supply of illegal drugs.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf52b16f5-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Process for development and submission of National Drug Control Strategy</heading><chapeau style="-uslm-lc:I12" class="indent1">In developing and effectively implementing the National Drug Control Strategy, the Director—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b16f6-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/b/4/A"><num value="A">(A)</num><chapeau> shall consult with—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf52b16f7-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/b/4/A/i"><num value="i">(i)</num><content> the heads of the National Drug Control Program agencies;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b16f8-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/b/4/A/ii"><num value="ii">(ii)</num><content> each Coordinator listed in <ref href="/us/usc/t21/s1703">section 1703 of this title</ref>;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b16f9-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/b/4/A/iii"><num value="iii">(iii)</num><content> the Interdiction Committee and the Emerging Threats Committee;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b16fa-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/b/4/A/iv"><num value="iv">(iv)</num><content> the appropriate congressional committees and any other committee of jurisdiction;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b16fb-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/b/4/A/v"><num value="v">(v)</num><content> State, local, and Tribal officials;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b16fc-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/b/4/A/vi"><num value="vi">(vi)</num><content> private citizens and organizations, including community and faith-based organizations, with experience and expertise in demand reduction;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b16fd-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/b/4/A/vii"><num value="vii">(vii)</num><content> private citizens and organizations with experience and expertise in supply reduction; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b16fe-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/b/4/A/viii"><num value="viii">(viii)</num><content> appropriate representatives of foreign governments; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b16ff-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/b/4/B"><num value="B">(B)</num><content> in satisfying the requirements of subparagraph (A), shall ensure, to the maximum extent possible, that State, local, and Tribal officials and relevant private organizations commit to support and take steps to achieve the goals and objectives of the National Drug Control Strategy.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf52b1700-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c"><num value="c" class="bold">(c)</num><heading class="bold"> Contents of the National Drug Control Strategy</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf52b1701-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The National Drug Control Strategy submitted under subsection (a)(2) shall include the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1702-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/A"><num value="A">(A)</num><content> A mission statement detailing the major functions of the National Drug Control Program.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1703-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/B"><num value="B">(B)</num><content> Comprehensive, research-based, long-range, quantifiable goals for reducing illicit drug use, and the consequences of illicit drug use in the United States.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1704-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/C"><num value="C">(C)</num><content> Annual quantifiable and measurable objectives and specific targets to accomplish long-term quantifiable goals that the Director determines may be achieved during each year beginning on the date on which the National Drug Control Strategy is submitted.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1705-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/D"><num value="D">(D)</num><content> A 5-year projection for the National Drug Control Program and budget priorities.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1706-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/E"><num value="E">(E)</num><content> A review of international, State, local, and private sector drug control activities to ensure that the United States pursues coordinated and effective drug control at all levels of government.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1707-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/F"><num value="F">(F)</num><chapeau> A description of how each goal established under subparagraph (B) will be achieved, including for each goal—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf52b1708-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/F/i"><num value="i">(i)</num><content> a list of each relevant National Drug Control Program agency and each such agency’s related programs, activities, and available assets and the role of each such program, activity, and asset in achieving such goal;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b1709-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/F/ii"><num value="ii">(ii)</num><content> a list of relevant stakeholders and each such stakeholder’s role in achieving such goal;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b170a-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/F/iii"><num value="iii">(iii)</num><content> an estimate of Federal funding and other resources needed to achieve such goal;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b170b-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/F/iv"><num value="iv">(iv)</num><content> a list of each existing or new coordinating mechanism needed to achieve such goal; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b170c-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/F/v"><num value="v">(v)</num><content> a description of the Office’s role in facilitating the achievement of such goal.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b170d-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/G"><num value="G">(G)</num><chapeau> For each year covered by the Strategy, a performance evaluation plan for each goal established under subparagraph (B) for each National Drug Control Program agency, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf52b170e-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/G/i"><num value="i">(i)</num><content> specific performance measures for each National Drug Control Program agency;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b170f-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/G/ii"><num value="ii">(ii)</num><content> annual and, to the extent practicable, quarterly objectives and targets for each performance measure; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b1710-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/G/iii"><num value="iii">(iii)</num><content> an estimate of Federal funding and other resources needed to achieve each performance objective and target.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1711-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/H"><num value="H">(H)</num><content> A list identifying existing data sources or a description of data collection needed to evaluate performance, including a description of how the Director will obtain such data.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1712-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/I"><num value="I">(I)</num><content> A list of any anticipated challenges to achieving the National Drug Control Strategy goals and planned actions to address such challenges.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1713-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/J"><num value="J">(J)</num><chapeau> A description of how each goal established under subparagraph (B) was determined, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf52b1714-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/J/i"><num value="i">(i)</num><content> a description of each required consultation and a description of how such consultation was incorporated; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b1715-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/J/ii"><num value="ii">(ii)</num><content> data, research, or other information used to inform the determination to establish the goal.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1716-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/K"><num value="K">(K)</num><content> A description of the current prevalence of illicit drug use in the United States, including both the availability of illicit drugs and the prevalence of substance use disorders.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1717-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/L"><num value="L">(L)</num><content> Such other statistical data and information as the Director considers appropriate to demonstrate and assess trends relating to illicit drug use, the effects and consequences of illicit drug use (including the effects on children), supply reduction, demand reduction, drug-related law enforcement, and the implementation of the National Drug Control Strategy.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1718-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/M"><num value="M">(M)</num><chapeau> A systematic plan for increasing data collection to enable real time surveillance of drug control threats, developing analysis and monitoring capabilities, and identifying and addressing policy questions related to the National Drug Control Strategy and Program, which shall include—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf52b1719-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/M/i"><num value="i">(i)</num><content> a list of policy-relevant questions for which the Director and each National Drug Control Program agency intends to develop evidence to support the National Drug Control Program and Strategy;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b171a-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/M/ii"><num value="ii">(ii)</num><content> a list of data the Director and each National Drug Control Program agency intends to collect, use, or acquire to facilitate the use of evidence in drug control policymaking and monitoring;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b171b-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/M/iii"><num value="iii">(iii)</num><content> a list of methods and analytical approaches that may be used to develop evidence to support the National Drug Control Program and Strategy and related policy;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b171c-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/M/iv"><num value="iv">(iv)</num><content> a list of any challenges to developing evidence to support policymaking, including any barriers to accessing, collecting, or using relevant data;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b171d-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/M/v"><num value="v">(v)</num><content> a description of the steps the Director and the head of each National Drug Control Program agency will take to effectuate the plan; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b171e-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/M/vi"><num value="vi">(vi)</num><content> any other relevant information as determined by the Director.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b171f-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/N"><num value="N">(N)</num><chapeau> A plan to expand treatment of substance use disorders, which shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf52b1720-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/N/i"><num value="i">(i)</num><content> identify unmet needs for treatment for substance use disorders and a strategy for closing the gap between available and needed treatment;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b1721-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/N/ii"><num value="ii">(ii)</num><content> describe the specific roles and responsibilities of the relevant National Drug Control Program agencies for implementing the plan;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b1722-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/N/iii"><num value="iii">(iii)</num><content> identify the specific resources required to enable the relevant National Drug Control Program agencies to implement that strategy; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b1723-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/1/N/iv"><num value="iv">(iv)</num><content> identify the resources, including private sources, required to eliminate the unmet need for evidence-based substance use disorder treatment.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf52b1724-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Consultation</heading><chapeau style="-uslm-lc:I12" class="indent1">In developing the plan required under paragraph (1)(M), the Director shall consult with the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1725-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/2/A"><num value="A">(A)</num><content> The public.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1726-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/2/B"><num value="B">(B)</num><content> Any evaluation or analysis units and personnel of the Office.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1727-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/2/C"><num value="C">(C)</num><content> Office officials responsible for implementing privacy policy.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1728-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/2/D"><num value="D">(D)</num><content> Office officials responsible for data governance.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1729-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/2/E"><num value="E">(E)</num><content> The appropriate congressional committees.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b172a-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/2/F"><num value="F">(F)</num><content> Any other individual or entity as determined by the Director.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf52b172b-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Additional strategies</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf52b172c-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">The Director shall include in the National Drug Control Strategy the additional strategies described under this paragraph and shall comply with the following:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf52b172d-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/A/i"><num value="i">(i)</num><content> Provide a copy of the additional strategies to the appropriate congressional committees and to the Committee on Armed Services and the Committee on Homeland Security of the House of Representatives, and the Committee on Homeland Security and Governmental Affairs and the Committee on Armed Services of the Senate.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b172e-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/A/ii"><num value="ii">(ii)</num><content> Issue the additional strategies in consultation with the head of each relevant National Drug Control Program agency, any relevant official of a State, local, or Tribal government, and the government of other relevant countries.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b172f-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/A/iii"><num value="iii">(iii)</num><content> Not change any existing agency authority or construe any strategy described under this paragraph to amend or modify any law governing interagency relationship but may include recommendations about changes to such authority or law.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b1730-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/A/iv"><num value="iv">(iv)</num><content> Present separately from the rest of any strategy described under this paragraph any information classified under criteria established by an Executive order, or whose public disclosure, as determined by the Director or the head of any relevant National Drug Control Program agency, would be detrimental to the law enforcement or national security activities of any Federal, State, local, or Tribal agency.</content>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf52b1731-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Requirement for Southwest Border Counternarcotics Strategy</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idf52b1732-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> Purposes</heading><chapeau style="-uslm-lc:I14" class="indent3">The Southwest Border Counternarcotics Strategy shall—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idf52b1733-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/B/i/I"><num value="I">(I)</num><content> set forth the Government’s strategy for preventing the illegal trafficking of drugs across the international border between the United States and Mexico, including through ports of entry and between ports of entry on that border;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf52b1734-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/B/i/II"><num value="II">(II)</num><content> state the specific roles and responsibilities of the relevant National Drug Control Program agencies for implementing that strategy; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf52b1735-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/B/i/III"><num value="III">(III)</num><content> identify the specific resources required to enable the relevant National Drug Control Program agencies to implement that strategy.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idf52b1736-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Specific content related to drug tunnels between the United States and Mexico</heading><chapeau style="-uslm-lc:I14" class="indent3">The Southwest Border Counternarcotics Strategy shall include—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idf52b1737-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/B/ii/I"><num value="I">(I)</num><content> a strategy to end the construction and use of tunnels and subterranean passages that cross the international border between the United States and Mexico for the purpose of illegal trafficking of drugs across such border; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf52b1738-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/B/ii/II"><num value="II">(II)</num><content> recommendations for criminal penalties for persons who construct or use such a tunnel or subterranean passage for such a purpose.</content>

</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idf52b1739-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Requirement for Northern Border Counternarcotics Strategy</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idf52b173a-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/C/i"><num value="i" class="bold">(i)</num><heading class="bold"> Purposes</heading><chapeau style="-uslm-lc:I14" class="indent3">The Northern Border Counternarcotics Strategy shall—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idf52b173b-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/C/i/I"><num value="I">(I)</num><content> set forth the strategy of the Federal Government for preventing the illegal trafficking of drugs across the international border between the United States and Canada, including through ports of entry and between ports of entry on the border;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf52b173c-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/C/i/II"><num value="II">(II)</num><content> state the specific roles and responsibilities of each relevant National Drug Control Program agency for implementing the strategy;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf52b173d-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/C/i/III"><num value="III">(III)</num><content> identify the specific resources required to enable the relevant National Drug Control Program agencies to implement the strategy;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf52b173e-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/C/i/IV"><num value="IV">(IV)</num><content> be designed to promote, and not hinder, legitimate trade and travel; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf52b173f-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/C/i/V"><num value="V">(V)</num><content> reflect the unique nature of small communities along the international border between the United States and Canada, ongoing cooperation and coordination with Canadian law,<ref class="footnoteRef" idref="fn002189">1</ref><note type="footnote" id="fn002189"><num>1</num> So in original. The comma probably should not appear.</note> enforcement authorities, and variations in the volumes of vehicles and pedestrians crossing through ports of entry along the international border between the United States and Canada.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idf52b1740-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/C/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Specific content related to cross-border Indian reservations</heading><chapeau style="-uslm-lc:I14" class="indent3">The Northern Border Counternarcotics Strategy shall include—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idf52b1741-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/C/ii/I"><num value="I">(I)</num><content> a strategy to end the illegal trafficking of drugs to or through Indian reservations on or near the international border between the United States and Canada; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf52b1742-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/3/C/ii/II"><num value="II">(II)</num><content> recommendations for additional assistance, if any, needed by Tribal law enforcement agencies relating to the strategy, including an evaluation of Federal technical and financial assistance, infrastructure capacity building, and interoperability deficiencies.</content>
</subclause>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf52b1743-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/4"><num value="4" class="bold">(4)</num><heading class="bold"> Classified information</heading><content><p style="-uslm-lc:I12" class="indent1">Any contents of the National Drug Control Strategy that involve information properly classified under criteria established by an Executive order shall be presented to Congress separately from the rest of the National Drug Control Strategy.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf52b1744-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/5"><num value="5" class="bold">(5)</num><heading class="bold"> Selection of data and information</heading><chapeau style="-uslm-lc:I12" class="indent1">In selecting data and information for inclusion in the Strategy, the Director shall ensure—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1745-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/5/A"><num value="A">(A)</num><content> the inclusion of data and information that will permit analysis of current trends against previously compiled data and information where the Director believes such analysis enhances long-term assessment of the National Drug Control Strategy; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1746-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/c/5/B"><num value="B">(B)</num><content> the inclusion of data and information to permit a standardized and uniform assessment of the effectiveness of drug treatment programs in the United States.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf52b1747-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/d"><num value="d" class="bold">(d)</num><heading class="bold"> Submission of revised Strategy</heading><chapeau style="-uslm-lc:I11" class="indent0">The President may submit to Congress a revised National Drug Control Strategy that meets the requirements of this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idf52b1748-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/d/1"><num value="1">(1)</num><content> at any time, upon a determination of the President, in consultation with the Director, that the National Drug Control Strategy in effect is not sufficiently effective; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf52b1749-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/d/2"><num value="2">(2)</num><content> if a new President or Director takes office.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf52b174a-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/e"><num value="e" class="bold">(e)</num><heading class="bold"> Failure of Director to Submit National Drug Control Strategy</heading><chapeau style="-uslm-lc:I11" class="indent0">If the Director does not submit a National Drug Control Strategy to Congress in accordance with subsection (a)(2), not later than five days after the first Monday in February following the year in which the term of the President commences, the Director shall send a notification to the appropriate congressional committees—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idf52b174b-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/e/1"><num value="1">(1)</num><content> explaining why the Strategy was not submitted; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf52b174c-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/e/2"><num value="2">(2)</num><content> specifying the date by which the Strategy will be submitted.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf52b174d-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f"><num value="f" class="bold">(f)</num><heading class="bold"> Drug Control Data Dashboard</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf52b174e-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Director shall collect and disseminate, as appropriate, such information as the Director determines is appropriate, but not less than the information described in this subsection. The data shall be publicly available in a machine-readable format on the online portal of the Office, and to the extent practicable on the Drug Control Data Dashboard.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf52b174f-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I12" class="indent1">The Director shall publish to the online portal of the Office in a machine-readable, sortable, and searchable format, or to the extent practicable, establish and maintain a data dashboard on the online portal of the Office to be known as the “Drug Control Data Dashboard”. To the extent practicable, when establishing the Drug Control Dashboard, the Director shall ensure the user interface of the dashboard is constructed with modern design standards. To the extent practicable, the data made available on the dashboard shall be publicly available in a machine-readable format and searchable by year, agency, drug, and location.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf52b1750-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3"><num value="3" class="bold">(3)</num><heading class="bold"> Data</heading><chapeau style="-uslm-lc:I12" class="indent1">The data included in the Drug Control Data Dashboard shall be updated quarterly to the extent practicable, but not less frequently than annually and shall include, at a minimum, the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1751-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3/A"><num value="A">(A)</num><chapeau> For each substance identified by the Director as having a significant impact on the prevalence of illicit drug use—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf52b1752-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3/A/i"><num value="i">(i)</num><chapeau> data sufficient to show the quantities of such substance available in the United States, including—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idf52b1753-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3/A/i/I"><num value="I">(I)</num><content> the total amount seized and disrupted in the calendar year and each of the previous 3 calendar years, including to the extent practicable the amount seized by State, local, and Tribal governments;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf52b1754-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3/A/i/II"><num value="II">(II)</num><content> the known and estimated flows into the United States from all sources in the calendar year and each of the previous 3 calendar years;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf52b1755-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3/A/i/III"><num value="III">(III)</num><content> the total amount of known flows that could not be interdicted or disrupted in the calendar year and each of the previous 3 calendar years;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf52b1756-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3/A/i/IV"><num value="IV">(IV)</num><content> the known and estimated levels of domestic production in the calendar year and each of the previous three calendar years, including the levels of domestic production if the drug is a prescription drug, as determined under the Federal Food, Drug, and Cosmetic Act [<ref href="/us/usc/t21/s301">21 U.S.C. 301</ref> et seq.], for which a listing is in effect under <ref href="/us/usc/t21/s812">section 812 of this title</ref>;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf52b1757-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3/A/i/V"><num value="V">(V)</num><content> the average street price for the calendar year and the highest known street price during the preceding 10-year period; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf52b1758-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3/A/i/VI"><num value="VI">(VI)</num><content> to the extent practicable, related prosecutions by State, local, and Tribal governments; <ref class="footnoteRef" idref="fn002190">2</ref><note type="footnote" id="fn002190"><num>2</num> So in original. Probably should be followed by “and”.</note></content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b1759-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3/A/ii"><num value="ii">(ii)</num><chapeau> data sufficient to show the frequency of use of such substance, including—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idf52b175a-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3/A/ii/I"><num value="I">(I)</num><content> use of such substance in the workplace and productivity lost by such use;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf52b175b-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3/A/ii/II"><num value="II">(II)</num><content> use of such substance by arrestees, probationers, and parolees;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf52b175c-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3/A/ii/III"><num value="III">(III)</num><content> crime and criminal activity related to such substance; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idf52b175d-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3/A/ii/IV"><num value="IV">(IV)</num><content> to the extent practicable, related prosecutions by State, local, and Tribal governments.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b175e-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3/B"><num value="B">(B)</num><chapeau> For the calendar year and each of the previous three years data sufficient to show, disaggregated by State and, to the extent feasible, by region within a State, county, or city, the following:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idf52b175f-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3/B/i"><num value="i">(i)</num><content> The number of fatal and non-fatal overdoses caused by each drug identified under subparagraph (A)(i).</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b1760-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3/B/ii"><num value="ii">(ii)</num><content> The prevalence of substance use disorders.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b1761-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3/B/iii"><num value="iii">(iii)</num><content> The number of individuals who have received substance use disorder treatment, including medication assisted treatment, for a substance use disorder, including treatment provided through publicly-financed health care programs.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idf52b1762-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3/B/iv"><num value="iv">(iv)</num><content> The extent of the unmet need for substance use disorder treatment, including the unmet need for medication-assisted treatment.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1763-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3/C"><num value="C">(C)</num><content> Data sufficient to show the extent of prescription drug diversion, trafficking, and misuse in the calendar year and each of the previous 3 calendar years.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1764-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/f/3/D"><num value="D">(D)</num><content> Any quantifiable measures the Director determines to be appropriate to detail progress toward the achievement of the goals of the National Drug Control Strategy.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf52b1765-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/g"><num value="g" class="bold">(g)</num><heading class="bold"> Development of an annual national drug control assessment</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf52b1766-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/g/1"><num value="1" class="bold">(1)</num><heading class="bold"> Timing</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than the first Monday in February of each year, the Director shall submit to the President, Congress, and the appropriate congressional committees, a report assessing the progress of each National Drug Control Program agency toward achieving each goal, objective, and target contained in the National Drug Control Strategy applicable to the prior fiscal year.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idf52b1767-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/g/2"><num value="2" class="bold">(2)</num><heading class="bold"> Process for development of the annual assessment</heading><chapeau style="-uslm-lc:I12" class="indent1">Not later than November 1 of each year, the head of each National Drug Control Program agency shall submit, in accordance with guidance issued by the Director, to the Director an evaluation of progress by the agency with respect to the National Drug Control Strategy goals using the performance measures for the agency developed under this chapter, including progress with respect to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1768-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/g/2/A"><num value="A">(A)</num><content> success in achieving the goals of the National Drug Control Strategy;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1769-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/g/2/B"><num value="B">(B)</num><content> success in reducing domestic and foreign sources of illegal drugs;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b176a-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/g/2/C"><num value="C">(C)</num><content> success in expanding access to and increasing the effectiveness of substance use disorder treatment;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b176b-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/g/2/D"><num value="D">(D)</num><content> success in protecting the borders of the United States (and in particular the Southwestern border of the United States) from penetration by illegal narcotics;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b176c-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/g/2/E"><num value="E">(E)</num><content> success in reducing crime associated with drug use in the United States;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b176d-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/g/2/F"><num value="F">(F)</num><content> success in reducing the negative health and social consequences of drug use in the United States;</content>
</subparagraph>

<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1772-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/g/3/B"><num value="B">(B)</num><content> a summary of the progress of each National Drug Control Program agency toward the National Drug Control Strategy goals of the agency using the performance measures for the agency developed under this chapter;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1773-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/g/3/C"><num value="C">(C)</num><content> an assessment of the effectiveness of each National Drug Control Program agency and program in achieving the National Drug Control Strategy for the previous year, including a specific evaluation of whether the applicable goals, measures, objectives, and targets for the previous year were met; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b1774-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/g/3/D"><num value="D">(D)</num><content> the assessments required under this subsection shall be based on the Performance Measurement System.<ref class="footnoteRef" idref="fn002191">3</ref><note type="footnote" id="fn002191"><num>3</num> So in original.</note></content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idf52b1775-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/h"><num value="h" class="bold">(h)</num><heading class="bold"> Performance measurement system</heading><chapeau style="-uslm-lc:I11" class="indent0">Not later than February 1 of each year, the Director shall submit to Congress as part of the National Drug Control Strategy, a description of a national drug control performance measurement system, that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idf52b1776-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/h/1"><num value="1">(1)</num><content> develops 2-year and 5-year performance measures and targets for each National Drug Control Strategy goal and objective established for reducing drug use, availability, and the consequences of drug use;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf52b1777-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/h/2"><num value="2">(2)</num><content> describes the sources of information and data that will be used for each performance measure incorporated into the performance measurement system;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf52b1778-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/h/3"><num value="3">(3)</num><content> identifies major programs and activities of the National Drug Control Program agencies that support the goals and annual objectives of the National Drug Control Strategy;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf52b1779-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/h/4"><num value="4">(4)</num><content> evaluates the contribution of demand reduction and supply reduction activities as defined in <ref href="/us/usc/t21/s1701">section 1701 of this title</ref> implemented by each National Drug Control Program agency in support of the National Drug Control Strategy;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf52b177a-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/h/5"><num value="5">(5)</num><content> monitors consistency between the drug-related goals and objectives of the National Drug Control Program agencies and ensures that each agency’s goals and budgets support and are fully consistent with the National Drug Control Strategy;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf52b177b-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/h/6"><num value="6">(6)</num><chapeau> coordinates the development and implementation of national drug control data collection and reporting systems to support policy formulation and performance measurement, including an assessment of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b177c-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/h/6/A"><num value="A">(A)</num><content> the quality of current drug use measurement instruments and techniques to measure supply reduction and demand reduction activities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b177d-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/h/6/B"><num value="B">(B)</num><content> the adequacy of the coverage of existing national drug use measurement instruments and techniques to measure the illicit drug user population, and groups that are at risk for illicit drug use;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b177e-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/h/6/C"><num value="C">(C)</num><content> the adequacy of the coverage of existing national treatment outcome monitoring systems to measure the effectiveness of drug abuse treatment in reducing illicit drug use and criminal behavior during and after the completion of substance abuse treatment; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idf52b177f-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/h/6/D"><num value="D">(D)</num><content> the actions the Director shall take to correct any deficiencies and limitations identified pursuant to subparagraphs (A) and (B) of this subsection; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idf52b1780-6371-11ee-b61f-b0ed6a65d7e9" identifier="/us/usc/t21/s1705/h/7"><num value="7">(7)</num><content> develops performance measures and targets for the National Drug Control Strategy for supplemental strategies (the Southwest Border, Northern Border, and Caribbean Border Counternarcotics Strategies) to effectively evaluate region-specific goals, to the extent the performance measurement system does not adequately measure the effectiveness of the strategies, as determined by the Director, such strategies may evaluate interdiction efforts at and between ports of entry, interdiction technology, intelligence sharing, diplomacy, and other appropriate metrics, specific to each supplemental strategies region, as determined by the Director.</content>
</paragraph>
