<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id7df53abf-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708"><num value="1708">§ 1708.</num><heading> Emerging Threats Committee, plan, and media campaign</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7df53ac0-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/a"><num value="a" class="bold">(a)</num><heading class="bold"> Emerging and Continuing Threats Coordinator</heading><content><p style="-uslm-lc:I11" class="indent0">The Director shall designate or appoint a United States Emerging and Continuing Threats Coordinator to perform the duties of that position described in this section and such other duties as may be determined by the Director. For purposes of carrying out the previous sentence, the Director shall designate or appoint an appointee in the Senior Executive Service or an appointee in a position at level 15 of the General Schedule (or equivalent).</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7df53ac1-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/b"><num value="b" class="bold">(b)</num><heading class="bold"> Emerging Threats Committee</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df53ac2-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The Emerging Threats Committee shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7df53ac3-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/b/1/A"><num value="A">(A)</num><content> monitor evolving and emerging drug threats in the United States;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df53ac4-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/b/1/B"><num value="B">(B)</num><content> identify and discuss evolving and emerging drug trends in the United States using the criteria required to be established under paragraph (6);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df53ac5-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/b/1/C"><num value="C">(C)</num><content> assist in the formulation of and oversee implementation of any plan described in subsection (d);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df53ac6-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/b/1/D"><num value="D">(D)</num><content> provide such other advice to the Coordinator and Director concerning strategy and policies for emerging drug threats and trends as the Committee determines to be appropriate; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df53ac7-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/b/1/E"><num value="E">(E)</num><chapeau> disseminate and facilitate the sharing with Federal, State, local, and Tribal officials and other entities as determined by the Director of pertinent information and data relating to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7df561d8-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/b/1/E/i"><num value="i">(i)</num><content> recent trends in drug supply and demand;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7df561d9-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/b/1/E/ii"><num value="ii">(ii)</num><content> fatal and nonfatal overdoses;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7df561da-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/b/1/E/iii"><num value="iii">(iii)</num><content> demand for and availability of evidence-based substance use disorder treatment, including the extent of the unmet treatment need, and treatment admission trends;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7df561db-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/b/1/E/iv"><num value="iv">(iv)</num><content> recent trends in drug interdiction, supply, and demand from State, local, and Tribal law enforcement agencies; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7df561dc-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/b/1/E/v"><num value="v">(v)</num><content> other subject matter as determined necessary by the Director.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df561dd-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Chairperson</heading><content><p style="-uslm-lc:I12" class="indent1">The Director shall designate one of the members of the Emerging Threats Committee to serve as Chairperson.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df561de-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Members</heading><chapeau style="-uslm-lc:I12" class="indent1">The Director shall appoint other members of the Committee, which shall include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7df561df-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/b/3/A"><num value="A">(A)</num><content> representatives from National Drug Control Program agencies or other agencies;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df561e0-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/b/3/B"><num value="B">(B)</num><content> representatives from State, local, and Tribal governments; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df561e1-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/b/3/C"><num value="C">(C)</num><content> representatives from other entities as designated by the Director.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df561e2-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Meetings</heading><content><p style="-uslm-lc:I12" class="indent1">The members of the Emerging Threats Committee shall meet, in person and not through any delegate or representative, not less frequently than once per calendar year, before June 1. At the call of the Director or the Chairperson, the Emerging Threats Committee may hold additional meetings as the members may choose.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df561e3-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/b/5"><num value="5" class="bold">(5)</num><heading class="bold"> Contract, agreement, and other authority</heading><content><p style="-uslm-lc:I12" class="indent1">The Director may award contracts, enter into interagency agreements, manage individual projects, and conduct other activities in support of the identification of emerging drug threats and in support of the development, implementation, and assessment of any Emerging Threat Response Plan.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df588f4-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/b/6"><num value="6" class="bold">(6)</num><heading class="bold"> Criteria to identify emerging drug threats</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 180 days after the date on which the Committee first meets, the Committee shall develop and recommend to the Director criteria to be used to identify an emerging drug threat or the termination of an emerging drug threat designation based on information gathered by the Committee, statistical data, and other evidence.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7df588f5-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/c"><num value="c" class="bold">(c)</num><heading class="bold"> Designation</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df588f6-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Director, in consultation with the Coordinator, the Committee, and the head of each National Drug Control Program agency, may designate an emerging drug threat in the United States.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df588f7-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Standards for designation</heading><content><p style="-uslm-lc:I12" class="indent1">The Director, in consultation with the Coordinator, shall promulgate and make publicly available standards by which a designation under paragraph (1) and the termination of such designation may be made. In developing such standards, the Director shall consider the recommendations of the committee and other criteria the Director considers to be appropriate.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df588f8-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Public statement required</heading><content><p style="-uslm-lc:I12" class="indent1">The Director shall publish a public written statement on the portal of the Office explaining the designation of an emerging drug threat or the termination of such designation and shall notify the appropriate congressional committees of the availability of such statement when a designation or termination of such designation has been made.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7df5b009-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/d"><num value="d" class="bold">(d)</num><heading class="bold"> Plan</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df5b00a-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Public availability of plan</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 90 days after making a designation under subsection (c), the Director shall publish and make publicly available an Emerging Threat Response Plan and notify the President and the appropriate congressional committees of such plan’s availability.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df5b00b-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Timing</heading><content><p style="-uslm-lc:I12" class="indent1">Concurrently with the annual submissions under <ref href="/us/usc/t21/s1705/g">section 1705(g) of this title</ref>, the Director shall update the plan and report on implementation of the plan, until the Director issues the public statement required under subsection (c)(3) to terminate the emerging drug threat designation.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df5b00c-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Contents of an emerging threat response plan</heading><chapeau style="-uslm-lc:I12" class="indent1">The Director shall include in the plan required under this subsection—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7df5b00d-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/d/3/A"><num value="A">(A)</num><content> a comprehensive strategic assessment of the emerging drug threat, including the current availability of, demand for, and effectiveness of evidence-based prevention, treatment, and enforcement programs and efforts to respond to the emerging drug threat;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df5b00e-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/d/3/B"><num value="B">(B)</num><content> comprehensive, research-based, short- and long-term, quantifiable goals for addressing the emerging drug threat, including for reducing the supply of the drug designated as the emerging drug threat and for expanding the availability and effectiveness of evidence-based substance use disorder treatment and prevention programs to reduce the demand for the emerging drug threat;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df5d71f-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/d/3/C"><num value="C">(C)</num><content> performance measures pertaining to the plan’s goals, including quantifiable and measurable objectives and specific targets;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df5d720-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/d/3/D"><num value="D">(D)</num><content> the level of funding needed to implement the plan, including whether funding is available to be reprogrammed or transferred to support implementation of the plan or whether additional appropriations are necessary to implement the plan;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df5d721-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/d/3/E"><num value="E">(E)</num><content> an implementation strategy for the media campaign under subsection (f), including goals as described under subparagraph (B) of this paragraph and performance measures, objectives, and targets, as described under subparagraph (C) of this paragraph; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df5d722-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/d/3/F"><num value="F">(F)</num><content> any other information necessary to inform the public of the status, progress, or response to an emerging drug threat.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df5d723-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> Implementation</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7df5d724-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/d/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Not later than 120 days after the date on which a designation is made under subsection (c), the Director, in consultation with the President, the appropriate congressional committees, and the head of each National Drug Control Program agency, shall issue guidance on implementation of the plan described in this subsection to the National Drug Control Program agencies and any other relevant agency determined to be necessary by the Director.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7df5d725-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/d/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Coordinator’s responsibilities</heading><chapeau style="-uslm-lc:I13" class="indent2">The Coordinator shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7df5d726-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/d/4/B/i"><num value="i">(i)</num><content> direct the implementation of the plan among the agencies identified in the plan, State, local, and Tribal governments, and other relevant entities;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7df5fe37-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/d/4/B/ii"><num value="ii">(ii)</num><content> facilitate information-sharing between agencies identified in the plan, State, local, and Tribal governments, and other relevant entities; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7df5fe38-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/d/4/B/iii"><num value="iii">(iii)</num><content> monitor implementation of the plan by coordinating the development and implementation of collection and reporting systems to support performance measurement and adherence to the plan by agencies identified in the plan, where appropriate.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7df5fe39-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/d/4/C"><num value="C" class="bold">(C)</num><heading class="bold"> Reporting</heading><content><p style="-uslm-lc:I13" class="indent2">Not later than 180 days after the date on which a designation is made under subsection (c) and in accordance with subparagraph (A), the head of each agency identified in the plan shall submit to the Coordinator a report on implementation of the plan.</p>
</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7df5fe3a-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/e"><num value="e" class="bold">(e)</num><heading class="bold"> Evaluation of media campaign</heading><content><p style="-uslm-lc:I11" class="indent0">Upon designation of an emerging drug threat, the Director shall evaluate whether a media campaign would be appropriate to address that threat.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7df5fe3b-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f"><num value="f" class="bold">(f)</num><heading class="bold"> National anti-drug media campaign</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df5fe3c-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The Director shall, to the extent feasible and appropriate, conduct a national anti-drug media campaign (referred to in this subsection as the “national media campaign”) in accordance with this subsection for the purposes of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7df5fe3d-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/1/A"><num value="A">(A)</num><content> preventing substance abuse among people in the United States;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df5fe3e-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/1/B"><num value="B">(B)</num><content> educating the public about the dangers and negative consequences of substance use and abuse, including patient and family education about the characteristics and hazards of substance abuse and methods to safeguard against substance use, to include the safe disposal of prescription medications;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df6254f-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/1/C"><num value="C">(C)</num><content> supporting evidence-based prevention programs targeting the attitudes, perception, and beliefs of persons concerning substance use and intentions to initiate or continue such use;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df62550-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/1/D"><num value="D">(D)</num><chapeau> encouraging individuals affected by substance use disorders to seek treatment and providing such individuals with information on—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7df62551-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/1/D/i"><num value="i">(i)</num><content> how to recognize addiction issues;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7df62552-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/1/D/ii"><num value="ii">(ii)</num><content> what forms of evidence-based treatment options are available; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7df62553-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/1/D/iii"><num value="iii">(iii)</num><content> how to access such treatment;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df62554-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/1/E"><num value="E">(E)</num><content> combating the stigma of addiction and substance use disorders, including the stigma of treating such disorders with medication-assisted treatment therapies; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df62555-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/1/F"><num value="F">(F)</num><content> informing the public about the dangers of any drug identified by the Director as an emerging drug threat as appropriate.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df62556-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Use of funds</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7df62557-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">Amounts made available to carry out this subsection for the national media campaign may only be used for the following:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7df62558-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/A/i"><num value="i">(i)</num><content> The purchase of media time and space, including the strategic planning for, tracking, and accounting of, such purchases.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7df62559-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/A/ii"><num value="ii">(ii)</num><content> Creative and talent costs, consistent with subparagraph (B)(i).</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7df6255a-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/A/iii"><num value="iii">(iii)</num><content> Advertising production costs, which may include television, radio, internet, social media, and other commercial marketing venues.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7df64b6b-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/A/iv"><num value="iv">(iv)</num><content> Testing and evaluation of advertising.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7df64b6c-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/A/v"><num value="v">(v)</num><content> Evaluation of the effectiveness of the national media campaign.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7df64b6d-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/A/vi"><num value="vi">(vi)</num><content> Costs of contracts to carry out activities authorized by this subsection.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7df64b6e-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/A/vii"><num value="vii">(vii)</num><content> Partnerships with professional and civic groups, community-based organizations, including faith-based organizations, and government organizations related to the national media campaign.</content>
</clause>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7df64b71-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Specific requirements</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id7df64b72-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> Creative services</heading><chapeau style="-uslm-lc:I14" class="indent3">In using amounts for creative and talent costs under subparagraph (A)(ii), the Director shall use creative services donated at no cost to the Government wherever feasible and may only procure creative services for advertising—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id7df64b73-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/B/i/I"><num value="I">(I)</num><content> responding to high-priority or emergent campaign needs that cannot timely be obtained at no cost; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id7df64b74-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/B/i/II"><num value="II">(II)</num><content> intended to reach a minority, ethnic, or other special audience that cannot reasonably be obtained at no cost.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id7df64b75-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Testing and evaluation of advertising</heading><content><p style="-uslm-lc:I14" class="indent3">In using amounts for testing and evaluation of advertising under subparagraph (A)(iv), the Director shall test all advertisements prior to use in the national media campaign to ensure that the advertisements are effective with the target audience and meet industry-accepted standards. The Director may waive this requirement for advertisements using no more than 10 percent of the purchase of advertising time purchased under this subsection in a fiscal year and no more than 10 percent of the advertising space purchased under this subsection in a fiscal year, if the advertisements respond to emergent and time-sensitive campaign needs or the advertisements will not be widely utilized in the national media campaign.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id7df67286-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/B/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Consultation</heading><chapeau style="-uslm-lc:I14" class="indent3">For the planning of the campaign under paragraph (1), the Director may consult with—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id7df67287-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/B/iii/I"><num value="I">(I)</num><content> the head of any appropriate National Drug Control Program agency;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id7df67288-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/B/iii/II"><num value="II">(II)</num><content> experts on the designated drug;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id7df67289-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/B/iii/III"><num value="III">(III)</num><content> State, local, and Tribal government officials and relevant agencies;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id7df6728a-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/B/iii/IV"><num value="IV">(IV)</num><content> communications professionals;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id7df6728b-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/B/iii/V"><num value="V">(V)</num><content> the public; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id7df6728c-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/B/iii/VI"><num value="VI">(VI)</num><content> appropriate congressional committees.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id7df6728d-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/B/iv"><num value="iv" class="bold">(iv)</num><heading class="bold"> Evaluation of effectiveness of national media campaign</heading><chapeau style="-uslm-lc:I14" class="indent3">In using amounts for the evaluation of the effectiveness of the national media campaign under subparagraph (A)(v), the Director shall—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id7df6728e-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/B/iv/I"><num value="I">(I)</num><chapeau> designate an independent entity to evaluate by April 20 of each year the effectiveness of the national media campaign based on data from—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id7df6728f-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/B/iv/I/aa"><num value="aa">(aa)</num><content> the Monitoring the Future Study published by the Department of Health and Human Services;</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id7df699a0-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/B/iv/I/bb"><num value="bb">(bb)</num><content> the National Survey on Drug Use and Health; and</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id7df699a1-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/B/iv/I/cc"><num value="cc">(cc)</num><content> other relevant studies or publications, as determined by the Director, including tracking and evaluation data collected according to marketing and advertising industry standards; and</content>
</item>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id7df699a2-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/2/B/iv/II"><num value="II">(II)</num><content> ensure that the effectiveness of the national media campaign is evaluated in a manner that enables consideration of whether the national media campaign has contributed to changes in attitude or behaviors among the target audience with respect to substance use and such other measures of evaluation as the Director determines are appropriate.</content>
</subclause>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df699a3-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/3"><num value="3" class="bold">(3)</num><heading class="bold"> Advertising</heading><content><p style="-uslm-lc:I12" class="indent1">In carrying out this subsection, the Director shall ensure that sufficient funds are allocated to meet the stated goals of the national media campaign.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df699a4-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/4"><num value="4" class="bold">(4)</num><heading class="bold"> Responsibilities and functions under the program</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7df699a5-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Director shall determine the overall purposes and strategy of the national media campaign.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7df699a6-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Director</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id7df699a7-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/4/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I14" class="indent3">The Director shall approve—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id7df699a8-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/4/B/i/I"><num value="I">(I)</num><content> the strategy of the national media campaign;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id7df699a9-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/4/B/i/II"><num value="II">(II)</num><content> all advertising and promotional material used in the national media campaign; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id7df699aa-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/4/B/i/III"><num value="III">(III)</num><content> the plan for the purchase of advertising time and space for the national media campaign.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id7df6c0bb-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/4/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Implementation</heading><chapeau style="-uslm-lc:I14" class="indent3">The Director shall be responsible for implementing a focused national media campaign to meet the purposes set forth in paragraph (1) and shall ensure—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id7df6c0bc-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/4/B/ii/I"><num value="I">(I)</num><content> information disseminated through the campaign is accurate and scientifically valid; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id7df6c0bd-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/4/B/ii/II"><num value="II">(II)</num><chapeau> the campaign is designed using strategies demonstrated to be the most effective at achieving the goals and requirements of paragraph (1), which may include—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id7df6c0be-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/4/B/ii/II/aa"><num value="aa">(aa)</num><content> a media campaign, as described in paragraph (2);</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id7df6c0bf-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/4/B/ii/II/bb"><num value="bb">(bb)</num><content> local, regional, or population specific messaging;</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id7df6c0c0-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/4/B/ii/II/cc"><num value="cc">(cc)</num><content> the development of websites to publicize and disseminate information;</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id7df6c0c1-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/4/B/ii/II/dd"><num value="dd">(dd)</num><content> conducting outreach and providing educational resources for parents;</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id7df6c0c2-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/4/B/ii/II/ee"><num value="ee">(ee)</num><content> collaborating with law enforcement agencies; and</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id7df6c0c3-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/4/B/ii/II/ff"><num value="ff">(ff)</num><content> providing support for school-based public health education classes to improve teen knowledge about the effects of substance use.</content>
</item>
</subclause>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df6c0c4-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/5"><num value="5" class="bold">(5)</num><heading class="bold"> Prohibitions</heading><chapeau style="-uslm-lc:I12" class="indent1">None of the amounts made available under paragraph (2) may be obligated or expended for any of the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7df6c0c5-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/5/A"><num value="A">(A)</num><content> To supplant current anti-drug community-based coalitions.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df6c0c6-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/5/B"><num value="B">(B)</num><content> To supplant pro bono public service time donated by national and local broadcasting networks for other public service campaigns.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df6c0c7-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/5/C"><num value="C">(C)</num><content> For partisan political purposes, or to express advocacy in support of or to defeat any clearly identified candidate, clearly identified ballot initiative, or clearly identified legislative or regulatory proposal.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df6e7d8-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/5/D"><num value="D">(D)</num><content> To fund advertising that features any elected officials, persons seeking elected office, cabinet level officials, or other Federal officials employed pursuant to section 213 of Schedule C of title 5, Code of Federal Regulations.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df6e7d9-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/5/E"><num value="E">(E)</num><content> To fund advertising that does not contain a primary message intended to reduce or prevent substance use.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df6e7da-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/5/F"><num value="F">(F)</num><content> To fund advertising containing a primary message intended to promote support for the national media campaign or private sector contributions to the national media campaign.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df6e7db-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/6"><num value="6" class="bold">(6)</num><heading class="bold"> Matching requirement</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7df6e7dc-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/6/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Amounts made available under paragraph (2) for media time and space shall be matched by an equal amount of non-Federal funds for the national media campaign, or be matched with in-kind contributions of the same value.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7df6e7dd-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/6/B"><num value="B" class="bold">(B)</num><heading class="bold"> No-cost match advertising direct relationship requirement</heading><content><p style="-uslm-lc:I13" class="indent2">The Director shall ensure that not less than 85 percent of no-cost match advertising directly relates to substance abuse prevention consistent with the specific purposes of the national media campaign.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7df6e7de-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/6/C"><num value="C" class="bold">(C)</num><heading class="bold"> No-cost match advertising not directly related</heading><content><p style="-uslm-lc:I13" class="indent2">The Director shall ensure that no-cost match advertising that does not directly relate to substance abuse prevention consistent with the purposes of the national media campaign includes a clear anti-drug message. Such message is not required to be the primary message of the match advertising.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df70eef-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/7"><num value="7" class="bold">(7)</num><heading class="bold"> Financial and performance accountability</heading><chapeau style="-uslm-lc:I12" class="indent1">The Director shall cause to be performed—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7df70ef0-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/7/A"><num value="A">(A)</num><content> audits and reviews of costs of the national media campaign pursuant to <ref href="/us/usc/t41/s4706">section 4706 of title 41</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df70ef1-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/7/B"><num value="B">(B)</num><content> an audit to determine whether the costs of the national media campaign are allowable under chapter 43 of title 41.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df70ef2-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/8"><num value="8" class="bold">(8)</num><heading class="bold"> Report to Congress</heading><chapeau style="-uslm-lc:I12" class="indent1">The Director shall submit on an annual basis a report to Congress that describes—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7df70ef3-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/8/A"><num value="A">(A)</num><content> the strategy of the national media campaign and whether specific objectives of the national media campaign were accomplished;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df70ef4-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/8/B"><num value="B">(B)</num><content> steps taken to ensure that the national media campaign operates in an effective and efficient manner consistent with the overall strategy and focus of the national media campaign;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df70ef5-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/8/C"><num value="C">(C)</num><content> plans to purchase advertising time and space;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df70ef6-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/8/D"><num value="D">(D)</num><content> policies and practices implemented to ensure that Federal funds are used responsibly to purchase advertising time and space and eliminate the potential for waste, fraud, and abuse;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df70ef7-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/8/E"><num value="E">(E)</num><content> all contracts entered into with a corporation, partnership, or individual working on behalf of the national media campaign;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df70ef8-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/8/F"><num value="F">(F)</num><content> the results of any financial audit of the national media campaign;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df70ef9-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/8/G"><num value="G">(G)</num><content> a description of any evidence used to develop the national media campaign;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df70efa-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/8/H"><num value="H">(H)</num><content> specific policies and steps implemented to ensure compliance with this section;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df7360b-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/8/I"><num value="I">(I)</num><content> a detailed accounting of the amount of funds obligated during the previous fiscal year for carrying out the national media campaign, including each recipient of funds, the purpose of each expenditure, the amount of each expenditure, any available outcome information, and any other information necessary to provide a complete accounting of the funds expended; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7df7360c-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/8/J"><num value="J">(J)</num><content> a review and evaluation of the effectiveness of the national media campaign strategy for the past year.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7df7360d-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s1708/f/9"><num value="9" class="bold">(9)</num><heading class="bold"> Required notice for communication from the Office</heading><content><p style="-uslm-lc:I12" class="indent1">Any communication, including an advertisement, paid for or otherwise disseminated by the Office directly or through a contract awarded by the Office shall include a prominent notice informing the audience that the communication was paid for by the Office.</p>

<p style="-uslm-lc:I21" class="indent0">By the authority vested in me as President by the Constitution and the laws of the United States of America, including <ref href="/us/usc/t3/s301">section 301 of title 3</ref>, United States Code, it is hereby ordered as follows:</p>
<p style="-uslm-lc:I21" class="indent0"><inline class="small-caps">Section</inline> 1. <i>Establishment</i>. There is established the President’s Drug Policy Council (“Council”).</p>
<p style="-uslm-lc:I21" class="indent0"><inline class="small-caps">Sec</inline>. 2. <i>Membership</i>. The Council shall comprise the:</p>
<p style="-uslm-lc:I21" class="indent0">(a) President, who shall serve as Chairman of the Council;</p>

<p style="-uslm-lc:I21" class="indent0">(p) Director of the Office of Management and Budget;</p>
<p style="-uslm-lc:I21" class="indent0">(q) Chief of Staff to the President;</p>
<p style="-uslm-lc:I21" class="indent0">(r) Director of National Drug Control Policy;</p>
<p style="-uslm-lc:I21" class="indent0">(s) Director of Central Intelligence;</p>
<p style="-uslm-lc:I21" class="indent0">(t) Assistant to the President for National Security Affairs;</p>
<p style="-uslm-lc:I21" class="indent0">(u) Counsel to the President;</p>
<p style="-uslm-lc:I21" class="indent0">(v) Chairman, Joint Chiefs of Staff;</p>
<p style="-uslm-lc:I21" class="indent0">(w) National Security Advisor to the Vice President; and</p>
<p style="-uslm-lc:I21" class="indent0">(x) Assistant to the President for Domestic Policy.</p>
<p style="-uslm-lc:I21" class="indent0">As applicable, the Council shall also comprise such other officials of the departments and agencies as the President may, from time to time, designate.</p>
<p style="-uslm-lc:I21" class="indent0"><inline class="small-caps">Sec</inline>. 3. <i>Meetings of the Council</i>. The President, or upon his direction, the Vice President, may convene meetings of the Council. The President shall preside over meetings of the Council, provided that in his absence, the Vice President will preside. The Council will meet at least quarterly.</p>
<p style="-uslm-lc:I21" class="indent0"><inline class="small-caps">Sec</inline>. 4. <i>Functions</i>. (a) The functions of the Council are to advise and assist the President in: (1) providing direction and oversight for the national drug control strategy, including relating drug control policy to other national security interests and establishing priorities; and (2) ensuring coordination among departments and agencies concerning implementation of the President’s national drug control strategy.</p>
<p style="-uslm-lc:I21" class="indent0">(b) The Director of National Drug Control Policy will continue to be the senior drug control policy official in the executive branch and the President’s chief drug control policy spokesman.</p>
<p style="-uslm-lc:I21" class="indent0">(c) In matters affecting national security interests, the Director of National Drug Control Policy shall work in conjunction with the Assistant to the President for National Security Affairs.</p>
<p style="-uslm-lc:I21" class="indent0"><inline class="small-caps">Sec</inline>. 5. <i>Administration</i>. (a) The Council may utilize established or ad hoc committees, task forces, or interagency groups chaired by the Director of National Drug Control Policy or his representative, in carrying out its functions under this order.</p>
<p style="-uslm-lc:I21" class="indent0">(b) The staff of the Office of National Drug Control Policy, in coordination with the staffs of the Vice President and the Assistant to the President for National Security Affairs, shall act as staff for the Council.</p>
<p style="-uslm-lc:I21" class="indent0">(c) All executive departments and agencies shall cooperate with the Council and provide such assistance, information, and advice as the Council may request, to the extent permitted by law.</p>

<p style="-uslm-lc:I21" class="indent0">Ex. Ord. No. 13023, <date date="1996-11-06">Nov. 6, 1996</date>, 61 F.R. 57767, provided:</p>
<p style="-uslm-lc:I21" class="indent0">By the authority vested in me as President by the Constitution and the laws of the United States of America, including <ref href="/us/usc/t3/s301">section 301 of title 3</ref>, United States Code, and in order to change the name of the “President’s Council on Counter-Narcotics” to the “President’s Drug Policy Council” and to make the Secretaries of the Interior, Agriculture, Health and Human Services, Housing and Urban Development, Education, Veterans Affairs, and the Assistant to the President for Domestic Policy, permanent members of the Council, it is hereby ordered as follows:</p>
<p style="-uslm-lc:I21" class="indent0"><inline class="small-caps">Section</inline> 1. The Council established by Executive Order 12992 [set out above] shall henceforth be called the “President’s Drug Policy Council.”</p>
