L. 109–469, title XI, § 1119, Dec. 29, 2006, 120 Stat. 3547.)","seq_in_title":619,"parent_identifier":"/us/usc/t21/ch22","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch22","level":"chapter","num":"CHAPTER 22—","heading":"NATIONAL DRUG CONTROL POLICY","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" id=\"id1e3f3ba8-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1714\"><num value=\"1714\">§ 1714.</num><heading> Awards for demonstration programs by local partnerships to coerce abstinence in chronic hard-drug users under community supervision through the use of drug testing and sanctions</heading><subsection class=\"indent0\" id=\"id1e3f3ba9-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1714/a\"><num value=\"a\">(a)</num><heading> Awards required</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Director shall make competitive awards to fund demonstration programs by eligible partnerships for the purpose of reducing the use of illicit drugs by chronic hard-drug users living in the community while under the supervision of the criminal justice system.</p>\n</content>\n</subsection>\n<subsection class=\"indent0\" id=\"id1e3f3baa-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1714/b\"><num value=\"b\">(b)</num><heading> Use of award amounts</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"blockIndent0\">Award amounts received under this section shall be used—</chapeau><paragraph class=\"indent1\" id=\"id1e3f3bab-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1714/b/1\"><num value=\"1\">(1)</num><content> to support the efforts of the agencies, organizations, and researchers included in the eligible partnership;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e3f3bac-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1714/b/2\"><num value=\"2\">(2)</num><content> to develop and field a drug testing and graduated sanctions program for chronic hard-drug users living in the community under criminal justice supervision; and</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e3f62bd-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1714/b/3\"><num value=\"3\">(3)</num><content> to assist individuals described in subsection (a) by strengthening rehabilitation efforts through such means as job training, drug treatment, or other services.</content>\n</paragraph>\n</subsection>\n<subsection class=\"indent0\" id=\"id1e3f62be-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1714/c\"><num value=\"c\">(c)</num><heading> Eligible partnership defined</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"blockIndent0\">In this section, the term “eligible partnership” means a working group whose application to the Director—</chapeau><paragraph class=\"indent1\" id=\"id1e3f62bf-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1714/c/1\"><num value=\"1\">(1)</num><chapeau> identifies the roles played, and certifies the involvement of, two or more agencies or organizations, which may include—</chapeau><subparagraph class=\"indent2\" id=\"id1e3f62c0-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1714/c/1/A\"><num value=\"A\">(A)</num><content> State, local, or tribal agencies (such as those carrying out police, probation, prosecution, courts, corrections, parole, or treatment functions);</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1e3f62c1-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1714/c/1/B\"><num value=\"B\">(B)</num><content> Federal agencies (such as the Drug Enforcement Agency, the Bureau of Alcohol, Tobacco, Firearms, and Explosives, and United States Attorney offices); and</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1e3f62c2-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1714/c/1/C\"><num value=\"C\">(C)</num><content> community-based organizations;</content>\n</subparagraph>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e3f62c3-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1714/c/2\"><num value=\"2\">(2)</num><content> includes a qualified researcher;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e3f89d4-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1714/c/3\"><num value=\"3\">(3)</num><content> includes a plan for using judicial or other criminal justice authority to administer drug tests to individuals described in subsection (a) at least twice a week, and to swiftly and certainly impose a known set of graduated sanctions for non-compliance with community-release provisions relating to drug abstinence (whether imposed as a pre-trial, probation, or parole condition or otherwise);</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e3f89d5-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1714/c/4\"><num value=\"4\">(4)</num><content> includes a strategy for responding to a range of substance use and abuse problems and a range of criminal histories;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e3f89d6-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1714/c/5\"><num value=\"5\">(5)</num><content> includes a plan for integrating data infrastructure among the agencies and organizations included in the eligible partnership to enable seamless, real-time tracking of individuals described in subsection (a);</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e3f89d7-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1714/c/6\"><num value=\"6\">(6)</num><content> includes a plan to monitor and measure the progress toward reducing the percentage of the population of individuals described in subsection (a) who, upon being summoned for a drug test, either fail to show up or who test positive for drugs.</content>\n</paragraph>\n</subsection>\n<subsection class=\"indent0\" id=\"id1e3f89d8-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1714/d\"><num value=\"d\">(d)</num><heading> Reports to Congress</heading><paragraph class=\"indent1\" id=\"id1e3f89d9-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1714/d/1\"><num value=\"1\">(1)</num><heading> Interim report</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Not later than <date date=\"2009-06-01\">June 1, 2009</date>, the Director shall submit to Congress a report that identifies the best practices in reducing the use of illicit drugs by chronic hard-drug users, including the best practices identified through the activities funded under this section.</p>\n</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1e3fb0ea-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1714/d/2\"><num value=\"2\">(2)</num><heading> Final report</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Not later than <date date=\"2010-06-01\">June 1, 2010</date>, the Director shall submit to Congress a report on the demonstration programs funded under this section, including on the matters specified in paragraph (1).</p>\n</content>\n</paragraph>\n</subsection>\n<subsection class=\"indent0\" id=\"id1e3fb0eb-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s1714/e\"><num value=\"e\">(e)</num><heading> Authorization of appropriations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">There is authorized to be appropriated to carry out this section $4,900,000 for each of fiscal years 2007 through 2009.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id1e3fb0ec-f63b-11e2-8470-abc29ba29c4d\">\n(<ref href=\"/us/pl/105/277/s716\">Pub.
