value=\"2205\">§ 2205.</num><heading> Food allergy and anaphylaxis management</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idca1b5eb6-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this section:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idca1b5eb7-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Early childhood education program</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “early childhood education program” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5eb8-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/a/1/A\"><num value=\"A\">(A)</num><content> a Head Start program or an Early Head Start program carried out under the Head Start Act (<ref href=\"/us/usc/t42/s9831\">42 U.S.C. 9831</ref> et seq.);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5eb9-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/a/1/B\"><num value=\"B\">(B)</num><content> a State licensed or regulated child care program or school; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5eba-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/a/1/C\"><num value=\"C\">(C)</num><content> a State prekindergarten program that serves children from birth through kindergarten.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idca1b5ebb-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> ESEA definitions</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The terms “local educational agency”, “secondary school”, “elementary school”, and “parent” have the meanings given the terms in <ref href=\"/us/usc/t20/s7801\">section 7801 of title 20</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idca1b5ebc-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/a/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> School</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “school” includes public—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5ebd-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/a/3/A\"><num value=\"A\">(A)</num><content> kindergartens;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5ebe-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/a/3/B\"><num value=\"B\">(B)</num><content> elementary schools; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5ebf-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/a/3/C\"><num value=\"C\">(C)</num><content> secondary schools.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idca1b5ec0-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/a/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Secretary</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Secretary” means the Secretary of Health and Human Services.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idca1b5ec1-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Establishment of voluntary food allergy and anaphylaxis management guidelines</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idca1b5ec2-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Establishment</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idca1b5ec3-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Not later than 1 year after <date date=\"2011-01-04\">January 4, 2011</date>, the Secretary, in consultation with the Secretary of Education, shall—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idca1b5ec4-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/1/A/i\"><num value=\"i\">(i)</num><content> develop guidelines to be used on a voluntary basis to develop plans for individuals to manage the risk of food allergy and anaphylaxis in schools and early childhood education programs; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idca1b5ec5-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/1/A/ii\"><num value=\"ii\">(ii)</num><content> make such guidelines available to local educational agencies, schools, early childhood education programs, and other interested entities and individuals to be implemented on a voluntary basis only.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idca1b5ec6-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Applicability of FERPA</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Each plan described in subparagraph (A) that is developed for an individual shall be considered an education record for the purpose of <ref href=\"/us/usc/t20/s1232g\">section 1232g of title 20</ref> (commonly referred to as the “Family Educational Rights and Privacy Act of 1974”).</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idca1b5ec7-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Contents</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The voluntary guidelines developed by the Secretary under paragraph (1) shall address each of the following and may be updated as the Secretary determines necessary:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5ec8-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/A\"><num value=\"A\">(A)</num><chapeau> Parental obligation to provide the school or early childhood education program, prior to the start of every school year, with—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idca1b5ec9-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/A/i\"><num value=\"i\">(i)</num><chapeau> documentation from their child’s physician or nurse—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idca1b5eca-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/A/i/I\"><num value=\"I\">(I)</num><content> supporting a diagnosis of food allergy, and any risk of anaphylaxis, if applicable;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idca1b5ecb-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/A/i/II\"><num value=\"II\">(II)</num><content> identifying any food to which the child is allergic;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idca1b5ecc-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/A/i/III\"><num value=\"III\">(III)</num><content> describing, if appropriate, any prior history of anaphylaxis;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idca1b5ecd-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/A/i/IV\"><num value=\"IV\">(IV)</num><content> listing any medication prescribed for the child for the treatment of anaphylaxis;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idca1b5ece-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/A/i/V\"><num value=\"V\">(V)</num><content> detailing emergency treatment procedures in the event of a reaction;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idca1b5ecf-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/A/i/VI\"><num value=\"VI\">(VI)</num><content> listing the signs and symptoms of a reaction; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idca1b5ed0-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/A/i/VII\"><num value=\"VII\">(VII)</num><content> assessing the child’s readiness for self-administration of prescription medication; and</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idca1b5ed1-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/A/ii\"><num value=\"ii\">(ii)</num><content> a list of substitute meals that may be offered to the child by school or early childhood education program food service personnel.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5ed2-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/B\"><num value=\"B\">(B)</num><chapeau> The creation and maintenance of an individual plan for food allergy management, in consultation with the parent, tailored to the needs of each child with a documented risk for anaphylaxis, including any procedures for the self-administration of medication by such children in instances where—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idca1b5ed3-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/B/i\"><num value=\"i\">(i)</num><content> the children are capable of self-administering medication; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idca1b5ed4-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/B/ii\"><num value=\"ii\">(ii)</num><content> such administration is not prohibited by State law.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5ed5-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/C\"><num value=\"C\">(C)</num><content> Communication strategies between individual schools or early childhood education programs and providers of emergency medical services, including appropriate instructions for emergency medical response.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5ed6-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/D\"><num value=\"D\">(D)</num><content> Strategies to reduce the risk of exposure to anaphylactic causative agents in classrooms and common school or early childhood education program areas such as cafeterias.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5ed7-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/E\"><num value=\"E\">(E)</num><content> The dissemination of general information on life-threatening food allergies to school or early childhood education program staff, parents, and children.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5ed8-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/F\"><num value=\"F\">(F)</num><content> Food allergy management training of school or early childhood education program personnel who regularly come into contact with children with life-threatening food allergies.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5ed9-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/G\"><num value=\"G\">(G)</num><content> The authorization and training of school or early childhood education program personnel to administer epinephrine when the nurse is not immediately available.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5eda-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/H\"><num value=\"H\">(H)</num><content> The timely accessibility of epinephrine by school or early childhood education program personnel when the nurse is not immediately available.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5edb-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/I\"><num value=\"I\">(I)</num><content> The creation of a plan contained in each individual plan for food allergy management that addresses the appropriate response to an incident of anaphylaxis of a child while such child is engaged in extracurricular programs of a school or early childhood education program, such as non-academic outings and field trips, before- and after-school programs or before- and after-early child education program programs,<ref class=\"footnoteRef\" idref=\"fn002199\">1</ref><note type=\"footnote\" id=\"fn002199\"><num>1</num> So in original.</note> and school-sponsored or early childhood education program-sponsored programs held on weekends.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5edc-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/J\"><num value=\"J\">(J)</num><content> Maintenance of information for each administration of epinephrine to a child at risk for anaphylaxis and prompt notification to parents.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5edd-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/2/K\"><num value=\"K\">(K)</num><content> Other elements the Secretary determines necessary for the management of food allergies and anaphylaxis in schools and early childhood education programs.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idca1b5ede-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Relation to State law</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Nothing in this section or the guidelines developed by the Secretary under paragraph (1) shall be construed to preempt State law, including any State law regarding whether students at risk for anaphylaxis may self-administer medication.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idca1b5edf-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> School-based food allergy management grants</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idca1b5ee0-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary may award grants to local educational agencies to assist such agencies with implementing voluntary food allergy and anaphylaxis management guidelines described in subsection (b).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idca1b5ee1-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Application</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idca1b5ee2-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">To be eligible to receive a grant under this subsection, a local educational agency shall submit an application to the Secretary at such time, in such manner, and including such information as the Secretary may reasonably require.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idca1b5ee3-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Contents</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Each application submitted under subparagraph (A) shall include—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idca1b5ee4-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/2/B/i\"><num value=\"i\">(i)</num><content> an assurance that the local educational agency has developed plans in accordance with the food allergy and anaphylaxis management guidelines described in subsection (b);</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idca1b5ee5-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/2/B/ii\"><num value=\"ii\">(ii)</num><chapeau> a description of the activities to be funded by the grant in carrying out the food allergy and anaphylaxis management guidelines, including—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idca1b5ee6-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/2/B/ii/I\"><num value=\"I\">(I)</num><content> how the guidelines will be carried out at individual schools served by the local educational agency;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idca1b5ee7-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/2/B/ii/II\"><num value=\"II\">(II)</num><content> how the local educational agency will inform parents and students of the guidelines in place;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idca1b5ee8-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/2/B/ii/III\"><num value=\"III\">(III)</num><content> how school nurses, teachers, administrators, and other school-based staff will be made aware of, and given training on, when applicable, the guidelines in place; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idca1b5ee9-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/2/B/ii/IV\"><num value=\"IV\">(IV)</num><content> any other activities that the Secretary determines appropriate;</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idca1b5eea-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/2/B/iii\"><num value=\"iii\">(iii)</num><content> an itemization of how grant funds received under this subsection will be expended;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idca1b5eeb-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/2/B/iv\"><num value=\"iv\">(iv)</num><content> a description of how adoption of the guidelines and implementation of grant activities will be monitored; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idca1b5eec-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/2/B/v\"><num value=\"v\">(v)</num><content> an agreement by the local educational agency to report information required by the Secretary to conduct evaluations under this subsection.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idca1b5eed-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Use of funds</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Each local educational agency that receives a grant under this subsection may use the grant funds for the following:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5eee-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/3/A\"><num value=\"A\">(A)</num><content> Purchase of materials and supplies, including limited medical supplies such as epinephrine and disposable wet wipes, to support carrying out the food allergy and anaphylaxis management guidelines described in subsection (b).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5eef-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/3/B\"><num value=\"B\">(B)</num><content> In partnership with local health departments, school nurse, teacher, and personnel training for food allergy management.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5ef0-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/3/C\"><num value=\"C\">(C)</num><content> Programs that educate students as to the presence of, and policies and procedures in place related to, food allergies and anaphylactic shock.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5ef1-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/3/D\"><num value=\"D\">(D)</num><content> Outreach to parents.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idca1b5ef2-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/3/E\"><num value=\"E\">(E)</num><content> Any other activities consistent with the guidelines described in subsection (b).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idca1b5ef3-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Duration of awards</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary may award grants under this subsection for a period of not more than 2 years. In the event the Secretary conducts a program evaluation under this subsection, funding in the second year of the grant, where applicable, shall be contingent on a successful program evaluation by the Secretary after the first year.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idca1b5ef4-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Limitation on grant funding</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary may not provide grant funding to a local educational agency under this subsection after such local educational agency has received 2 years of grant funding under this subsection.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idca1b5ef5-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Maximum amount of annual awards</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A grant awarded under this subsection may not be made in an amount that is more than $50,000 annually.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idca1b5ef6-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/7\"><num value=\"7\" class=\"bold\">(7)</num><heading class=\"bold\"> Priority</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In awarding grants under this subsection, the Secretary shall give priority to local educational agencies with the highest percentages of children who are counted under <ref href=\"/us/usc/t20/s6333/c\">section 6333(c) of title 20</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idca1b5ef7-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/8\"><num value=\"8\" class=\"bold\">(8)</num><heading class=\"bold\"> Matching funds</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idca1b5ef8-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/8/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary may not award a grant under this subsection unless the local educational agency agrees that, with respect to the costs to be incurred by such local educational agency in carrying out the grant activities, the local educational agency shall make available (directly or through donations from public or private entities) non-Federal funds toward such costs in an amount equal to not less than 25 percent of the amount of the grant.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idca1b5ef9-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/8/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Determination of amount of non-Federal contribution</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Non-Federal funds required under subparagraph (A) may be cash or in kind, including plant, equipment, or services. Amounts provided by the Federal Government, and any portion of any service subsidized by the Federal Government, may not be included in determining the amount of such non-Federal funds.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idca1b5efa-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/9\"><num value=\"9\" class=\"bold\">(9)</num><heading class=\"bold\"> Administrative funds</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A local educational agency that receives a grant under this subsection may use not more than 2 percent of the grant amount for administrative costs related to carrying out this subsection.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idca1b5efb-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/10\"><num value=\"10\" class=\"bold\">(10)</num><heading class=\"bold\"> Progress and evaluations</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">At the completion of the grant period referred to in paragraph (4), a local educational agency shall provide the Secretary with information on how grant funds were spent and the status of implementation of the food allergy and anaphylaxis management guidelines described in subsection (b).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idca1b5efc-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/11\"><num value=\"11\" class=\"bold\">(11)</num><heading class=\"bold\"> Supplement, not supplant</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Grant funds received under this subsection shall be used to supplement, and not supplant, non-Federal funds and any other Federal funds available to carry out the activities described in this subsection.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idca1b5efd-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/c/12\"><num value=\"12\" class=\"bold\">(12)</num><heading class=\"bold\"> Authorization of appropriations</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">There is authorized to be appropriated to carry out this subsection $30,000,000 for fiscal year 2011 and such sums as may be necessary for each of the 4 succeeding fiscal years.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idca1b5efe-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Voluntary nature of guidelines</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idca1b5eff-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s2205/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The food allergy and anaphylaxis management guidelines developed by the Secretary under subsection (b) are voluntary.
