<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id7e062a99-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s2243"><num value="2243">§ 2243.</num><heading> Smuggled food</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7e062a9a-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s2243/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">Not later than 180 days after <date date="2011-01-04">January 4, 2011</date>, the Secretary shall, in coordination with the Secretary of Homeland Security, develop and implement a strategy to better identify smuggled food and prevent entry of such food into the United States.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7e0651ab-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s2243/b"><num value="b" class="bold">(b)</num><heading class="bold"> Notification to Homeland Security</heading><content><p style="-uslm-lc:I11" class="indent0">Not later than 10 days after the Secretary identifies a smuggled food that the Secretary believes would cause serious adverse health consequences or death to humans or animals, the Secretary shall provide to the Secretary of Homeland Security a notification under <ref href="/us/usc/t21/s350f/n">section 350f(n) of this title</ref> describing the smuggled food and, if available, the names of the individuals or entities that attempted to import such food into the United States.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7e0651ac-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s2243/c"><num value="c" class="bold">(c)</num><heading class="bold"> Public notification</heading><chapeau style="-uslm-lc:I11" class="indent0">If the Secretary—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7e0651ad-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s2243/c/1"><num value="1">(1)</num><content> identifies a smuggled food;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7e0651ae-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s2243/c/2"><num value="2">(2)</num><content> reasonably believes exposure to the food would cause serious adverse health consequences or death to humans or animals; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7e0651af-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s2243/c/3"><num value="3">(3)</num><content> reasonably believes that the food has entered domestic commerce and is likely to be consumed,</content>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">the Secretary shall promptly issue a press release describing that food and shall use other emergency communication or recall networks, as appropriate, to warn consumers and vendors about the potential threat.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7e0651b0-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s2243/d"><num value="d" class="bold">(d)</num><heading class="bold"> Effect of section</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this section shall affect the authority of the Secretary to issue public notifications under other circumstances.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id7e0651b1-81bc-11eb-b838-b6993269d559" identifier="/us/usc/t21/s2243/e"><num value="e" class="bold">(e)</num><heading class="bold"> Definition</heading><content><p style="-uslm-lc:I11" class="indent0">In this subsection, the term “smuggled food” means any food that a person introduces into the United States through fraudulent means or with the intent to defraud or mislead.</p>
