<chapeau style="-uslm-lc:I11" class="indent0">In this chapter:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id29854862-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/1"><num value="1" class="bold">(1)</num><heading class="bold"> Alien; national; national of the United States</heading><content><p style="-uslm-lc:I12" class="indent1">The terms “alien”, “national”, and “national of the United States” have the meanings given those terms in <ref href="/us/usc/t8/s1101">section 1101 of title 8</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id29854863-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/2"><num value="2" class="bold">(2)</num><heading class="bold"> Appropriate congressional committees and leadership</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “appropriate congressional committees and leadership” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id29854864-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/2/A"><num value="A">(A)</num><content> the Committee on Appropriations, the Committee on Armed Services, the Committee on Banking, Housing, and Urban Affairs, the Committee on Foreign Relations, the Committee on Homeland Security and Governmental Affairs, the Committee on the Judiciary, the Select Committee on Intelligence, and the majority leader and the minority leader of the Senate; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id29854865-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/2/B"><num value="B">(B)</num><content> the Committee on Appropriations, the Committee on Armed Services, the Committee on Financial Services, the Committee on Foreign Affairs, the Committee on Homeland Security, the Committee on the Judiciary, the Committee on Oversight and Reform, the Permanent Select Committee on Intelligence, and the Speaker and the minority leader of the House of Representatives.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id29856f76-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/3"><num value="3" class="bold">(3)</num><heading class="bold"> Controlled substance; listed chemical</heading><content><p style="-uslm-lc:I12" class="indent1">The terms “controlled substance”, “listed chemical”, “narcotic drug”, and “opioid” have the meanings given those terms in <ref href="/us/usc/t21/s802">section 802 of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id29856f77-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/4"><num value="4" class="bold">(4)</num><heading class="bold"> Entity</heading><content><p style="-uslm-lc:I12" class="indent1">The term “entity” means a partnership, joint venture, association, corporation, organization, network, group, or subgroup, or any form of business collaboration.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id29856f78-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/5"><num value="5" class="bold">(5)</num><heading class="bold"> Foreign opioid trafficker</heading><content><p style="-uslm-lc:I12" class="indent1">The term “foreign opioid trafficker” means any foreign person that the President determines plays a significant role in opioid trafficking.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id29856f79-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/6"><num value="6" class="bold">(6)</num><heading class="bold"> Foreign person</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “foreign person”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id29856f7a-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/6/A"><num value="A">(A)</num><chapeau> means—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id29856f7b-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/6/A/i"><num value="i">(i)</num><content> any citizen or national of a foreign country; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id29856f7c-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/6/A/ii"><num value="ii">(ii)</num><content> any entity not organized under the laws of the United States or a jurisdiction within the United States; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id29856f7d-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/6/B"><num value="B">(B)</num><content> does not include the government of a foreign country.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id29856f7e-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/7"><num value="7" class="bold">(7)</num><heading class="bold"> Knowingly</heading><content><p style="-uslm-lc:I12" class="indent1">The term “knowingly”, with respect to conduct, a circumstance, or a result, means that a person has actual knowledge, or should have known, of the conduct, the circumstance, or the result.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id29856f7f-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/8"><num value="8" class="bold">(8)</num><heading class="bold"> Opioid trafficking</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “opioid trafficking” means any illicit activity—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id29856f80-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/8/A"><num value="A">(A)</num><chapeau> to produce, manufacture, distribute, sell, or knowingly finance or transport—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id29856f81-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/8/A/i"><num value="i">(i)</num><content> synthetic opioids, including controlled substances that are synthetic opioids and listed chemicals that are synthetic opioids; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id29856f82-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/8/A/ii"><num value="ii">(ii)</num><content> active pharmaceutical ingredients or chemicals that are used in the production of controlled substances that are synthetic opioids;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id29856f83-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/8/B"><num value="B">(B)</num><content> to attempt to carry out an activity described in subparagraph (A); or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id29856f84-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/8/C"><num value="C">(C)</num><content> to assist, abet, conspire, or collude with other persons to carry out such an activity.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id29856f85-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/9"><num value="9" class="bold">(9)</num><heading class="bold"> Person</heading><content><p style="-uslm-lc:I12" class="indent1">The term “person” means an individual or entity.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id29856f86-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/10"><num value="10" class="bold">(10)</num><heading class="bold"> United States person</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “United States person” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id29856f87-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/10/A"><num value="A">(A)</num><content> any citizen or national of the United States;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id29856f88-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/10/B"><num value="B">(B)</num><content> any alien lawfully admitted for permanent residence in the United States;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id29856f89-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/10/C"><num value="C">(C)</num><content> any entity organized under the laws of the United States or any jurisdiction within the United States (including a foreign branch of such an entity); or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id29856f8a-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2302/10/D"><num value="D">(D)</num><content> any person located in the United States.</content>
