<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id29856f8f-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311"><num value="2311">§ 2311.</num><heading> Identification of foreign opioid traffickers</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id29856f90-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/a"><num value="a" class="bold">(a)</num><heading class="bold"> Public report</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id29856f91-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The President shall submit to the appropriate congressional committees and leadership, in accordance with subsection (c), a report—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id29856f92-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/a/1/A"><num value="A">(A)</num><content> identifying the foreign persons that the President determines are foreign opioid traffickers;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id29856f93-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/a/1/B"><num value="B">(B)</num><content> detailing progress the President has made in implementing this subchapter; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id29856f94-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/a/1/C"><num value="C">(C)</num><content> providing an update on cooperative efforts with the governments of Mexico, the People’s Republic of China, and other countries of concern with respect to combating foreign opioid traffickers.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id29856f95-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Identification of additional persons</heading><content><p style="-uslm-lc:I12" class="indent1">If, at any time after submitting a report required by paragraph (1) and before the submission of the next such report, the President determines that a foreign person not identified in the report is a foreign opioid trafficker, the President shall submit to the appropriate congressional committees and leadership an additional report containing the information required by paragraph (1) with respect to the foreign person.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id298596a6-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Exclusion</heading><content><p style="-uslm-lc:I12" class="indent1">The President shall not be required to include in a report under paragraph (1) or (2) any persons with respect to which the United States has imposed sanctions before the date of the report under this subchapter or any other provision of law with respect to opioid trafficking.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id298596a7-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> Form of report</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id298596a8-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/a/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Each report required by paragraph (1) or (2) shall be submitted in unclassified form but may include a classified annex.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id298596a9-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/a/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Availability to public</heading><content><p style="-uslm-lc:I13" class="indent2">The unclassified portion of a report required by paragraph (1) or (2) shall be made available to the public.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id298596aa-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/b"><num value="b" class="bold">(b)</num><heading class="bold"> Classified report</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id298596ab-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The President shall submit to the appropriate congressional committees and leadership, in accordance with subsection (c), a report, in classified form—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id298596ac-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/b/1/A"><num value="A">(A)</num><content> describing in detail the status of sanctions imposed under this subchapter, including the personnel and resources directed toward the imposition of such sanctions during the preceding fiscal year;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id298596ad-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/b/1/B"><num value="B">(B)</num><content> providing background information with respect to persons newly identified as foreign opioid traffickers and their illicit activities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id298596ae-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/b/1/C"><num value="C">(C)</num><content> describing actions the President intends to undertake or has undertaken to implement this subchapter; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id298596af-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/b/1/D"><num value="D">(D)</num><content> providing a strategy for identifying additional foreign opioid traffickers.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id298596b0-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Effect on other reporting requirements</heading><content><p style="-uslm-lc:I12" class="indent1">The report required by paragraph (1) is in addition to, and in no way delimits or restricts, the obligations of the President to keep Congress fully and currently informed pursuant to the provisions of the National Security Act of 1947 (<ref href="/us/usc/t50/s3001">50 U.S.C. 3001</ref> et seq.).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id298596b1-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/c"><num value="c" class="bold">(c)</num><heading class="bold"> Submission of reports</heading><content><p style="-uslm-lc:I11" class="indent0">Not later than 180 days after <date date="2019-12-20">December 20, 2019</date>, and annually thereafter until the date that is 5 years after <date date="2019-12-20">December 20, 2019</date>, the President shall submit the reports required by subsections (a) and (b) to the appropriate congressional committees and leadership.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id298596b2-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/d"><num value="d" class="bold">(d)</num><heading class="bold"> Exclusion of certain information</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id298596b3-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Intelligence</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding any other provision of this section, a report required by subsection (a) or (b) shall not disclose the identity of any person if the Director of National Intelligence determines that such disclosure could compromise an intelligence operation, activity, source, or method of the United States.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id298596b4-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Law enforcement</heading><chapeau style="-uslm-lc:I12" class="indent1">Notwithstanding any other provision of this section, a report required by subsection (a) or (b) shall not disclose the identity of any person if the Attorney General, in coordination, as appropriate, with the Director of the Federal Bureau of Investigation, the Administrator of the Drug Enforcement Administration, the Secretary of the Treasury, the Secretary of State, and the head of any other appropriate Federal law enforcement agency, determines that such disclosure could reasonably be expected—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id298596b5-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/d/2/A"><num value="A">(A)</num><content> to compromise the identity of a confidential source, including a State, local, or foreign agency or authority or any private institution that furnished information on a confidential basis;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id298596b6-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/d/2/B"><num value="B">(B)</num><content> to jeopardize the integrity or success of an ongoing criminal investigation or prosecution;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id298596b7-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/d/2/C"><num value="C">(C)</num><content> to endanger the life or physical safety of any person; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id298596b8-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/d/2/D"><num value="D">(D)</num><content> to cause substantial harm to physical property.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id298596b9-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Notification required</heading><content><p style="-uslm-lc:I12" class="indent1">If the Director of National Intelligence makes a determination under paragraph (1) or the Attorney General makes a determination under paragraph (2), the Director or the Attorney General, as the case may be, shall notify the appropriate congressional committees and leadership of the determination and the reasons for the determination.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2985bdca-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> Rule of construction</heading><content><p style="-uslm-lc:I12" class="indent1">Nothing in this section may be construed to authorize or compel the disclosure of information determined by the President to be law enforcement information, classified information, national security information, or other information the disclosure of which is prohibited by any other provision of law.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2985bdcb-09a0-11eb-a78d-da6bfa680960" identifier="/us/usc/t21/s2311/e"><num value="e" class="bold">(e)</num><heading class="bold"> Provision of information required for reports</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary of the Treasury, the Attorney General, the Secretary of Defense, the Secretary of State, the Secretary of Homeland Security, and the Director of National Intelligence shall consult among themselves and provide to the President and the Director of the Office of National Drug Control Policy the appropriate and necessary information to enable the President to submit the reports required by subsection (a).</p>
