F, title LXXII, § 7214, Dec. 20, 2019, 133 Stat. 2267.)","seq_in_title":710,"parent_identifier":"/us/usc/t21/ch28/schI","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch28","level":"chapter","num":"CHAPTER 28—","heading":"SANCTIONS WITH RESPECT TO FOREIGN TRAFFICKERS OF ILLICIT SYNTHETIC OPIOIDS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch28/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"SANCTIONS WITH RESPECT TO FOREIGN OPIOID TRAFFICKERS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id29860c11-09a0-11eb-a78d-da6bfa680960\" identifier=\"/us/usc/t21/s2314\"><num value=\"2314\">§ 2314.</num><heading> Waivers</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id29860c12-09a0-11eb-a78d-da6bfa680960\" identifier=\"/us/usc/t21/s2314/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Waiver for state-owned entities in countries that cooperate in multilateral anti-trafficking efforts</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id29860c13-09a0-11eb-a78d-da6bfa680960\" identifier=\"/us/usc/t21/s2314/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The President may waive for a period of not more than 12 months the application of sanctions under this subchapter with respect to an entity that is owned or controlled, directly or indirectly, by a foreign government or any political subdivision, agency, or instrumentality of a foreign government, if, not less than 15 days before the waiver is to take effect, the President certifies to the appropriate congressional committees and leadership that the foreign government is closely cooperating with the United States in efforts to prevent opioid trafficking.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id29863324-09a0-11eb-a78d-da6bfa680960\" identifier=\"/us/usc/t21/s2314/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Certification</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The President may certify under paragraph (1) that a foreign government is closely cooperating with the United States in efforts to prevent opioid trafficking if that government is—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id29863325-09a0-11eb-a78d-da6bfa680960\" identifier=\"/us/usc/t21/s2314/a/2/A\"><num value=\"A\">(A)</num><content> implementing domestic laws to schedule all fentanyl analogues as controlled substances; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id29863326-09a0-11eb-a78d-da6bfa680960\" identifier=\"/us/usc/t21/s2314/a/2/B\"><num value=\"B\">(B)</num><chapeau> doing two or more of the following:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id29863327-09a0-11eb-a78d-da6bfa680960\" identifier=\"/us/usc/t21/s2314/a/2/B/i\"><num value=\"i\">(i)</num><content> Implementing substantial improvements in regulations involving the chemical and pharmaceutical production and export of illicit opioids.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id29863328-09a0-11eb-a78d-da6bfa680960\" identifier=\"/us/usc/t21/s2314/a/2/B/ii\"><num value=\"ii\">(ii)</num><content> Implementing substantial improvements in judicial regulations to combat transnational criminal organizations that traffic opioids.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id29863329-09a0-11eb-a78d-da6bfa680960\" identifier=\"/us/usc/t21/s2314/a/2/B/iii\"><num value=\"iii\">(iii)</num><content> Increasing efforts to prosecute foreign opioid traffickers.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2986332a-09a0-11eb-a78d-da6bfa680960\" identifier=\"/us/usc/t21/s2314/a/2/B/iv\"><num value=\"iv\">(iv)</num><content> Increasing intelligence sharing and law enforcement cooperation with the United States with respect to opioid trafficking.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2986332b-09a0-11eb-a78d-da6bfa680960\" identifier=\"/us/usc/t21/s2314/a/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Subsequent renewal of waiver</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The President may renew a waiver under paragraph (1) for subsequent periods of not more than 12 months each if, not less than 15 days before the renewal is to take effect, the Secretary of State certifies to the appropriate congressional committees and leadership that the government of the country to which the waiver applies has effectively implemented and is effectively enforcing the measures that formed the basis for the certification under paragraph (2).</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id2986332c-09a0-11eb-a78d-da6bfa680960\" identifier=\"/us/usc/t21/s2314/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Waivers for national security and access to prescription medications</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2986332d-09a0-11eb-a78d-da6bfa680960\" identifier=\"/us/usc/t21/s2314/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The President may waive the application of sanctions under this subchapter if the President determines that the application of such sanctions would harm—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2986332e-09a0-11eb-a78d-da6bfa680960\" identifier=\"/us/usc/t21/s2314/b/1/A\"><num value=\"A\">(A)</num><content> the national security interests of the United States; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2986332f-09a0-11eb-a78d-da6bfa680960\" identifier=\"/us/usc/t21/s2314/b/1/B\"><num value=\"B\">(B)</num><content> subject to paragraph (2), the access of United States persons to prescription medications.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id29863330-09a0-11eb-a78d-da6bfa680960\" identifier=\"/us/usc/t21/s2314/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Monitoring</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The President shall establish a monitoring program to verify that a person that receives a waiver under paragraph (1)(B) is not trafficking illicit opioids.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id29863331-09a0-11eb-a78d-da6bfa680960\" identifier=\"/us/usc/t21/s2314/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Notification</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Not later than 15 days after making a determination under paragraph (1), the President shall notify the appropriate congressional committees and leadership of the determination and the reasons for the determination.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id29863332-09a0-11eb-a78d-da6bfa680960\" identifier=\"/us/usc/t21/s2314/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Humanitarian waiver</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The President may waive, for renewable periods of 180 days, the application of the sanctions under this subchapter if the President certifies to the appropriate congressional committees and leadership that the waiver is necessary for the provision of humanitarian assistance.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id29863333-09a0-11eb-a78d-da6bfa680960\">(<ref href=\"/us/pl/116/92/dF/tLXXII/s7214\">Pub.
