waivers; exceptions</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide65bb3e8-0944-11ef-904e-98e3fcd8664f\" identifier=\"/us/usc/t21/s2354/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Penalties</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Any person that violates, attempts to violate, conspires to violate, or causes a violation of this subchapter or any regulation, license, or order issued to carry out this subchapter shall be subject to the penalties set forth in subsections (b) and (c) of <ref href=\"/us/usc/t50/s1705\">section 1705 of title 50</ref> to the same extent as a person that commits an unlawful act described in subsection (a) of that section.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide65bb3e9-0944-11ef-904e-98e3fcd8664f\" identifier=\"/us/usc/t21/s2354/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> National security waiver</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The President may waive the application of sanctions under this subchapter with respect to a foreign person if the President determines that such waiver is in the national security interest of the United States.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ide65bb3ea-0944-11ef-904e-98e3fcd8664f\" identifier=\"/us/usc/t21/s2354/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Exceptions</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide65bb3eb-0944-11ef-904e-98e3fcd8664f\" identifier=\"/us/usc/t21/s2354/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Exception for intelligence activities</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">This subchapter shall not apply with respect to activities subject to the reporting requirements under title V of the National Security Act of 1947 (<ref href=\"/us/usc/t50/s3091\">50 U.S.C. 3091</ref> et seq.) or any authorized intelligence activities of the United States.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide65bb3ec-0944-11ef-904e-98e3fcd8664f\" identifier=\"/us/usc/t21/s2354/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Exception for compliance with international obligations and law enforcement activities</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Sanctions under this subchapter shall not apply with respect to an alien if admitting or paroling the alien into the United States is necessary—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide65bb3ed-0944-11ef-904e-98e3fcd8664f\" identifier=\"/us/usc/t21/s2354/c/2/A\"><num value=\"A\">(A)</num><content> to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success on <date date=\"1947-06-26\">June 26, 1947</date>, and entered into force <date date=\"1947-11-21\">November 21, 1947</date>, between the United Nations and the United States, or other applicable international obligations of the United States; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide65bb3ee-0944-11ef-904e-98e3fcd8664f\" identifier=\"/us/usc/t21/s2354/c/2/B\"><num value=\"B\">(B)</num><content> to carry out or assist law enforcement activity of the United States.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ide65bb3ef-0944-11ef-904e-98e3fcd8664f\" identifier=\"/us/usc/t21/s2354/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Humanitarian exemption</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The President may not impose sanctions under this subchapter with respect to any person for conducting or facilitating a transaction for the sale of agricultural commodities, food, medicine, or medical devices or for the provision of humanitarian assistance.</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"ide65bb3f0-0944-11ef-904e-98e3fcd8664f\">(<ref href=\"/us/pl/118/50/dE/tI/s3104\">Pub.
