A, title III, § 3101(a)(2)(A), Dec. 13, 2016, 130 Stat. 1152.)","seq_in_title":100,"parent_identifier":"/us/usc/t21/ch9/schIII","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9","level":"chapter","num":"CHAPTER 9—","heading":"FEDERAL FOOD, DRUG, AND COSMETIC ACT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"PROHIBITED ACTS AND PENALTIES","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"ide4659c05-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331\"><num value=\"331\">§ 331.</num><heading> Prohibited acts</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The following acts and the causing thereof are prohibited:</chapeau><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c06-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/a\"><num value=\"a\">(a)</num><content> The introduction or delivery for introduction into interstate commerce of any food, drug, device, tobacco product, or cosmetic that is adulterated or misbranded.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c07-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/b\"><num value=\"b\">(b)</num><content> The adulteration or misbranding of any food, drug, device, tobacco product, or cosmetic in interstate commerce.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c08-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/c\"><num value=\"c\">(c)</num><content> The receipt in interstate commerce of any food, drug, device, tobacco product, or cosmetic that is adulterated or misbranded, and the delivery or proffered delivery thereof for pay or otherwise.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c09-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/d\"><num value=\"d\">(d)</num><content> The introduction or delivery for introduction into interstate commerce of any article in violation of section 344, 350d, 355, or 360bbb–3 of this title.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c0a-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/e\"><num value=\"e\">(e)</num><content> The refusal to permit access to or copying of any record as required by section 350a, 350c, 350f(j), 350e, 354, 360bbb–3, 373, 374(a), 379aa, or 379aa–1 of this title; or the failure to establish or maintain any record, or make any report, required under section 350a, 350c(b), 350f, 350e, 354, 355(i) or (k), 360b(a)(4)(C), 360b(j), (<i>l</i>) or (m), 360ccc–1(i), 360e(f), 360i, 360bbb–3, 379aa, 379aa–1, 387i, or 387t of this title or the refusal to permit access to or verification or copying of any such required record; or the violation of any recordkeeping requirement under section 2223 <ref class=\"footnoteRef\" idref=\"fn002006\">1</ref><note type=\"footnote\" id=\"fn002006\"><num>1</num> See References in Text note below.</note> of this title (except when such violation is committed by a farm).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c0b-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/f\"><num value=\"f\">(f)</num><content> The refusal to permit entry or inspection as authorized by <ref href=\"/us/usc/t21/s374\">section 374 of this title</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c0c-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/g\"><num value=\"g\">(g)</num><content> The manufacture within any Territory of any food, drug, device, tobacco product, or cosmetic that is adulterated or misbranded.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c0d-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/h\"><num value=\"h\">(h)</num><content> The giving of a guaranty or undertaking referred to in <ref href=\"/us/usc/t21/s333/c/2\">section 333(c)(2) of this title</ref>, which guaranty or undertaking is false, except by a person who relied upon a guaranty or undertaking to the same effect signed by, and containing the name and address of, the person residing in the United States from whom he received in good faith the food, drug, device, tobacco product, or cosmetic; or the giving of a guaranty or undertaking referred to in <ref href=\"/us/usc/t21/s333/c/3\">section 333(c)(3) of this title</ref>, which guaranty or undertaking is false.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c0e-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/i\"><num value=\"i\">(i)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c0f-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/i/1\"><num value=\"1\">(1)</num><content> Forging, counterfeiting, simulating, or falsely representing, or without proper authority using any mark, stamp, tag, label, or other identification device authorized or required by regulations promulgated under the provisions of section 344 or 379e of this title.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c10-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/i/2\"><num value=\"2\">(2)</num><content> Making, selling, disposing of, or keeping in possession, control, or custody, or concealing any punch, die, plate, stone, or other thing designed to print, imprint, or reproduce the trademark, trade name, or other identifying mark, imprint, or device of another or any likeness of any of the foregoing upon any drug or container or labeling thereof so as to render such drug a counterfeit drug.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c11-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/i/3\"><num value=\"3\">(3)</num><content> The doing of any act which causes a drug to be a counterfeit drug, or the sale or dispensing, or the holding for sale or dispensing, of a counterfeit drug.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c12-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/j\"><num value=\"j\">(j)</num><content> The using by any person to his own advantage, or revealing, other than to the Secretary or officers or employees of the Department, or to the courts when relevant in any judicial proceeding under this chapter, any information acquired under authority of section 344, 348, 350a, 350c, 355, 360, 360b, 360c, 360d, 360e, 360f, 360h, 360i, 360j, 360ccc, 360ccc–1, 360ccc–2, 374, 379, 379e, 387d, 387e, 387f, 387g, 387h, 387i, or 387t(b) of this title concerning any method or process which as a trade secret is entitled to protection; or the violating of <ref href=\"/us/usc/t21/s346a/i/2\">section 346a(i)(2) of this title</ref> or any regulation issued under that section..<ref class=\"footnoteRef\" idref=\"fn002007\">2</ref><note type=\"footnote\" id=\"fn002007\"><num>2</num> So in original.</note> This paragraph does not authorize the withholding of information from either House of Congress or from, to the extent of matter within its jurisdiction, any committee or subcommittee of such committee or any joint committee of Congress or any subcommittee of such joint committee.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c13-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/k\"><num value=\"k\">(k)</num><content> The alteration, mutilation, destruction, obliteration, or removal of the whole or any part of the labeling of, or the doing of any other act with respect to, a food, drug, device, tobacco product, or cosmetic, if such act is done while such article is held for sale (whether or not the first sale) after shipment in interstate commerce and results in such article being adulterated or misbranded.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c14-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/l\"><num value=\"l\">(l)</num><content> Repealed. <ref href=\"/us/pl/105/115/tIV\">Pub. L. 105–115, title IV</ref>, § 421, <date date=\"1997-11-21\">Nov. 21, 1997</date>, <ref href=\"/us/stat/111/2380\">111 Stat. 2380</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c15-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/m\"><num value=\"m\">(m)</num><content> The sale or offering for sale of colored oleomargarine or colored margarine, or the possession or serving of colored oleomargarine or colored margarine in violation of subsections (b) or (c) of <ref href=\"/us/usc/t21/s347\">section 347 of this title</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c16-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/n\"><num value=\"n\">(n)</num><content> The using, in labeling, advertising or other sales promotion of any reference to any report or analysis furnished in compliance with <ref href=\"/us/usc/t21/s374\">section 374 of this title</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c17-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/o\"><num value=\"o\">(o)</num><content> In the case of a prescription drug distributed or offered for sale in interstate commerce, the failure of the manufacturer, packer, or distributor thereof to maintain for transmittal, or to transmit, to any practitioner licensed by applicable State law to administer such drug who makes written request for information as to such drug, true and correct copies of all printed matter which is required to be included in any package in which that drug is distributed or sold, or such other printed matter as is approved by the Secretary. Nothing in this paragraph shall be construed to exempt any person from any labeling requirement imposed by or under other provisions of this chapter.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c18-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/p\"><num value=\"p\">(p)</num><content> The failure to register in accordance with section 360 or 387e of this title, the failure to provide any information required by section 360(j), 360(k), 387e(i), or 387e(j) of this title, or the failure to provide a notice required by section 360(j)(2) or 387e(i)(3) of this title.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c19-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/q\"><num value=\"q\">(q)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c1a-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/q/1\"><num value=\"1\">(1)</num><chapeau> The failure or refusal—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide4659c1b-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/q/1/A\"><num value=\"A\">(A)</num><content> to comply with any requirement prescribed under section 360h, 360j(g), 387c(b), 387g, 387h, or 387<i>o</i> of this title;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide4659c1c-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/q/1/B\"><num value=\"B\">(B)</num><content> to furnish any notification or other material or information required by or under section 360i, 360j(g), 387d, 387i, or 387t of this title; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide4659c1d-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/q/1/C\"><num value=\"C\">(C)</num><content> to comply with a requirement under section 360<i>l</i> or 387m of this title.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c1e-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/q/2\"><num value=\"2\">(2)</num><content> With respect to any device or tobacco product, the submission of any report that is required by or under this chapter that is false or misleading in any material respect.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c1f-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/r\"><num value=\"r\">(r)</num><content> The movement of a device, drug, or tobacco product in violation of an order under <ref href=\"/us/usc/t21/s334/g\">section 334(g) of this title</ref> or the removal or alteration of any mark or label required by the order to identify the device, drug, or tobacco product as detained.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c20-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/s\"><num value=\"s\">(s)</num><content> The failure to provide the notice required by section 350a(c) or 350a(e) of this title, the failure to make the reports required by <ref href=\"/us/usc/t21/s350a/f/1/B\">section 350a(f)(1)(B) of this title</ref>, the failure to retain the records required by <ref href=\"/us/usc/t21/s350a/b/4\">section 350a(b)(4) of this title</ref>, or the failure to meet the requirements prescribed under <ref href=\"/us/usc/t21/s350a/f/3\">section 350a(f)(3) of this title</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c21-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/t\"><num value=\"t\">(t)</num><content> The importation of a drug in violation of <ref href=\"/us/usc/t21/s381/d/1\">section 381(d)(1) of this title</ref>, the sale, purchase, or trade of a drug or drug sample or the offer to sell, purchase, or trade a drug or drug sample in violation of <ref href=\"/us/usc/t21/s353/c\">section 353(c) of this title</ref>, the sale, purchase, or trade of a coupon, the offer to sell, purchase, or trade such a coupon, or the counterfeiting of such a coupon in violation of <ref href=\"/us/usc/t21/s353/c/2\">section 353(c)(2) of this title</ref>, the distribution of a drug sample in violation of <ref href=\"/us/usc/t21/s353/d\">section 353(d) of this title</ref> or the failure to otherwise comply with the requirements of <ref href=\"/us/usc/t21/s353/d\">section 353(d) of this title</ref>, the distribution of drugs in violation of <ref href=\"/us/usc/t21/s353/e\">section 353(e) of this title</ref>, failure to comply with the requirements under <ref href=\"/us/usc/t21/s360eee–1\">section 360eee–1 of this title</ref>, the failure to comply with the requirements under <ref href=\"/us/usc/t21/s360eee–3\">section 360eee–3 of this title</ref>, as applicable, or the failure to otherwise comply with the requirements of <ref href=\"/us/usc/t21/s353/e\">section 353(e) of this title</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c22-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/u\"><num value=\"u\">(u)</num><content> The failure to comply with any requirements of the provisions of, or any regulations or orders of the Secretary, under section 360b(a)(4)(A), 360b(a)(4)(D), or 360b(a)(5) of this title.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c23-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/v\"><num value=\"v\">(v)</num><content> The introduction or delivery for introduction into interstate commerce of a dietary supplement that is unsafe under <ref href=\"/us/usc/t21/s350b\">section 350b of this title</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c24-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/w\"><num value=\"w\">(w)</num><content> The making of a knowingly false statement in any statement, certificate of analysis, record, or report required or requested under <ref href=\"/us/usc/t21/s381/d/3\">section 381(d)(3) of this title</ref>; the failure to submit a certificate of analysis as required under such section; the failure to maintain records or to submit records or reports as required by such section; the release into interstate commerce of any article or portion thereof imported into the United States under such section or any finished product made from such article or portion, except for export in accordance with section 381(e) or 382 of this title, or with <ref href=\"/us/usc/t42/s262/h\">section 262(h) of title 42</ref>; or the failure to so export or to destroy such an article or portions thereof, or such a finished product.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c25-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/x\"><num value=\"x\">(x)</num><content> The falsification of a declaration of conformity submitted under <ref href=\"/us/usc/t21/s360d/c\">section 360d(c) of this title</ref> or the failure or refusal to provide data or information requested by the Secretary under paragraph (3) of such section.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c26-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/y\"><num identifier=\"/us/usc/t21/s331/y/1\"><num value=\"1\">(1)</num><content> the submission of a report or recommendation by a person accredited under <ref href=\"/us/usc/t21/s360m\">section 360m of this title</ref> that is false or misleading in any material respect;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide4659c28-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/y/2\"><num value=\"2\">(2)</num><content> the disclosure by a person accredited under <ref href=\"/us/usc/t21/s360m\">section 360m of this title</ref> of confidential commercial information or any trade secret without the express written consent of the person who submitted such information or secret to such person; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide4659c29-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/y/3\"><num value=\"3\">(3)</num><content> the receipt by a person accredited under <ref href=\"/us/usc/t21/s360m\">section 360m of this title</ref> of a bribe in any form or the doing of any corrupt act by such person associated with a responsibility delegated to such person under this chapter.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c2a-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/z\"><num value=\"z\">(z)</num><content> Omitted.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c2b-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/aa\"><num value=\"aa\">(aa)</num><content> The importation of a prescription drug in violation of <ref href=\"/us/usc/t21/s384\">section 384 of this title</ref>, the falsification of any record required to be maintained or provided to the Secretary under such section, or any other violation of regulations under such section.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c2c-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/bb\"><num value=\"bb\">(bb)</num><content> The transfer of an article of food in violation of an order under <ref href=\"/us/usc/t21/s334/h\">section 334(h) of this title</ref>, or the removal or alteration of any mark or label required by the order to identify the article as value=\"cc\">(cc)</num><content> The importing or offering for import into the United States of an article of food by, with the assistance of, or at the direction of, a person debarred under <ref 381(m) of this title</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c30-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/ff\"><num value=\"ff\">(ff)</num><content> The importing or offering for import into the United States of a drug or device with respect to which there is a failure to comply with a request of the Secretary to submit to the Secretary a statement under section 381(<i>o</i>) of this title.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c31-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/gg\"><num value=\"gg\">(gg)</num><content> The knowing failure to comply with paragraph (7)(E) of <ref href=\"/us/usc/t21/s374/g\">section 374(g) of this title</ref>; the knowing inclusion by a person accredited under paragraph (2) of such section of false information in an inspection report under paragraph (7)(A) of such section; or the knowing failure of such a person to include material facts in such a report.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c32-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/hh\"><num value=\"hh\">(hh)</num><content> The failure by a shipper, carrier by motor vehicle or rail vehicle, receiver, or any other person engaged in the transportation of food to comply with the sanitary transportation practices prescribed by the Secretary under <ref href=\"/us/usc/t21/s350e\">section 350e of this title</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c33-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/ii\"><num value=\"ii\">(ii)</num><content> The falsification of a report of a serious adverse event submitted to a responsible person (as defined under section 379aa or 379aa–1 of this title) or the falsification of a serious adverse event report (as defined under section 379aa or 379aa–1 of this title) submitted to the Secretary.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c34-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/jj\"><num value=\"jj\">(jj)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c35-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/jj/1\"><num value=\"1\">(1)</num><content> The failure to submit the certification required by <ref href=\"/us/usc/t42/s282/j/5/B\">section 282(j)(5)(B) of title 42</ref>, or knowingly submitting a false certification under such section.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c36-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/jj/2\"><num value=\"2\">(2)</num><content> The failure to submit clinical trial information required under subsection (j) of <ref href=\"/us/usc/t42/s282\">section 282 of title 42</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c37-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/jj/3\"><num value=\"3\">(3)</num><content> The submission of clinical trial information under subsection (j) of <ref href=\"/us/usc/t42/s282\">section 282 of title 42</ref> that is false or misleading in any particular under paragraph (5)(D) of such subsection (j).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c38-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/kk\"><num value=\"kk\">(kk)</num><content> The dissemination of a television advertisement without complying with section 353c <sup>1</sup> of this title.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c39-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/ll\"><num value=\"ll\">(ll)</num><chapeau> The introduction or delivery for introduction into interstate commerce of any food to which has been added a drug approved under <ref href=\"/us/usc/t21/s355\">section 355 of this title</ref>, a biological product licensed under <ref href=\"/us/usc/t42/s262\">section 262 of title 42</ref>, or a drug or a biological product for which substantial clinical investigations have been instituted and for which the existence of such investigations has been made public, unless—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide4659c3a-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/ll/1\"><num value=\"1\">(1)</num><content> such drug or such biological product was marketed in food before any approval of the drug under <ref href=\"/us/usc/t21/s355\">section 355 of this title</ref>, before licensure of the biological product under such <ref href=\"/us/usc/t42/s262\">section 262 of title 42</ref>, and before any substantial clinical investigations involving the drug or the biological product have been instituted;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide4659c3b-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/ll/2\"><num value=\"2\">(2)</num><content> the Secretary, in the Secretary’s discretion, has issued a regulation, after notice and comment, approving the use of such drug or such biological product in the food;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide4659c3c-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/ll/3\"><num value=\"3\">(3)</num><chapeau> the use of the drug or the biological product in the food is to enhance the safety of the food to which the drug or the biological product is added or applied and not to have independent biological or therapeutic effects on humans, and the use is in conformity with—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide4659c3d-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/ll/3/A\"><num value=\"A\">(A)</num><content> a regulation issued under <ref href=\"/us/usc/t21/s348\">section 348 of this title</ref> prescribing conditions of safe use in food;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide4659c3e-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/ll/3/B\"><num value=\"B\">(B)</num><content> a regulation listing or affirming conditions under which the use of the drug or the biological product in food is generally recognized as safe;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide4659c3f-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/ll/3/C\"><num value=\"C\">(C)</num><content> the conditions of use identified in a notification to the Secretary of a claim of exemption from the premarket approval requirements for food additives based on the notifier’s determination that the use of the drug or the biological product in food is generally recognized as safe, provided that the Secretary has not questioned the general recognition of safety determination in a letter to the notifier;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide4659c40-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/ll/3/D\"><num value=\"D\">(D)</num><content> a food contact substance notification that is effective under <ref href=\"/us/usc/t21/s348/h\">section 348(h) of this title</ref>; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide4659c41-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/ll/3/E\"><num value=\"E\">(E)</num><content> such drug or biological product had been marketed for smoking cessation prior to <date date=\"2007-09-27\">September 27, 2007</date>; or</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide4659c42-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/ll/4\"><num value=\"4\">(4)</num><content> the drug is a new animal drug whose use is not unsafe under <ref href=\"/us/usc/t21/s360b\">section 360b of this title</ref>.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c43-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/mm\"><num value=\"mm\">(mm)</num><content> The failure to submit a report or provide a notification required under <ref href=\"/us/usc/t21/s350f/d\">section 350f(d) of this title</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c44-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/nn\"><num value=\"nn\">(nn)</num><content> The falsification of a report or notification required under <ref href=\"/us/usc/t21/s350f/d\">section 350f(d) of this title</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c45-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/oo\"><num value=\"oo\">(oo)</num><content> The sale of tobacco products in violation of a no-tobacco-sale order issued under <ref href=\"/us/usc/t21/s333/f\">section 333(f) of this title</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c46-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/pp\"><num value=\"pp\">(pp)</num><content> The introduction or delivery for introduction into interstate commerce of a tobacco product in violation of <ref href=\"/us/usc/t21/s387k\">section 387k of this title</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c47-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/qq\"><num value=\"qq\">(qq)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c48-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/qq/1\"><num value=\"1\">(1)</num><content> Forging, counterfeiting, simulating, or falsely representing, or without proper authority using any mark, stamp (including tax stamp), tag, label, or other identification device upon any tobacco product or container or labeling thereof so as to render such tobacco product a counterfeit tobacco product.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c49-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/qq/2\"><num value=\"2\">(2)</num><content> Making, selling, disposing of, or keeping in possession, control, or custody, or concealing any punch, die, plate, stone, or other item that is designed to print, imprint, or reproduce the trademark, trade name, or other identifying mark, imprint, or device of another or any likeness of any of the foregoing upon any tobacco product or container or labeling thereof so as to render such tobacco product a counterfeit tobacco product.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c4a-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/qq/3\"><num value=\"3\">(3)</num><content> The doing of any act that causes a tobacco product to be a counterfeit tobacco product, or the sale or dispensing, or the holding for sale or dispensing, of a counterfeit tobacco product.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c4b-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/rr\"><num value=\"rr\">(rr)</num><content> The charitable distribution of tobacco products.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c4c-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/ss\"><num value=\"ss\">(ss)</num><content> The failure of a manufacturer or distributor to notify the Attorney General and the Secretary of the Treasury of their knowledge of tobacco products used in illicit trade.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c4d-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/tt\"><num value=\"tt\">(tt)</num><chapeau> Making any express or implied statement or representation directed to consumers with respect to a tobacco product, in a label or labeling or through the media or advertising, that either conveys, or misleads or would mislead consumers into believing, that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide4659c4e-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/tt/1\"><num value=\"1\">(1)</num><content> the product is approved by the Food and Drug Administration;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide4659c4f-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/tt/2\"><num value=\"2\">(2)</num><content> the Food and Drug Administration deems the product to be safe for use by consumers;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide4659c50-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/tt/3\"><num value=\"3\">(3)</num><content> the product is endorsed by the Food and Drug Administration for use by consumers; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide4659c51-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/tt/4\"><num value=\"4\">(4)</num><chapeau> the product is safe or less harmful by virtue of—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide4659c52-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/tt/4/A\"><num value=\"A\">(A)</num><content> its regulation or inspection by the Food and Drug Administration; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide4659c53-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/tt/4/B\"><num value=\"B\">(B)</num><content> its compliance with regulatory requirements set by the Food and Drug Administration;</content>\n</subparagraph>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">including any such statement or representation rendering the product misbranded under <ref href=\"/us/usc/t21/s387c\">section 387c of this title</ref>.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c54-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/uu\"><num value=\"uu\">(uu)</num><content> The operation of a facility that manufactures, processes, packs, or holds food for sale in the United States if the owner, operator, or agent in charge of such facility is not in compliance with <ref href=\"/us/usc/t21/s350g\">section 350g of this title</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c55-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/vv\"><num value=\"vv\">(vv)</num><content> The failure to comply with the requirements under <ref href=\"/us/usc/t21/s350h\">section 350h of this title</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c56-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/ww\"><num value=\"ww\">(ww)</num><content> The failure to comply with <ref href=\"/us/usc/t21/s350i\">section 350i of this title</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c57-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/xx\"><num value=\"xx\">(xx)</num><content> The refusal or failure to follow an order under section 350<i>l</i> of this title.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c58-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/yy\"><num value=\"yy\">(yy)</num><content> The knowing and willful failure to comply with the notification requirement under <ref href=\"/us/usc/t21/s350f/h\">section 350f(h) of this title</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c59-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/zz\"><num value=\"zz\">(zz)</num><content> The importation or offering for importation of a food if the importer (as defined in <ref href=\"/us/usc/t21/s384a\">section 384a of this title</ref>) does not have in place a foreign supplier verification program in compliance with such <ref href=\"/us/usc/t21/s384a\">section 384a of this title</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c5a-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/aaa\"><num value=\"aaa\">(aaa)</num><content> The failure to register in accordance with <ref href=\"/us/usc/t21/s381/s\">section 381(s) of this title</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c5b-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/bbb\"><num value=\"bbb\">(bbb)</num><content> The failure to notify the Secretary in violation of <ref href=\"/us/usc/t21/s360bbb–7\">section 360bbb–7 of this title</ref>.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c5c-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/ccc\"><num value=\"ccc\">(ccc)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c5d-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/ccc/1\"><num value=\"1\">(1)</num><content> The resale of a compounded drug that is labeled “not for resale” in accordance with <ref href=\"/us/usc/t21/s353b\">section 353b of this title</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c5e-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/ccc/2\"><num value=\"2\">(2)</num><content> With respect to a drug to be compounded pursuant to section 353a or 353b of this title, the intentional falsification of a prescription, as applicable.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c5f-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/ccc/3\"><num value=\"3\">(3)</num><content> The failure to report drugs or adverse events by an entity that is registered in accordance with subsection (b) of <ref href=\"/us/usc/t21/s353b\">section 353b of this title</ref>.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c60-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/ddd\"><num value=\"ddd\">(ddd)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide4659c61-ec7d-11e6-944b-93361b188886\" identifier=\"/us/usc/t21/s331/ddd/1\"><num value=\"1\">(1)</num><content> The L. 110–85</ref>, enacting sections 353b and 355–1 of this title, amending this section, sections 333, 352, and 355 of this title, and <ref href=\"/us/usc/t42/s262\">section 262 of Title 42</ref>, The Public Health and Welfare, and enacting provisions set out as notes under sections 352, 355, and 355a of this title] takes effect 180 days after the date of the enactment of this Act [<date date=\"2007-09-27\">Sept. 27, 2007</date>].</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> Drugs Deemed to Have Risk Evaluation and Mitigation Strategies.—</heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>A drug that was approved before the effective date of this Act [probably means “this subtitle”, see above] is, in accordance with paragraph (2), deemed to have in effect an approved risk evaluation and mitigation strategy under section 505–1 of the Federal Food, Drug, and Cosmetic Act [<ref href=\"/us/usc/t21/s355–1\">21 U.S.C. 355–1</ref>] (as added by section 901) (referred to in this section as the ‘Act’) if there are in effect on the effective date of this Act elements to assure safe use—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> required under section 314.520 or section 601.42 of title 21, Code of Federal Regulations; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> otherwise agreed to by the applicant and the Secretary for such drug.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Elements of strategy; enforcement</inline>.—</heading><chapeau>The approved risk evaluation and mitigation strategy in effect for a drug under paragraph (1)—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> is deemed to consist of the timetable required under section 505–1(d) and any additional elements under subsections (e) and (f) of such section in effect for such drug on the effective date of this Act; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> is subject to enforcement by the Secretary to the same extent as any other risk evaluation and mitigation strategy under section 505–1 of the Act, except that sections 303(f)(4) and 502(y) and (z) of the Act [<ref href=\"/us/usc/t21/s333/f/4\">21 U.S.C. 333(f)(4)</ref>, 352(y), (z)] (as added by section 902) shall not apply to such strategy before the Secretary has completed review of, and acted on, the first assessment of such strategy under such section 505–1.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Submission</inline>.—</heading><content>Not later than 180 days after the effective date of this Act, the holder of an approved application for which a risk evaluation and mitigation strategy is deemed to be in effect under paragraph (1) shall submit to the Secretary a proposed risk evaluation and mitigation strategy.
