L. 103–417, §§ 3(c), 7(d), Oct. 25, 1994, 108 Stat. 4328, 4331.)","seq_in_title":129,"parent_identifier":"/us/usc/t21/ch9/schIV","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9","level":"chapter","num":"CHAPTER 9—","heading":"FEDERAL FOOD, DRUG, AND COSMETIC ACT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schIV","level":"subchapter","num":"SUBCHAPTER IV—","heading":"FOOD","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idae1456ae-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350\"><num value=\"350\">§ 350.</num><heading> Vitamins and minerals</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idae1456af-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Authority and limitations of Secretary; applicability</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idae1456b0-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/a/1\"><num value=\"1\">(1)</num><chapeau> Except as provided in paragraph (2)—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idae1456b1-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/a/1/A\"><num value=\"A\">(A)</num><content> the Secretary may not establish, under section 321(n), 341, or 343 of this title, maximum limits on the potency of any synthetic or natural vitamin or mineral within a food to which this section applies;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idae1456b2-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/a/1/B\"><num value=\"B\">(B)</num><content> the Secretary may not classify any natural or synthetic vitamin or mineral (or combination thereof) as a drug solely because it exceeds the level of potency which the Secretary determines is nutritionally rational or useful;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idae1456b3-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/a/1/C\"><num value=\"C\">(C)</num><chapeau> the Secretary may not limit, under section 321(n), 341, or 343 of this title, the combination or number of any synthetic or natural—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idae1456b4-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/a/1/C/i\"><num value=\"i\">(i)</num><content> vitamin,</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idae1456b5-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/a/1/C/ii\"><num value=\"ii\">(ii)</num><content> mineral, or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idae1456b6-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/a/1/C/iii\"><num value=\"iii\">(iii)</num><content> other ingredient of food,</content>\n</clause>\n\n<continuation style=\"-uslm-lc:I17\" class=\"indent1 firstIndent0\">within a food to which this section applies.</continuation>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idae1456b7-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/a/2\"><num value=\"2\">(2)</num><content> Paragraph (1) shall not apply in the case of a vitamin, mineral, other ingredient of food, or food, which is represented for use by individuals in the treatment or management of specific diseases or disorders, by children, or by pregnant or lactating women. For purposes of this subparagraph,<ref class=\"footnoteRef\" idref=\"fn002018\">1</ref><note type=\"footnote\" id=\"fn002018\"><num>1</num> So in original. Probably should be “paragraph”.</note> the term “children” means individuals who are under the age of twelve years.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idae1456b8-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Labeling and advertising requirements for foods</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idae1456b9-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/b/1\"><num value=\"1\">(1)</num><content> A food to which this section applies shall not be deemed under <ref href=\"/us/usc/t21/s343\">section 343 of this title</ref> to be misbranded solely because its label bears, in accordance with <ref href=\"/us/usc/t21/s343/i/2\">section 343(i)(2) of this title</ref>, all the ingredients in the food or its advertising contains references to ingredients in the food which are not vitamins or minerals.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idae1456ba-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/b/2\"><num value=\"2\">(2)</num><content> The labeling for any food to which this section applies may not list its ingredients which are not dietary supplement ingredients described in <ref href=\"/us/usc/t21/s321/ff\">section 321(ff) of this title</ref> (i) except as a part of a list of all the ingredients of such food, and (ii) unless such ingredients are listed in accordance with applicable regulations under <ref href=\"/us/usc/t21/s343\">section 343 of this title</ref>. To the extent that compliance with clause (i) of this subparagraph is impracticable or results in deception or unfair competition, exemptions shall be established by regulations promulgated by the Secretary.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idae1456bb-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Definitions</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idae1456bc-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/c/1\"><num value=\"1\">(1)</num><chapeau> For purposes of this section, the term “food to which this section applies” means a food for humans which is a food for special dietary use—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idae1456bd-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/c/1/A\"><num value=\"A\">(A)</num><content> which is or contains any natural or synthetic vitamin or mineral, and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idae1456be-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/c/1/B\"><num value=\"B\">(B)</num><chapeau> which—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idae1456bf-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/c/1/B/i\"><num value=\"i\">(i)</num><content> is intended for ingestion in tablet, capsule, powder, softgel, gelcap, or liquid form, or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idae1456c0-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/c/1/B/ii\"><num value=\"ii\">(ii)</num><content> if not intended for ingestion in such a form, is not represented as conventional food and is not represented for use as a sole item of a meal or of the diet.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idae1456c1-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/c/2\"><num value=\"2\">(2)</num><content> For purposes of paragraph (1)(B)(i), a food shall be considered as intended for ingestion in liquid form only if it is formulated in a fluid carrier and it is intended for ingestion in daily quantities measured in drops or similar small units of measure.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idae1456c2-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/c/3\"><num value=\"3\">(3)</num><chapeau> For purposes of paragraph (1) and of <ref href=\"/us/usc/t21/s343/j\">section 343(j) of this title</ref> insofar as that section is applicable to food to which this section applies, the term “special dietary use” as applied to food used by man means a particular use for which a food purports or is represented to be used, including but not limited to the following:</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idae1456c3-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/c/3/A\"><num value=\"A\">(A)</num><content> Supplying a special dietary need that exists by reason of a physical, physiological, pathological, or other condition, including but not limited to the condition of disease, convalescence, pregnancy, lactation, infancy, allergic hypersensitivity to food, underweight, overweight, or the need to control the intake of sodium.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idae1456c4-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/c/3/B\"><num value=\"B\">(B)</num><content> Supplying a vitamin, mineral, or other ingredient for use by man to supplement his diet by increasing the total dietary intake.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idae1456c5-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350/c/3/C\"><num value=\"C\">(C)</num><content> Supplying a special dietary need by reason of being a food for use as the sole item of the diet.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idae1456c6-ec38-11e5-9fc5-818d616f3d7f\">(<ref href=\"/us/act/1938-06-25/ch675\">June 25, 1938, ch. 675</ref>, § 411, as added <ref href=\"/us/pl/94/278/tV\">Pub.
