L. 111–353, title I, § 106(a), Jan. 4, 2011, 124 Stat. 3905.)","seq_in_title":138,"parent_identifier":"/us/usc/t21/ch9/schIV","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9","level":"chapter","num":"CHAPTER 9—","heading":"FEDERAL FOOD, DRUG, AND COSMETIC ACT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schIV","level":"subchapter","num":"SUBCHAPTER IV—","heading":"FOOD","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idae1b8191-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350i\"><num value=\"350i\">§ 350i.</num><heading> Protection against intentional adulteration</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idae1b8192-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350i/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Determinations</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idae1b8193-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350i/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau>The Secretary shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idae1b8194-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350i/a/1/A\"><num value=\"A\">(A)</num><content> conduct a vulnerability assessment of the food system, including by consideration of the Department of Homeland Security biological, chemical, radiological, or other terrorism risk assessments;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idae1b8195-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350i/a/1/B\"><num value=\"B\">(B)</num><content> consider the best available understanding of uncertainties, risks, costs, and benefits associated with guarding against intentional adulteration of food at vulnerable points; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idae1b8196-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350i/a/1/C\"><num value=\"C\">(C)</num><content> determine the types of science-based mitigation strategies or measures that are necessary to protect against the intentional adulteration of food.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idae1b8197-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350i/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Limited distribution</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In the interest of national security, the Secretary, in consultation with the Secretary of Homeland Security, may determine the time, manner, and form in which determinations made under paragraph (1) are made publicly available.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idae1b8198-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350i/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Regulations</heading><chapeau>Not later than 18 months after <date date=\"2011-01-04\">January 4, 2011</date>, the Secretary, in coordination with the Secretary of Homeland Security and in consultation with the Secretary of Agriculture, shall promulgate regulations to protect against the intentional adulteration of food subject to this chapter. Such regulations shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idae1b8199-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350i/b/1\"><num value=\"1\">(1)</num><content> specify how a person shall assess whether the person is required to implement mitigation strategies or measures intended to protect against the intentional adulteration of food; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idae1b819a-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350i/b/2\"><num value=\"2\">(2)</num><content> specify appropriate science-based mitigation strategies or measures to prepare and protect the food supply chain at specific vulnerable points, as appropriate.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idae1b819b-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350i/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Applicability</heading><chapeau>Regulations promulgated under subsection (b) shall apply only to food for which there is a high risk of intentional contamination, as determined by the Secretary, in consultation with the Secretary of Homeland Security, under subsection (a), that could cause serious adverse health consequences or death to humans or animals and shall include those foods—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idae1b819c-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350i/c/1\"><num value=\"1\">(1)</num><content> for which the Secretary has identified clear vulnerabilities (including short shelf-life or susceptibility to intentional contamination at critical control points); and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idae1b819d-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350i/c/2\"><num value=\"2\">(2)</num><content> in bulk or batch form, prior to being packaged for the final consumer.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idae1b819e-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350i/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Exception</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">This section shall not apply to farms, except for those that produce milk.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idae1b819f-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s350i/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Definition</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this section, the term “farm” has the meaning given that term in section 1.227 of title 21, Code of Federal Regulations (or any successor regulation).</p>\n</content>\n</subsection>\n<sourceCredit id=\"idae1b81a0-ec38-11e5-9fc5-818d616f3d7f\">(<ref href=\"/us/act/1938-06-25/ch675\">June 25, 1938, ch. 675</ref>, § 420, as added <ref href=\"/us/pl/111/353/tI\">Pub. L. 111–353, title I</ref>, § 106(a), <date date=\"2011-01-04\">Jan. 4, 2011</date>, <ref href=\"/us/stat/124/3905\">124 Stat. 3905</ref>.)</sourceCredit>\n<notes type=\"uscNote\" id=\"idae1b81a1-ec38-11e5-9fc5-818d616f3d7f\">\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"idae1b81a2-ec38-11e5-9fc5-818d616f3d7f\"><heading class=\"centered smallCaps\">Construction</heading><p style=\"-uslm-lc:I21\" class=\"indent0\">Nothing in this section to be construed to apply to certain alcohol-related facilities, to alter jurisdiction and authorities established under certain other Acts, or in a manner inconsistent with international agreements to which the United States is a party, see sections 2206, 2251, and 2252 of this title.</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"idae1b81a3-ec38-11e5-9fc5-818d616f3d7f\"><heading class=\"centered smallCaps\">Guidance Documents</heading><p><ref href=\"/us/pl/111/353/tI\">Pub. L. 111–353, title I</ref>, § 106(b), <date date=\"2011-01-04\">Jan. 4, 2011</date>, <ref href=\"/us/stat/124/3906\">124 Stat. 3906</ref>, provided that:<quotedContent origin=\"/us/pl/111/353/tI\">\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>Not later than 1 year after the date of enactment of this Act [<date date=\"2011-01-04\">Jan. 4, 2011</date>], the Secretary of Health and Human Services, in consultation with the Secretary of Homeland Security and the Secretary of Agriculture, shall issue guidance documents related to protection against the intentional adulteration of food, including mitigation strategies or measures to guard against such adulteration as required under section 420 of the Federal Food, Drug, and Cosmetic Act [<ref href=\"/us/usc/t21/s450i\">21 U.S.C. 450i</ref>], as added by subsection (a).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Content</inline>.—</heading><chapeau>The guidance documents issued under paragraph (1) shall—</chapeau><subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"A\">“(A)</num><content> include a model assessment for a person to use under subsection (b)(1) of section 420 of the Federal Food, Drug, and Cosmetic Act, as added by subsection (a);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"B\">“(B)</num><content> include examples of mitigation strategies or measures described in subsection (b)(2) of such section; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"C\">“(C)</num><content> specify situations in which the examples of mitigation strategies or measures described in subsection (b)(2) of such section are appropriate.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Limited distribution</inline>.—</heading><content>In the interest of national security, the Secretary of Health and Human Services, in consultation with the Secretary of Homeland Security, may determine the time, manner, and form in which the guidance documents issued under paragraph (1) are made public, including by releasing such documents to targeted audiences.”</content>\n</paragraph>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"idae1b81a4-ec38-11e5-9fc5-818d616f3d7f\"><heading class=\"centered smallCaps\">Periodic Review</heading><p><ref href=\"/us/pl/111/353/tI\">Pub.
