facilities, foreign facilities, and ports of entry; annual report</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id7ccbfc48-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Identification and inspection of facilities</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id7ccc2359-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Identification</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall identify high-risk facilities and shall allocate resources to inspect facilities according to the known safety risks of the facilities, which shall be based on the following factors:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7ccc235a-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/a/1/A\"><num value=\"A\">(A)</num><content> The known safety risks of the food manufactured, processed, packed, or held at the facility.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7ccc235b-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/a/1/B\"><num value=\"B\">(B)</num><content> The compliance history of a facility, including with regard to food recalls, outbreaks of foodborne illness, and violations of food safety standards.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7ccc235c-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/a/1/C\"><num value=\"C\">(C)</num><content> The rigor and effectiveness of the facility’s hazard analysis and risk-based preventive controls.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7ccc235d-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/a/1/D\"><num value=\"D\">(D)</num><content> Whether the food manufactured, processed, packed, or held at the facility meets the criteria for priority under <ref href=\"/us/usc/t21/s381/h/1\">section 381(h)(1) of this title</ref>.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7ccc235e-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/a/1/E\"><num value=\"E\">(E)</num><content> Whether the food or the facility that manufactured, processed, packed, or held such food has received a certification as described in section 381(q) or 384b of this title, as appropriate.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7ccc235f-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/a/1/F\"><num value=\"F\">(F)</num><content> Any other criteria deemed necessary and appropriate by the Secretary for purposes of allocating inspection resources.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id7ccc2360-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Inspections</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id7ccc2361-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/a/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Beginning on <date date=\"2011-01-04\">January 4, 2011</date>, the Secretary shall increase the frequency of inspection of all facilities.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id7ccc2362-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/a/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Domestic high-risk facilities</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall increase the frequency of inspection of domestic facilities identified under paragraph (1) as high-risk facilities such that each such facility is inspected—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id7ccc2363-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/a/2/B/i\"><num value=\"i\">(i)</num><content> not less often than once in the 5-year period following <date date=\"2011-01-04\">January 4, 2011</date>; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id7ccc2364-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/a/2/B/ii\"><num value=\"ii\">(ii)</num><content> not less often than once every 3 years thereafter.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id7ccc2365-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/a/2/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Domestic non-high-risk facilities</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall ensure that each domestic facility that is not identified under paragraph (1) as a high-risk facility is inspected—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id7ccc4a76-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/a/2/C/i\"><num value=\"i\">(i)</num><content> not less often than once in the 7-year period following <date date=\"2011-01-04\">January 4, 2011</date>; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id7ccc4a77-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/a/2/C/ii\"><num value=\"ii\">(ii)</num><content> not less often than once every 5 years thereafter.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id7ccc4a78-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/a/2/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Foreign facilities</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id7ccc4a79-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/a/2/D/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Year 1</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">In the 1-year period following <date date=\"2011-01-04\">January 4, 2011</date>, the Secretary shall inspect not fewer than 600 foreign facilities.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id7ccc4a7a-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/a/2/D/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Subsequent years</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">In each of the 5 years following the 1-year period described in clause (i), the Secretary shall inspect not fewer than twice the number of foreign facilities inspected by the Secretary during the previous year.</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id7ccc4a7b-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/a/2/E\"><num value=\"E\" class=\"bold\">(E)</num><heading class=\"bold\"> Reliance on Federal, State, or local inspections</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In meeting the inspection requirements under this subsection for domestic facilities, the Secretary may rely on inspections conducted by other Federal, State, or local agencies under interagency agreement, contract, memoranda of understanding, or other obligation.</p>\n</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id7ccc4a7c-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Identification and inspection at ports of entry</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary, in consultation with the Secretary of Homeland Security, shall allocate resources to inspect any article of food imported into the United States according to the known safety risks of the article of food, which shall be based on the following factors:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7ccc4a7d-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/b/1\"><num value=\"1\">(1)</num><content> The known safety risks of the food imported.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7ccc4a7e-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/b/2\"><num value=\"2\">(2)</num><content> The known safety risks of the countries or regions of origin and countries through which such article of food is transported.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7ccc4a7f-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/b/3\"><num value=\"3\">(3)</num><content> The compliance history of the importer, including with regard to food recalls, outbreaks of foodborne illness, and violations of food safety standards.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7ccc4a80-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/b/4\"><num value=\"4\">(4)</num><content> The rigor and effectiveness of the activities conducted by the importer of such article of food to satisfy the requirements of the foreign supplier verification program under <ref href=\"/us/usc/t21/s384a\">section 384a of this title</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7ccc7191-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/b/5\"><num value=\"5\">(5)</num><content> Whether the food importer participates in the voluntary qualified importer program under <ref href=\"/us/usc/t21/s384b\">section 384b of this title</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7ccc7192-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/b/6\"><num value=\"6\">(6)</num><content> Whether the food meets the criteria for priority under <ref href=\"/us/usc/t21/s381/h/1\">section 381(h)(1) of this title</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7ccc7193-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/b/7\"><num value=\"7\">(7)</num><content> Whether the food or the facility that manufactured, processed, packed, or held such food received a certification as described in section 381(q) or 384b of this title.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7ccc7194-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/b/8\"><num value=\"8\">(8)</num><content> Any other criteria deemed necessary and appropriate by the Secretary for purposes of allocating inspection resources.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id7ccc7195-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Interagency agreements with respect to seafood</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id7ccc7196-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary of Health and Human Services, the Secretary of Commerce, the Secretary of Homeland Security, the Chairman of the Federal Trade Commission, and the heads of other appropriate agencies may enter into such agreements as may be necessary or appropriate to improve seafood safety.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id7ccc7197-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Scope of agreements</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The agreements under paragraph (1) may include—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7ccc7198-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/c/2/A\"><num value=\"A\">(A)</num><content> cooperative arrangements for examining and testing seafood imports that leverage the resources, capabilities, and authorities of each party to the agreement;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7ccc7199-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/c/2/B\"><num value=\"B\">(B)</num><content> coordination of inspections of foreign facilities to increase the percentage of imported seafood and seafood facilities inspected;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7ccc719a-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/c/2/C\"><num value=\"C\">(C)</num><content> standardization of data on seafood names, inspection records, and laboratory testing to improve interagency coordination;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7ccc719b-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/c/2/D\"><num value=\"D\">(D)</num><content> coordination to detect and investigate violations under applicable Federal law;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7ccc719c-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/c/2/E\"><num value=\"E\">(E)</num><content> a process, including the use or modification of existing processes, by which officers and employees of the National Oceanic and Atmospheric Administration may be duly designated by the Secretary to carry out seafood examinations and investigations under <ref href=\"/us/usc/t21/s381\">section 381 of this title</ref> or section 203 of the Food Allergen Labeling and Consumer Protection Act of 2004;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7ccc98ad-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/c/2/F\"><num value=\"F\">(F)</num><content> the sharing of information concerning observed non-compliance with United States food requirements domestically and in foreign nations and new regulatory decisions and policies that may affect the safety of food imported into the United States;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7ccc98ae-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/c/2/G\"><num value=\"G\">(G)</num><content> conducting joint training on subjects that affect and strengthen seafood inspection effectiveness by Federal authorities; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7ccc98af-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/c/2/H\"><num value=\"H\">(H)</num><content> outreach on Federal efforts to enhance seafood safety and compliance with Federal food safety requirements.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id7ccc98b0-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Coordination</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall improve coordination and cooperation with the Secretary of Agriculture and the Secretary of Homeland Security to target food inspection resources.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id7ccc98b1-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s350j/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Facility</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this section, the term “facility” means a domestic facility or a foreign facility that is
