L. 111–353, title II, § 206(a), Jan. 4, 2011, 124 Stat. 3939.)","seq_in_title":116,"parent_identifier":"/us/usc/t21/ch9/schIV","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9","level":"chapter","num":"CHAPTER 9—","heading":"FEDERAL FOOD, DRUG, AND COSMETIC ACT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schIV","level":"subchapter","num":"SUBCHAPTER IV—","heading":"FOOD","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id6e08b1e2-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l\"><num value=\"350l\">§ 350l.</num><heading> Mandatory recall authority</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id6e08b1e3-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Voluntary procedures</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">If the Secretary determines, based on information gathered through the reportable food registry under <ref href=\"/us/usc/t21/s350f\">section 350f of this title</ref> or through any other means, that there is a reasonable probability that an article of food (other than infant formula) is adulterated under <ref href=\"/us/usc/t21/s342\">section 342 of this title</ref> or misbranded under <ref href=\"/us/usc/t21/s343/w\">section 343(w) of this title</ref> and the use of or exposure to such article will cause serious adverse health consequences or death to humans or animals, the Secretary shall provide the responsible party (as defined in <ref href=\"/us/usc/t21/s350f\">section 350f of this title</ref>) with an opportunity to cease distribution and recall such article.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id6e08b1e4-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Prehearing order to cease distribution and give notice</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id6e08b1e5-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau>If the responsible party refuses to or does not voluntarily cease distribution or recall such article within the time and in the manner prescribed by the Secretary (if so prescribed), the Secretary may, by order require, as the Secretary deems necessary, such person to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6e08b1e6-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/b/1/A\"><num value=\"A\">(A)</num><content> immediately cease distribution of such article; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6e08b1e7-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/b/1/B\"><num value=\"B\">(B)</num><chapeau> as applicable, immediately notify all persons—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id6e08b1e8-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/b/1/B/i\"><num value=\"i\">(i)</num><content> manufacturing, processing, packing, transporting, distributing, receiving, holding, or importing and selling such article; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id6e08b1e9-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/b/1/B/ii\"><num value=\"ii\">(ii)</num><content> to which such article has been distributed, transported, or sold, to immediately cease distribution of such article.<ref class=\"footnoteRef\" idref=\"fn002025\">1</ref><note type=\"footnote\" id=\"fn002025\"><num>1</num> So in original. (ii).</note></content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id6e08b1ea-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Required additional information</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id6e08b1eb-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/b/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">If an article of food covered by a recall order issued under paragraph (1)(B) has been distributed to a warehouse-based third party logistics provider without providing such provider sufficient information to know or reasonably determine the precise identity of the article of food covered by a recall order that is in its possession, the notice provided by the responsible party subject to the order issued under paragraph (1)(B) shall include such information as is necessary for the warehouse-based third party logistics provider to identify the food.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id6e08b1ec-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/b/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Rules of construction</heading><chapeau>Nothing in this paragraph shall be construed—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id6e08b1ed-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/b/2/B/i\"><num value=\"i\">(i)</num><content> to exempt a warehouse-based third party logistics provider from the requirements of this chapter, including the requirements in this section and <ref href=\"/us/usc/t21/s350c\">section 350c of this title</ref>; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id6e08b1ee-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/b/2/B/ii\"><num value=\"ii\">(ii)</num><content> to exempt a warehouse-based third party logistics provider from being the subject of a mandatory recall order.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id6e08b1ef-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Determination to limit areas affected</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">If the Secretary requires a responsible party to cease distribution under paragraph (1)(A) of an article of food identified in subsection (a), the Secretary may limit the size of the geographic area and the markets affected by such cessation if such limitation would not compromise the public health.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id6e08b1f0-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Hearing on order</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall provide the responsible party subject to an order under subsection (b) with an opportunity for an informal hearing, to be held as soon as possible, but not later than 2 days after the issuance of the order, on the actions required by the order and on why the article that is the subject of the order should not be recalled.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id6e08b1f1-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Post-hearing recall order and modification of order</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id6e08b1f2-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Amendment of order</heading><chapeau>If, after providing opportunity for an informal hearing under subsection (c), the Secretary determines that removal of the article from commerce is necessary, the Secretary shall, as appropriate—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6e08b1f3-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/d/1/A\"><num value=\"A\">(A)</num><content> amend the order to require recall of such article or other appropriate action;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6e08b1f4-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/d/1/B\"><num value=\"B\">(B)</num><content> specify a timetable in which the recall shall occur;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6e08b1f5-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/d/1/C\"><num value=\"C\">(C)</num><content> require periodic reports to the Secretary describing the progress of the recall; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6e08b1f6-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/d/1/D\"><num value=\"D\">(D)</num><content> provide notice to consumers to whom such article was, or may have been, distributed.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id6e08b1f7-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Vacating of order</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">If, after such hearing, the Secretary determines that adequate grounds do not exist to continue the actions required by the order, or that such actions should be modified, the Secretary shall vacate the order or modify the order.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id6e08b1f8-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Rule regarding alcoholic beverages</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall not initiate a mandatory recall or take any other action under this section with respect to any alcohol beverage until the Secretary has provided the Alcohol and Tobacco Tax and Trade Bureau with a reasonable opportunity to cease distribution and recall such article under the Alcohol and Tobacco Tax and Trade Bureau authority.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id6e0b22f9-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Cooperation and consultation</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall work with State and local public health officials in carrying out this section, as appropriate.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id6e0b22fa-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Public notification</heading><chapeau>In conducting a recall under this section, the Secretary shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6e0b22fb-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/g/1\"><num value=\"1\">(1)</num><chapeau> ensure that a press release is published regarding the recall, as well as alerts and public notices, as appropriate, in order to provide notification—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6e0b22fc-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/g/1/A\"><num value=\"A\">(A)</num><content> of the recall to consumers and retailers to whom such article was, or may have been, distributed; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6e0b22fd-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/g/1/B\"><num value=\"B\">(B)</num><chapeau> that includes, at a minimum—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id6e0b22fe-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/g/1/B/i\"><num value=\"i\">(i)</num><content> the name of the article of food subject to the recall;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id6e0b22ff-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/g/1/B/ii\"><num value=\"ii\">(ii)</num><content> a description of the risk associated with such article; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id6e0b2300-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/g/1/B/iii\"><num value=\"iii\">(iii)</num><content> to the extent practicable, information for consumers about similar articles of food that are not affected by the recall;</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6e0b2301-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/g/2\"><num value=\"2\">(2)</num><content> consult the policies of the Department of Agriculture regarding providing to the public a list of retail consignees receiving products involved in a Class I recall and shall consider providing such a list to the public, as determined appropriate by the Secretary; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6e0b2302-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/g/3\"><num value=\"3\">(3)</num><content> if available, publish on the Internet Web site of the Food and Drug Administration an image of the article that is the subject of the press release described in (1).<ref class=\"footnoteRef\" idref=\"fn002026\">2</ref><note type=\"footnote\" id=\"fn002026\"><num>2</num> So in original. Probably should be “paragraph (1).”</note></content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id6e0b2303-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> No delegation</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The authority conferred by this section to order a recall or vacate a recall order shall not be delegated to any officer or employee other than the Commissioner.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id6e0b2304-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Effect</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Nothing in this section shall affect the authority of the Secretary to request or participate in a voluntary recall, or to issue an order to cease distribution or to recall under any other provision of this chapter or under the Public Health Service Act [<ref href=\"/us/usc/t42/s201\">42 U.S.C. 201</ref> et seq.].</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id6e0b2305-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/j\"><num value=\"j\" class=\"bold\">(j)</num><heading class=\"bold\"> Coordinated communication</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id6e0b2306-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/j/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">To assist in carrying out the requirements of this subsection, the Secretary shall establish an incident command operation or a similar operation within the Department of Health and Human Services that will operate not later than 24 hours after the initiation of a mandatory recall or the recall of an article of food for which the use of, or exposure to, such article will cause serious adverse health consequences or death to humans or animals.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id6e0b2307-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/j/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Requirements</heading><chapeau>To reduce the potential for miscommunication during recalls or regarding investigations of a food borne illness outbreak associated with a food that is subject to a recall, each incident command operation or similar operation under paragraph (1) shall use regular staff and resources of the Department of Health and Human Services to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6e0b2308-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/j/2/A\"><num value=\"A\">(A)</num><content> ensure timely and coordinated communication within the Department, including enhanced communication and coordination between different agencies and organizations within the Department;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6e0b2309-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/j/2/B\"><num value=\"B\">(B)</num><content> ensure timely and coordinated communication from the Department, including public statements, throughout the duration of the investigation and related foodborne illness outbreak;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6e0b230a-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/j/2/C\"><num value=\"C\">(C)</num><content> identify a single point of contact within the Department for public inquiries regarding any actions by the Secretary related to a recall;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6e0b230b-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/j/2/D\"><num value=\"D\">(D)</num><content> coordinate with Federal, State, local, and tribal authorities, as appropriate, that have responsibilities related to the recall of a food or a foodborne illness outbreak associated with a food that is subject to the recall, including notification of the Secretary of Agriculture and the Secretary of Education in the event such recalled food is a commodity intended for use in a child nutrition program (as identified in <ref href=\"/us/usc/t42/s1769f/b\">section 1769f(b) of title 42</ref>); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6e0b230c-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/j/2/E\"><num value=\"E\">(E)</num><content> conclude operations at such time as the Secretary determines appropriate.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id6e0b230d-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s350l/j/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Multiple recalls</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary may establish multiple or concurrent incident command operations or similar operations in the event of multiple recalls or foodborne illness outbreaks necessitating such action by the Department of Health and Human Services.</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id6e0b230e-6123-11e3-9d46-8388bf8dcc60\">(<ref href=\"/us/act/1938-06-25/ch675/s423\">June 25, 1938, ch. 675, § 423</ref>, as added <ref href=\"/us/pl/111/353/s206/a\">Pub.
