L. 113–54, title I, § 106(a), Nov. 27, 2013, 127 Stat. 598.)","seq_in_title":146,"parent_identifier":"/us/usc/t21/ch9/schV/ptA","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9","level":"chapter","num":"CHAPTER 9—","heading":"FEDERAL FOOD, DRUG, AND COSMETIC ACT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schV","level":"subchapter","num":"SUBCHAPTER V—","heading":"DRUGS AND DEVICES","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schV/ptA","level":"part","num":"Part A—","heading":"Drugs and Devices","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id41203f14-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a\"><num value=\"353a\">§ 353a.</num><heading> Pharmacy compounding</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id41203f15-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><chapeau>Sections 351(a)(2)(B), 352(f)(1), and 355 of this title shall not apply to a drug product if the drug product is compounded for an identified individual patient based on the receipt of a valid prescription order or a notation, approved by the prescribing practitioner, on the prescription order that a compounded product is necessary for the identified patient, if the drug product meets the requirements of this section, and if the compounding—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id41203f16-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/a/1\"><num value=\"1\">(1)</num><chapeau> is by—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id41203f17-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/a/1/A\"><num value=\"A\">(A)</num><content> a licensed pharmacist in a State licensed pharmacy or a Federal facility, or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id41203f18-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/a/1/B\"><num value=\"B\">(B)</num><content> a licensed physician,</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I17\" class=\"indent1 firstIndent0\">on the prescription order for such individual patient made by a licensed physician or other licensed practitioner authorized by State law to prescribe drugs; or</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id41203f19-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/a/2\"><num value=\"2\">(2)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id41203f1a-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/a/2/A\"><num value=\"A\">(A)</num><content> is by a licensed pharmacist or licensed physician in limited quantities before the receipt of a valid prescription order for such individual patient; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id41203f1b-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/a/2/B\"><num value=\"B\">(B)</num><chapeau> is based on a history of the licensed pharmacist or licensed physician receiving valid prescription orders for the compounding of the drug product, which orders have been generated solely within an established relationship between—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id41203f1c-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/a/2/B/i\"><num value=\"i\">(i)</num><content> the licensed pharmacist or licensed physician; and</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4122b01d-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/a/2/B/ii\"><num value=\"ii\">(ii)</num><subclause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4122b01e-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/a/2/B/ii/I\"><num value=\"I\">(I)</num><content> such individual patient for whom the prescription order will be provided; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4122b01f-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/a/2/B/ii/II\"><num value=\"II\">(II)</num><content> the physician or other licensed practitioner who will write such prescription order.</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id4122b020-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Compounded drug</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id4122b021-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Licensed pharmacist and licensed physician</heading><chapeau>A drug product may be compounded under subsection (a) if the licensed pharmacist or licensed physician—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4122b022-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/b/1/A\"><num value=\"A\">(A)</num><chapeau> compounds the drug product using bulk drug substances, as defined in regulations of the Secretary published at section 207.3(a)(4) of title 21 of the Code of Federal Regulations—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id4122b023-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/b/1/A/i\"><num value=\"i\">(i)</num><chapeau> that—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id4122b024-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/b/1/A/i/I\"><num value=\"I\">(I)</num><content> comply with the standards of an applicable United States Pharmacopoeia or National Formulary monograph, if a monograph exists, and the United States Pharmacopoeia chapter on pharmacy compounding;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id4122b025-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/b/1/A/i/II\"><num value=\"II\">(II)</num><content> if such a monograph does not exist, are drug substances that are components of drugs approved by the Secretary; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id4122b026-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/b/1/A/i/III\"><num value=\"III\">(III)</num><content> if such a monograph does not exist and the drug substance is not a component of a drug approved by the Secretary, that appear on a list developed by the Secretary through regulations issued by the Secretary under subsection (c);</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id4122b027-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/b/1/A/ii\"><num value=\"ii\">(ii)</num><content> that are manufactured by an establishment that is registered under <ref href=\"/us/usc/t21/s360\">section 360 of this title</ref> (including a foreign establishment that is registered under <ref href=\"/us/usc/t21/s360/i\">section 360(i) of this title</ref>); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id4122b028-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/b/1/A/iii\"><num value=\"iii\">(iii)</num><content> that are accompanied by valid certificates of analysis for each bulk drug substance;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4122b029-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/b/1/B\"><num value=\"B\">(B)</num><content> compounds the drug product using ingredients (other than bulk drug substances) that comply with the standards of an applicable United States Pharmacopoeia or National Formulary monograph, if a monograph exists, and the United States Pharmacopoeia chapter on pharmacy compounding;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4122b02a-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/b/1/C\"><num value=\"C\">(C)</num><content> does not compound a drug product that appears on a list published by the Secretary in the Federal Register of drug products that have been withdrawn or removed from the market because such drug products or components of such drug products have been found to be unsafe or not effective; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4122b02b-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/b/1/D\"><num value=\"D\">(D)</num><content> does not compound regularly or in inordinate amounts (as defined by the Secretary) any drug products that are essentially copies of a commercially available drug product.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id4122b02c-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Definition</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">For purposes of paragraph (1)(D), the term “essentially a copy of a commercially available drug product” does not include a drug product in which there is a change, made for an identified individual patient, which produces for that patient a significant difference, as determined by the prescribing practitioner, between the compounded drug and the comparable commercially available drug product.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id4122b02d-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Drug product</heading><chapeau>A drug product may be compounded under subsection (a) only if—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4122b02e-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/b/3/A\"><num value=\"A\">(A)</num><content> such drug product is not a drug product identified by the Secretary by regulation as a drug product that presents demonstrable difficulties for compounding that reasonably demonstrate an adverse effect on the safety or effectiveness of that drug product; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4122b02f-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/b/3/B\"><num value=\"B\">(B)</num><chapeau> such drug product is compounded in a State—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id4122b030-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/b/3/B/i\"><num value=\"i\">(i)</num><content> that has entered into a memorandum of understanding with the Secretary which addresses the distribution of inordinate amounts of compounded drug products interstate and provides for appropriate investigation by a State agency of complaints relating to compounded drug products distributed outside such State; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id4122b031-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/b/3/B/ii\"><num value=\"ii\">(ii)</num><content> that has not entered into the memorandum of understanding described in clause (i) and the licensed pharmacist, licensed pharmacy, or licensed physician distributes (or causes to be distributed) compounded drug products out of the State in which they are compounded in quantities that do not exceed 5 percent of the total prescription orders dispensed or distributed by such pharmacy or physician.</content>\n</clause>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I17\" class=\"indent1 firstIndent0\">The Secretary shall, in consultation with the National Association of Boards of Pharmacy, develop a standard memorandum of understanding for use by the States in complying with subparagraph (B)(i).</continuation>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id4122b032-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Regulations</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id4122b033-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall issue regulations to implement this section. Before issuing regulations to implement subsections (b)(1)(A)(i)(III), (b)(1)(C), or (b)(3)(A), the Secretary shall convene and consult an advisory committee on compounding unless the Secretary determines that the issuance of such regulations before consultation is necessary to protect the public health. The advisory committee shall include representatives from the National Association of Boards of Pharmacy, the United States Pharmacopoeia, pharmacy, physician, and consumer organizations, and other experts selected by the Secretary.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id4122b034-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Limiting compounding</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary, in consultation with the United States Pharmacopoeia Convention, Incorporated, shall promulgate regulations identifying drug substances that may be used in compounding under subsection (b)(1)(A)(i)(III) for which a monograph does not exist or which are not components of drug products approved by the Secretary. The Secretary shall include in the regulation the criteria for such substances, which shall include historical use, reports in peer reviewed medical literature, or other criteria the Secretary may identify.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id4122b035-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Application</heading><chapeau>This section shall not apply to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4122b036-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/d/1\"><num value=\"1\">(1)</num><content> compounded positron emission tomography drugs as defined in <ref href=\"/us/usc/t21/s321/ii\">section 321(ii) of this title</ref>; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4122b037-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/d/2\"><num value=\"2\">(2)</num><content> radiopharmaceuticals.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id4122b038-a3d3-11e9-95d4-f3ff9237185e\" identifier=\"/us/usc/t21/s353a/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> “Compounding” defined</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">As used in this section, the term “compounding” does not include mixing, reconstituting, or other such acts that are performed in accordance with directions contained in approved labeling provided by the product’s manufacturer and other manufacturer directions consistent with that labeling.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id4122b039-a3d3-11e9-95d4-f3ff9237185e\">(<ref href=\"/us/act/1938-06-25/ch675/s503A\">June 25, 1938, ch. 675, § 503A</ref>, as added <ref href=\"/us/pl/105/115/tI/s127/a\">Pub.
