L. 110–85, title IX, § 913, Sept. 27, 2007, 121 Stat. 952.)","seq_in_title":156,"parent_identifier":"/us/usc/t21/ch9/schV/ptA","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9","level":"chapter","num":"CHAPTER 9—","heading":"FEDERAL FOOD, DRUG, AND COSMETIC ACT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schV","level":"subchapter","num":"SUBCHAPTER V—","heading":"DRUGS AND DEVICES","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schV/ptA","level":"part","num":"Part A—","heading":"Drugs and Devices","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" id=\"id1c663625-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s355e\"><num value=\"355e\">§ 355e.</num><heading> Pharmaceutical security</heading><subsection class=\"indent0\" id=\"id1c663626-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s355e/a\"><num value=\"a\">(a)</num><heading> In general</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall develop standards and identify and validate effective technologies for the purpose of securing the drug supply chain against counterfeit, diverted, subpotent, substandard, adulterated, misbranded, or expired drugs.</p>\n</content>\n</subsection>\n<subsection class=\"indent0\" id=\"id1c663627-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s355e/b\"><num value=\"b\">(b)</num><heading> Standards development</heading><paragraph class=\"indent1\" id=\"id1c663628-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s355e/b/1\"><num value=\"1\">(1)</num><heading> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall, in consultation with the agencies specified in paragraph (4), manufacturers, distributors, pharmacies, and other supply chain stakeholders, prioritize and develop standards for the identification, validation, authentication, and tracking and tracing of prescription drugs.</p>\n</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1c663629-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s355e/b/2\"><num value=\"2\">(2)</num><heading> Standardized numeral identifier</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Not later than 30 months after <date date=\"2007-09-27\">September 27, 2007</date>, the Secretary shall develop a standardized numerical identifier (which, to the extent practicable, shall be harmonized with international consensus standards for such an identifier) to be applied to a prescription drug at the point of manufacturing and repackaging (in which case the numerical identifier shall be linked to the numerical identifier applied at the point of manufacturing) at the package or pallet level, sufficient to facilitate the identification, validation, authentication, and tracking and tracing of the prescription drug.</p>\n</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1c665d3a-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s355e/b/3\"><num value=\"3\">(3)</num><heading> Promising technologies</heading>\n<chapeau style=\"-uslm-lc:I12\" class=\"blockIndent1\">The standards developed under this subsection shall address promising technologies, which may include—</chapeau><subparagraph class=\"indent2\" id=\"id1c665d3b-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s355e/b/3/A\"><num value=\"A\">(A)</num><content> radio frequency identification technology;</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1c665d3c-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s355e/b/3/B\"><num value=\"B\">(B)</num><content> nanotechnology;</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1c665d3d-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s355e/b/3/C\"><num value=\"C\">(C)</num><content> encryption technologies; and</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1c665d3e-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s355e/b/3/D\"><num value=\"D\">(D)</num><content> other track-and-trace or authentication technologies.</content>\n</subparagraph>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1c665d3f-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s355e/b/4\"><num value=\"4\">(4)</num><heading> Interagency collaboration</heading>\n<chapeau style=\"-uslm-lc:I12\" class=\"blockIndent1\">In carrying out this subsection, the Secretary shall consult with Federal health and security agencies, including—</chapeau><subparagraph class=\"indent2\" id=\"id1c665d40-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s355e/b/4/A\"><num value=\"A\">(A)</num><content> the Department of Justice;</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1c665d41-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s355e/b/4/B\"><num value=\"B\">(B)</num><content> the Department of Homeland Security;</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1c668452-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s355e/b/4/C\"><num value=\"C\">(C)</num><content> the Department of Commerce; and</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1c668453-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s355e/b/4/D\"><num value=\"D\">(D)</num><content> other appropriate Federal and State agencies.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection class=\"indent0\" id=\"id1c668454-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s355e/c\"><num value=\"c\">(c)</num><heading> Inspection and enforcement</heading><paragraph class=\"indent1\" id=\"id1c668455-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s355e/c/1\"><num value=\"1\">(1)</num><heading> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall expand and enhance the resources and facilities of agency components of the Food and Drug Administration involved with regulatory and criminal enforcement of this chapter to secure the drug supply chain against counterfeit, diverted, subpotent, substandard, adulterated, misbranded, or expired drugs including biological products and active pharmaceutical ingredients from domestic and foreign sources.</p>\n</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1c668456-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s355e/c/2\"><num value=\"2\">(2)</num><heading> Activities</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall undertake enhanced and joint enforcement activities with other Federal and State agencies, and establish regional capacities for the validation of prescription drugs and the inspection of the prescription drug supply chain.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection class=\"indent0\" id=\"id1c668457-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s355e/d\"><num value=\"d\">(d)</num><heading> Definition</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In this section, the term “prescription drug” means a drug subject to <ref href=\"/us/usc/t21/s353/b/1\">section 353(b)(1) of this title</ref>.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id1c668458-f63b-11e2-8470-abc29ba29c4d\">\n(<ref href=\"/us/act/1938-06-25/ch675/s505D\">June 25, 1938, ch. 675, § 505D</ref>, as added <ref href=\"/us/pl/110/85/s913\">Pub.
