L. 107–281, § 4, Nov. 6, 2002, 116 Stat. 1993.)","seq_in_title":170,"parent_identifier":"/us/usc/t21/ch9/schV/ptB","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9","level":"chapter","num":"CHAPTER 9—","heading":"FEDERAL FOOD, DRUG, AND COSMETIC ACT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schV","level":"subchapter","num":"SUBCHAPTER V—","heading":"DRUGS AND DEVICES","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schV/ptB","level":"part","num":"Part B—","heading":"Drugs for Rare Diseases or Conditions","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id6ea826be-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s360cc\"><num value=\"360cc\">§ 360cc.</num><heading> Protection for drugs for rare diseases or conditions</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id6ea826bf-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s360cc/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Exclusive approval, certification, or license</heading><chapeau>Except as provided in subsection (b) of this section, if the Secretary—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ea826c0-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s360cc/a/1\"><num value=\"1\">(1)</num><content> approves an application filed pursuant to <ref href=\"/us/usc/t21/s355\">section 355 of this title</ref>, or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ea826c1-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s360cc/a/2\"><num value=\"2\">(2)</num><content> issues a license under <ref href=\"/us/usc/t42/s262\">section 262 of title 42</ref></content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">for a drug designated under <ref href=\"/us/usc/t21/s360bb\">section 360bb of this title</ref> for a rare disease or condition, the Secretary may not approve another application under <ref href=\"/us/usc/t21/s355\">section 355 of this title</ref> or issue another license under <ref href=\"/us/usc/t42/s262\">section 262 of title 42</ref> for such drug for such disease or condition for a person who is not the holder of such approved application or of such license until the expiration of seven years from the date of the approval of the approved application or the issuance of the license. <ref href=\"/us/usc/t21/s355/c/2\">Section 355(c)(2) of this title</ref> does not apply to the refusal to approve an application under the preceding sentence.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id6ea826c2-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s360cc/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Exceptions</heading><chapeau>If an application filed pursuant to <ref href=\"/us/usc/t21/s355\">section 355 of this title</ref> is approved for a drug designated under <ref href=\"/us/usc/t21/s360bb\">section 360bb of this title</ref> for a rare disease or condition or if a license is issued under <ref href=\"/us/usc/t42/s262\">section 262 of title 42</ref> for such a drug, the Secretary may, during the seven-year period beginning on the date of the application approval or of the issuance of the license, approve another application under <ref href=\"/us/usc/t21/s355\">section 355 of this title</ref> or issue a license under <ref href=\"/us/usc/t42/s262\">section 262 of title 42</ref>, for such drug for such disease or condition for a person who is not the holder of such approved application or of such license if—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ea826c3-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s360cc/b/1\"><num value=\"1\">(1)</num><content> the Secretary finds, after providing the holder notice and opportunity for the submission of views, that in such period the holder of the approved application or of the license cannot assure the availability of sufficient quantities of the drug to meet the needs of persons with the disease or condition for which the drug was designated; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ea826c4-6123-11e3-9d46-8388bf8dcc60\" identifier=\"/us/usc/t21/s360cc/b/2\"><num value=\"2\">(2)</num><content> such holder provides the Secretary in writing the consent of such holder for the approval of other applications or the issuance of other licenses before the expiration of such seven-year period.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id6ea826c5-6123-11e3-9d46-8388bf8dcc60\">(<ref href=\"/us/act/1938-06-25/ch675/s527\">June 25, 1938, ch. 675, § 527</ref>, as added <ref href=\"/us/pl/97/414/s2/a\">Pub.
