<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id2813a7f6-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d"><num value="360d">§ 360d.</num><heading> Performance standards</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2813a7f7-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/a"><num value="a" class="bold">(a)</num><heading class="bold"> Reasonable assurance of safe and effective performance; periodic evaluation</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id2813a7f8-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/a/1"><num value="1">(1)</num><content> The special controls required by <ref href="/us/usc/t21/s360c/a/1/B">section 360c(a)(1)(B) of this title</ref> shall include performance standards for a class II device if the Secretary determines that a performance standard is necessary to provide reasonable assurance of the safety and effectiveness of the device. A class III device may also be considered a class II device for purposes of establishing a standard for the device under subsection (b) if the device has been reclassified as a class II device under an administrative order under <ref href="/us/usc/t21/s360c/e">section 360c(e) of this title</ref> (or a regulation promulgated under such section prior to <date date="2012-07-09">July 9, 2012</date>) but such order (or regulation) provides that the reclassification is not to take effect until the effective date of such a standard for the device.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id2813cf09-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/a/2"><num value="2">(2)</num><chapeau> A performance standard established under subsection (b) for a device—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id2813cf0a-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/a/2/A"><num value="A">(A)</num><content> shall include provisions to provide reasonable assurance of its safe and effective performance;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id2813cf0b-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/a/2/B"><num value="B">(B)</num><chapeau> shall, where necessary to provide reasonable assurance of its safe and effective performance, include—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id2813cf0c-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/a/2/B/i"><num value="i">(i)</num><content> provisions respecting the construction, components, ingredients, and properties of the device and its compatibility with power systems and connections to such systems,</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id2813cf0d-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/a/2/B/ii"><num value="ii">(ii)</num><content> provisions for the testing (on a sample basis or, if necessary, on an individual basis) of the device or, if it is determined that no other more practicable means are available to the Secretary to assure the conformity of the device to the standard, provisions for the testing (on a sample basis or, if necessary, on an individual basis) by the Secretary or by another person at the direction of the Secretary,</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id2813cf0e-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/a/2/B/iii"><num value="iii">(iii)</num><content> provisions for the measurement of the performance characteristics of the device,</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id2813cf0f-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/a/2/B/iv"><num value="iv">(iv)</num><content> provisions requiring that the results of each or of certain of the tests of the device required to be made under clause (ii) show that the device is in conformity with the portions of the standard for which the test or tests were required, and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id2813cf10-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/a/2/B/v"><num value="v">(v)</num><content> a provision requiring that the sale and distribution of the device be restricted but only to the extent that the sale and distribution of a device may be restricted under a regulation under <ref href="/us/usc/t21/s360j/e">section 360j(e) of this title</ref>; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id2813f621-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/a/2/C"><num value="C">(C)</num><content> shall, where appropriate, require the use and prescribe the form and content of labeling for the proper installation, maintenance, operation, and use of the device.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id2813f622-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/a/3"><num value="3">(3)</num><content> The Secretary shall provide for periodic evaluation of performance standards established under subsection (b) to determine if such standards should be changed to reflect new medical, scientific, or other technological data.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id2813f623-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/a/4"><num value="4">(4)</num><chapeau> In carrying out his duties under this subsection and subsection (b), the Secretary shall, to the maximum extent practicable—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id2813f624-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/a/4/A"><num value="A">(A)</num><content> use personnel, facilities, and other technical support available in other Federal agencies,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id2813f625-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/a/4/B"><num value="B">(B)</num><content> consult with other Federal agencies concerned with standard-setting and other nationally or internationally recognized standard-setting entities, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id2813f626-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/a/4/C"><num value="C">(C)</num><content> invite appropriate participation, through joint or other conferences, workshops, or other means, by informed persons representative of scientific, professional, industry, or consumer organizations who in his judgment can make a significant contribution.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2813f627-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b"><num value="b" class="bold">(b)</num><heading class="bold"> Establishment of a standard</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id2813f628-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/1"><num value="1">(1)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id2813f629-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/1/A"><num value="A">(A)</num><content> The Secretary shall publish in the Federal Register a notice of proposed rulemaking for the establishment, amendment, or revocation of any performance standard for a device.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id2813f62a-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/1/B"><num value="B">(B)</num><chapeau> A notice of proposed rulemaking for the establishment or amendment of a performance standard for a device shall—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="id2813f62b-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/1/B/i"><num value="i">(i)</num><content> set forth a finding with supporting justification that the performance standard is appropriate and necessary to provide reasonable assurance of the safety and effectiveness of the device,</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id2813f62c-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/1/B/ii"><num value="ii">(ii)</num><content> set forth proposed findings with respect to the risk of illness or injury that the performance standard is intended to reduce or eliminate,</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id28141d3d-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/1/B/iii"><num value="iii">(iii)</num><content> invite interested persons to submit to the Secretary, within 30 days of the publication of the notice, requests for changes in the classification of the device pursuant to <ref href="/us/usc/t21/s360c/e">section 360c(e) of this title</ref> based on new information relevant to the classification, and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id28141d3e-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/1/B/iv"><num value="iv">(iv)</num><content> invite interested persons to submit an existing performance standard for the device, including a draft or proposed performance standard, for consideration by the Secretary.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id28141d3f-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/1/C"><num value="C">(C)</num><content> A notice of proposed rulemaking for the revocation of a performance standard shall set forth a finding with supporting justification that the performance standard is no longer necessary to provide reasonable assurance of the safety and effectiveness of a device.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id28141d40-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/1/D"><num value="D">(D)</num><content> The Secretary shall provide for a comment period of not less than 60 days.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id28141d41-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/2"><num value="2">(2)</num><content> If, after publication of a notice in accordance with paragraph (1), the Secretary receives a request for a change in the classification of the device, the Secretary shall, within 60 days of the publication of the notice, after consultation with the appropriate panel under <ref href="/us/usc/t21/s360c">section 360c of this title</ref>, either deny the request or give notice of an intent to initiate such change under <ref href="/us/usc/t21/s360c/e">section 360c(e) of this title</ref>.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id28141d42-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/3"><num value="3">(3)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id28141d43-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/3/A"><num value="A">(A)</num><content> After the expiration of the period for comment on a notice of proposed rulemaking published under paragraph (1) respecting a performance standard and after consideration of such comments and any report from an advisory committee under paragraph (5), the Secretary shall (i) promulgate a regulation establishing a performance standard and publish in the Federal Register findings on the matters referred to in paragraph (1), or (ii) publish a notice terminating the proceeding for the development of the standard together with the reasons for such termination. If a notice of termination is published, the Secretary shall (unless such notice is issued because the device is a banned device under <ref href="/us/usc/t21/s360f">section 360f of this title</ref>) initiate a proceeding under <ref href="/us/usc/t21/s360c/e">section 360c(e) of this title</ref> to reclassify the device subject to the proceeding terminated by such notice.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id28141d44-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/3/B"><num value="B">(B)</num><content> A regulation establishing a performance standard shall set forth the date or dates upon which the standard shall take effect, but no such regulation may take effect before one year after the date of its publication unless (i) the Secretary determines that an earlier effective date is necessary for the protection of the public health and safety, or (ii) such standard has been established for a device which, effective upon the effective date of the standard, has been reclassified from class III to class II. Such date or dates shall be established so as to minimize, consistent with the public health and safety, economic loss to, and disruption or dislocation of, domestic and international trade.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id28141d45-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/4"><num value="4">(4)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id28141d46-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/4/A"><num value="A">(A)</num><content> The Secretary, upon his own initiative or upon petition of an interested person may by regulation, promulgated in accordance with the requirements of paragraphs (1), (2), and (3)(B) of this subsection, amend or revoke a performance standard.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id28144457-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/4/B"><num value="B">(B)</num><content> The Secretary may declare a proposed amendment of a performance standard to be effective on and after its publication in the Federal Register and until the effective date of any final action taken on such amendment if he determines that making it so effective is in the public interest. A proposed amendment of a performance standard made so effective under the preceding sentence may not prohibit, during the period in which it is so effective, the introduction or delivery for introduction into interstate commerce of a device which conforms to such standard without the change or changes provided by such proposed amendment.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id28144458-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/5"><num value="5">(5)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id28144459-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/5/A"><num value="A">(A)</num><chapeau> The Secretary—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="id2814445a-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/5/A/i"><num value="i">(i)</num><content> may on his own initiative refer a proposed regulation for the establishment, amendment, or revocation of a performance standard, or</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id2814445b-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/5/A/ii"><num value="ii">(ii)</num><content> shall, upon the request of an interested person which demonstrates good cause for referral and which is made before the expiration of the period for submission of comments on such proposed regulation refer such proposed regulation,</content>
</clause>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">to an advisory committee of experts, established pursuant to subparagraph (B), for a report and recommendation with respect to any matter involved in the proposed regulation which requires the exercise of scientific judgment. If a proposed regulation is referred under this subparagraph to an advisory committee, the Secretary shall provide the advisory committee with the data and information on which such proposed regulation is based. The advisory committee shall, within sixty days of the referral of a proposed regulation and after independent study of the data and information furnished to it by the Secretary and other data and information before it, submit to the Secretary a report and recommendation respecting such regulation, together with all underlying data and information and a statement of the reason or basis for the recommendation. A copy of such report and recommendation shall be made public by the Secretary.</continuation>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id2814445c-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/b/5/B"><num value="B">(B)</num><content> The Secretary shall establish advisory committees (which may not be panels under <ref href="/us/usc/t21/s360c">section 360c of this title</ref>) to receive referrals under subparagraph (A). The Secretary shall appoint as members of any such advisory committee persons qualified in the subject matter to be referred to the committee and of appropriately diversified professional background, except that the Secretary may not appoint to such a committee any individual who is in the regular full-time employ of the United States and engaged in the administration of this chapter. Each such committee shall include as nonvoting members a representative of consumer interests and a representative of interests of the device manufacturing industry. Members of an advisory committee who are not officers or employees of the United States, while attending conferences or meetings of their committee or otherwise serving at the request of the Secretary, shall be entitled to receive compensation at rates to be fixed by the Secretary, which rates may not exceed the daily equivalent of the rate in effect for grade GS–18 of the General Schedule, for each day (including traveltime) they are so engaged; and while so serving away from their homes or regular places of business each member may be allowed travel expenses, including per diem in lieu of subsistence, as authorized by <ref href="/us/usc/t5/s5703">section 5703 of title 5</ref> for persons in the Government service employed intermittently. The Secretary shall designate one of the members of each advisory committee to serve as chairman thereof. The Secretary shall furnish each advisory committee with clerical and other assistance, and shall by regulation prescribe the procedures to be followed by each such committee in acting on referrals made under subparagraph (A).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id28146b6d-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/c"><num value="c" class="bold">(c)</num><heading class="bold"> Recognition of standard</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id28146b6e-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/c/1"><num value="1">(1)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id28146b6f-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/c/1/A"><num value="A">(A)</num><content> In addition to establishing a performance standard under this section, the Secretary shall, by publication in the Federal Register (or, with respect to a susceptibility test interpretive criteria standard under <ref href="/us/usc/t21/s360a–2">section 360a–2 of this title</ref>, by posting on the Interpretive Criteria Website in accordance with such section), recognize all or part of an appropriate standard established by a nationally or internationally recognized standard development organization for which a person may submit a declaration of conformity in order to meet a premarket submission requirement or other requirement under this chapter to which such standard is applicable.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id28146b70-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/c/1/B"><num value="B">(B)</num><content> If a person elects to use a standard recognized by the Secretary under subparagraph (A) to meet the requirements described in such subparagraph, the person shall provide a declaration of conformity to the Secretary that certifies that the device is in conformity with such standard. A person may elect to use data, or information, other than data required by a standard recognized under subparagraph (A) to meet any requirement regarding devices under this chapter.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id28146b71-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/c/1/C"><num value="C">(C)</num><clause style="-uslm-lc:I11" class="indent0" id="id28146b72-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/c/1/C/i"><num value="i">(i)</num><content> Any person may submit a request for recognition under subparagraph (A) of all or part of an appropriate standard established by a nationally or internationally recognized standard organization.<ref class="footnoteRef" idref="fn002058">1</ref><note type="footnote" id="fn002058"><num>1</num> So in original. Probably should be “standard development organization.”</note></content>
</clause>
<clause style="-uslm-lc:I11" class="indent0" id="id28146b73-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/c/1/C/ii"><num value="ii">(ii)</num><chapeau> Not later than 60 calendar days after the Secretary receives such a request, the Secretary shall—</chapeau><subclause style="-uslm-lc:I12" class="indent1" id="id28146b74-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/c/1/C/ii/I"><num value="I">(I)</num><content> make a determination to recognize all, part, or none of the standard that is the subject of the request; and</content>
</subclause>
<subclause style="-uslm-lc:I12" class="indent1" id="id28146b75-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/c/1/C/ii/II"><num value="II">(II)</num><content> issue to the person who submitted such request a response in writing that states the Secretary’s rationale for that determination, including the scientific, technical, regulatory, or other basis for such determination.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I11" class="indent0" id="id28146b76-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/c/1/C/iii"><num value="iii">(iii)</num><content> The Secretary shall make a response issued under clause (ii)(II) publicly available, in such a manner as the Secretary determines appropriate.</content>
</clause>
<clause style="-uslm-lc:I11" class="indent0" id="id28146b77-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/c/1/C/iv"><num value="iv">(iv)</num><content> The Secretary shall take such actions as may be necessary to implement all or part of a standard recognized under clause (ii)(I), in accordance with subparagraph (A).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id28146b78-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/c/1/D"><num value="D">(D)</num><content> The Secretary shall make publicly available, in such manner as the Secretary determines appropriate, the rationale for recognition under subparagraph (A) of all, part, or none of a standard, including the scientific, technical, regulatory, or other basis for the decision regarding such recognition.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id28146b79-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/c/2"><num value="2">(2)</num><content> The Secretary may withdraw such recognition of a standard through publication of a notice in the Federal Register if the Secretary determines that the standard is no longer appropriate for meeting a requirement regarding devices under this chapter.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id28146b7a-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/c/3"><num value="3">(3)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="id28146b7b-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/c/3/A"><num value="A">(A)</num><chapeau> Subject to subparagraph (B), the Secretary shall accept a declaration of conformity that a device is in conformity with a standard recognized under paragraph (1) unless the Secretary finds—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="id28146b7c-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/c/3/A/i"><num value="i">(i)</num><content> that the data or information submitted to support such declaration does not demonstrate that the device is in conformity with the standard identified in the declaration of conformity; or</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="id28146b7d-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/c/3/A/ii"><num value="ii">(ii)</num><content> that the standard identified in the declaration of conformity is not applicable to the particular device under review.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id28146b7e-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/c/3/B"><num value="B">(B)</num><content> The Secretary may request, at any time, the data or information relied on by the person to make a declaration of conformity with respect to a standard recognized under paragraph (1).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="id2814928f-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/c/3/C"><num value="C">(C)</num><content> A person making a declaration of conformity with respect to a standard recognized under paragraph (1) shall maintain the data and information demonstrating conformity of the device to the standard for a period of two years after the date of the classification or approval of the device by the Secretary or a period equal to the expected design life of the device, whichever is longer.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id28149290-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/c/4"><num value="4">(4)</num><content> The Secretary shall provide to all employees of the Food and Drug Administration who review premarket submissions for devices periodic training on the concept and use of recognized standards for purposes of meeting a premarket submission requirement or other applicable requirement under this chapter, including standards relevant to an employee’s area of device review.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id28149291-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d"><num value="d" class="bold">(d)</num><heading class="bold"> Pilot accreditation scheme for conformity assessment</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id28149292-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau>The Secretary shall establish a pilot program under which—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id28149293-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d/1/A"><num value="A">(A)</num><content> testing laboratories may be accredited, by accreditation bodies meeting criteria specified by the Secretary, to assess the conformance of a device with certain standards recognized under this section; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id28149294-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d/1/B"><num value="B">(B)</num><content> subject to paragraph (2), determinations by testing laboratories so accredited that a device conforms with such standard or standards shall be accepted by the Secretary for purposes of demonstrating such conformity under this section unless the Secretary finds that a particular such determination shall not be so accepted.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id28149295-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Secretarial review of accredited laboratory determinations</heading><chapeau>The Secretary may—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id28149296-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d/2/A"><num value="A">(A)</num><content> review determinations by testing laboratories accredited pursuant to this subsection, including by conducting periodic audits of such determinations or processes of accredited bodies or testing laboratories and, following such review, taking additional measures under this chapter, such as suspension or withdrawal of accreditation of such testing laboratory under paragraph (1)(A) or requesting additional information with respect to such device, as the Secretary determines appropriate; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id28149297-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d/2/B"><num value="B">(B)</num><content> if the Secretary becomes aware of information materially bearing on safety or effectiveness of a device assessed for conformity by a testing laboratory so accredited, take such additional measures under this chapter as the Secretary determines appropriate, such as suspension or withdrawal of accreditation of such testing laboratory under paragraph (1)(A), or requesting additional information with regard to such device.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id28149298-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Implementation and reporting</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id28149299-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Public meeting</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall publish in the Federal Register a notice of a public meeting to be held no later than <date date="2018-09-30">September 30, 2018</date>, to discuss and obtain input and recommendations from stakeholders regarding the goals and scope of, and a suitable framework and procedures and requirements for, the pilot program under this subsection.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2814929a-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Pilot program guidance</heading><chapeau>The Secretary shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id2814929b-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d/3/B/i"><num value="i">(i)</num><content> not later than <date date="2019-09-30">September 30, 2019</date>, issue draft guidance regarding the goals and implementation of the pilot program under this subsection; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2814929c-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d/3/B/ii"><num value="ii">(ii)</num><content> not later than <date date="2021-09-30">September 30, 2021</date>, issue final guidance with respect to the implementation of such program.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2814929d-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Pilot program initiation</heading><content><p style="-uslm-lc:I13" class="indent2">Not later than <date date="2020-09-30">September 30, 2020</date>, the Secretary shall initiate the pilot program under this subsection.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2814929e-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d/3/D"><num value="D" class="bold">(D)</num><heading class="bold"> Report</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall make available on the internet website of the Food and Drug Administration an annual report on the progress of the pilot program under this subsection.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2814929f-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> Sunset</heading><chapeau>As of <date date="2022-10-01">October 1, 2022</date>—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id2814b9b0-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d/4/A"><num value="A">(A)</num><content> the authority for accreditation bodies to accredit testing laboratories pursuant to paragraph (1)(A) shall cease to have force or effect;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2814b9b1-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d/4/B"><num value="B">(B)</num><chapeau> the Secretary—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id2814b9b2-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d/4/B/i"><num value="i">(i)</num><content> may not accept a determination pursuant to paragraph (1)(B) made by a testing laboratory after such date; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2814b9b3-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d/4/B/ii"><num value="ii">(ii)</num><content> may accept such a determination made prior to such date;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2814b9b4-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d/4/C"><num value="C">(C)</num><content> except for purposes of accepting a determination described in subparagraph (B)(ii), the Secretary shall not continue to recognize the accreditation of testing laboratories accredited under paragraph (1)(A); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2814b9b5-93e5-11e7-9024-a70e43310041" identifier="/us/usc/t21/s360d/d/4/D"><num value="D">(D)</num><content> the Secretary may take actions in accordance with paragraph (2) with respect to the determinations made prior to such date and recognition of the accreditation of testing laboratories pursuant to determinations made prior to such date.</content>

<p style="-uslm-lc:I21" class="indent0">“(B) If the Secretary issues under subparagraph (A)(ii) a notice of termination of a proceeding to establish a performance standard for a device, he shall (unless such notice is issued because the device is a banned device under <ref href="/us/usc/t21/s360f">section 360f of this title</ref>) initiate a proceeding under <ref href="/us/usc/t21/s360c/e">section 360c(e) of this title</ref> to reclassify the device subject to the proceeding terminated by such notice.</p>
<p style="-uslm-lc:I21" class="indent0">“(2) A notice of proposed rulemaking for the establishment of a performance standard for a device published under paragraph (1)(A)(i) shall set forth proposed findings with respect to the degree of the risk of illness or injury designed to be eliminated or reduced by the proposed standard and the benefit to the public from the device.”</p>
