FF, title III, § 3306(a), Dec. 29, 2022, 136 Stat. 5834.)","seq_in_title":198,"parent_identifier":"/us/usc/t21/ch9/schV/ptA","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9","level":"chapter","num":"CHAPTER 9—","heading":"FEDERAL FOOD, DRUG, AND COSMETIC ACT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schV","level":"subchapter","num":"SUBCHAPTER V—","heading":"DRUGS AND DEVICES","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schV/ptA","level":"part","num":"Part A—","heading":"Drugs and Devices","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idc9615d75-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s360f\"><num value=\"360f\">§ 360f.</num><heading> Banned devices</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idc9615d76-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s360f/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> General rule</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Whenever the Secretary finds, on the basis of all available data and information, that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idc9615d77-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s360f/a/1\"><num value=\"1\">(1)</num><content> a device intended for human use presents substantial deception or an unreasonable and substantial risk of illness or injury for one or more intended uses; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idc9615d78-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s360f/a/2\"><num value=\"2\">(2)</num><content> in the case of substantial deception or an unreasonable and substantial risk of illness or injury which the Secretary determined could be corrected or eliminated by labeling or change in labeling and with respect to which the Secretary provided written notice to the manufacturer specifying the deception or risk of illness or injury, the labeling or change in labeling to correct the deception or eliminate or reduce such risk, and the period within which such labeling or change in labeling was to be done, such labeling or change in labeling was not done within such period;</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">he may initiate a proceeding to promulgate a regulation to make such device a banned device or to make such intended use or uses a banned intended use or uses. A device that is banned for one or more intended uses is not a legally marketed device under <ref href=\"/us/usc/t21/s396\">section 396 of this title</ref> when intended for such use or uses.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idc9615d79-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s360f/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Special effective date</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may declare a proposed regulation under subsection (a) to be effective upon its publication in the Federal Register and until the effective date of any final action taken respecting such regulation if (1) he determines, on the basis of all available data and information, that the deception or risk of illness or injury associated with the use of the device which is subject to the regulation presents an unreasonable, direct, and substantial danger to the health of individuals, and (2) before the date of the publication of such regulation, the Secretary notifies the manufacturer of such device that such regulation is to be made so effective. If the Secretary makes a proposed regulation so effective, he shall, as expeditiously as possible, give interested persons prompt notice of his action under this subsection, provide reasonable opportunity for an informal hearing on the proposed regulation, and either affirm, modify, or revoke such proposed regulation.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idc9615d7a-f339-11ed-b7d6-eb7e2ad38908\">(<ref href=\"/us/act/1938-06-25/ch675/s516\">June 25, 1938, ch. 675, § 516</ref>, as added <ref href=\"/us/pl/94/295/s2\">Pub.
