L. 103–80, § 4(a)(2), Aug. 13, 1993, 107 Stat. 779.)","seq_in_title":197,"parent_identifier":"/us/usc/t21/ch9/schV/ptC","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9","level":"chapter","num":"CHAPTER 9—","heading":"FEDERAL FOOD, DRUG, AND COSMETIC ACT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schV","level":"subchapter","num":"SUBCHAPTER V—","heading":"DRUGS AND DEVICES","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schV/ptC","level":"part","num":"Part C—","heading":"Electronic Product Radiation Control","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" id=\"id1cb34502-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s360hh\"><num value=\"360hh\">§ 360hh.</num><heading> Definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"blockIndent0\">As used in this part—</chapeau><paragraph class=\"indent1\" id=\"id1cb34503-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s360hh/1\"><num value=\"1\">(1)</num><chapeau> the term “electronic product radiation” means—</chapeau><subparagraph class=\"indent2\" id=\"id1cb34504-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s360hh/1/A\"><num value=\"A\">(A)</num><content> any ionizing or non-ionizing electromagnetic or particulate radiation, or</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1cb34505-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s360hh/1/B\"><num value=\"B\">(B)</num><content> any sonic, infrasonic, or ultrasonic wave, which is emitted from an electronic product as the result of the operation of an electronic circuit in such product;</content>\n</subparagraph>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1cb34506-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s360hh/2\"><num value=\"2\">(2)</num><content> the term “electronic product” means (A) any manufactured or assembled product which, when in operation, (i) contains or acts as part of an electronic circuit and (ii) emits (or in the absence of effective shielding or other controls would emit) electronic product radiation, or (B) any manufactured or assembled article which is intended for use as a component, part, or accessory of a product described in clause (A) and which when in operation emits (or in the absence of effective shielding or other controls would emit) such radiation;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1cb36c17-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s360hh/3\"><num value=\"3\">(3)</num><content> the term “manufacturer” means any person engaged in the business of manufacturing, assembling, or importing of electronic products;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1cb36c18-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s360hh/4\"><num value=\"4\">(4)</num><content> the term “commerce” means (A) commerce between any place in any State and any place outside thereof; and (B) commerce wholly within the District of Columbia; and</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1cb36c19-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s360hh/5\"><num value=\"5\">(5)</num><content> the term “State” includes the District of Columbia, the Commonwealth of Puerto Rico, the Northern Mariana Islands, the Virgin Islands, Guam, and American Samoa.</content>\n</paragraph>\n<sourceCredit id=\"id1cb36c1a-f63b-11e2-8470-abc29ba29c4d\">\n(<ref href=\"/us/act/1938-06-25/ch675/s531\">June 25, 1938, ch. 675, § 531</ref>, formerly <ref href=\"/us/act/1944-07-01/ch373\">act July 1, 1944, ch. 373</ref>, title III, § 531, formerly § 355, as added <ref href=\"/us/pl/90/602/s2/3\">Pub.
