<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idec3144dc-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Priority review voucher</heading><content><p style="-uslm-lc:I12" class="indent1">The term “priority review voucher” means a voucher issued by the Secretary to the sponsor of a tropical disease product application that entitles the holder of such voucher to priority review of a single human drug application submitted under <ref href="/us/usc/t21/s355/b/1">section 355(b)(1) of this title</ref> or <ref href="/us/usc/t42/s262">section 262 of title 42</ref> after the date of approval of the tropical disease product application.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idec3144f1-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> Tropical disease product application</heading><chapeau>The term “tropical disease product application” means an application that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idec3144f2-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/a/4/A"><num value="A">(A)</num><chapeau> is a human drug application as defined in <ref href="/us/usc/t21/s379g/1">section 379g(1) of this title</ref>—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idec3144f3-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/a/4/A/i"><num value="i">(i)</num><content> for prevention or treatment of a tropical disease; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idec3144f4-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/a/4/A/ii"><num value="ii">(ii)</num><content> the Secretary deems eligible for priority review;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idec338de5-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/a/4/B"><num value="B">(B)</num><content> is approved after <date date="2007-09-27">September 27, 2007</date>, by the Secretary for use in the prevention, detection, or treatment of a tropical disease; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idec338de6-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/a/4/C"><num value="C">(C)</num><content> is for a human drug, no active ingredient (including any ester or salt of the active ingredient) of which has been approved in any other application under <ref href="/us/usc/t21/s355/b/1">section 355(b)(1) of this title</ref> or <ref href="/us/usc/t42/s262">section 262 of title 42</ref>.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idec338de7-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/b"><num value="b" class="bold">(b)</num><heading class="bold"> Priority review voucher</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idec338de8-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall award a priority review voucher to the sponsor of a tropical disease product application upon approval by the Secretary of such tropical disease product application.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idec338de9-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Transferability</heading><content><p style="-uslm-lc:I12" class="indent1">The sponsor of a tropical disease product that receives a priority review voucher under this section may transfer (including by sale) the entitlement to such voucher to a sponsor of a human drug for which an application under <ref href="/us/usc/t21/s355/b/1">section 355(b)(1) of this title</ref> or <ref href="/us/usc/t42/s262">section 262 of title 42</ref> will be submitted after the date of the approval of the tropical disease product application. There is no limit on the number of times a priority review voucher may be transferred before such voucher is used.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idec338dea-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Limitation</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idec338deb-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/b/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> No award for prior approved application</heading><content><p style="-uslm-lc:I13" class="indent2">A sponsor of a tropical disease product may not receive a priority review voucher under this section if the tropical disease product application was submitted to the Secretary prior to <date date="2007-09-27">September 27, 2007</date>.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idec338dec-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/b/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> One-year waiting period</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall issue a priority review voucher to the sponsor of a tropical disease product no earlier than the date that is 1 year after <date date="2007-09-27">September 27, 2007</date>.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idec338ded-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Notification</heading><content><p style="-uslm-lc:I12" class="indent1">The sponsor of a human drug application shall notify the Secretary not later than 90 days prior to submission of the human drug application that is the subject of a priority review voucher of an intent to submit the human drug application, including the date on which the sponsor intends to submit the application. Such notification shall be a legally binding commitment to pay for the user fee to be assessed in accordance with this section.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idec338dee-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/c"><num value="c" class="bold">(c)</num><heading class="bold"> Priority review user fee</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idec338def-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall establish a user fee program under which a sponsor of a human drug application that is the subject of a priority review voucher shall pay to the Secretary a fee determined under paragraph (2). Such fee shall be in addition to any fee required to be submitted by the sponsor under subchapter VII.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idec338df0-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Fee amount</heading><content><p style="-uslm-lc:I12" class="indent1">The amount of the priority review user fee shall be determined each fiscal year by the Secretary and based on the average cost incurred by the agency in the review of a human drug application subject to priority review in the previous fiscal year.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idec338df1-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Annual fee setting</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall establish, before the beginning of each fiscal year beginning after <date date="2007-09-30">September 30, 2007</date>, for that fiscal year, the amount of the priority review user fee.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idec338df2-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/c/4"><num value="4" class="bold">(4)</num><heading class="bold"> Payment</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idec338df3-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/c/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The priority review user fee required by this subsection shall be due upon the submission of a human drug application under <ref href="/us/usc/t21/s355/b/1">section 355(b)(1) of this title</ref> or <ref href="/us/usc/t42/s262">section 262 of title 42</ref> for which the priority review voucher is used.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idec338df4-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/c/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Complete application</heading><content><p style="-uslm-lc:I13" class="indent2">An application described under subparagraph (A) for which the sponsor requests the use of a priority review voucher shall be considered incomplete if the fee required by this subsection and all other applicable user fees are not paid in accordance with the Secretary’s procedures for paying such fees.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idec338df5-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/c/4/C"><num value="C" class="bold">(C)</num><heading class="bold"> No waivers, exemptions, reductions, or refunds</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may not grant a waiver, exemption, reduction, or refund of any fees due and payable under this section.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idec338df6-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/c/5"><num value="5" class="bold">(5)</num><heading class="bold"> Offsetting collections</heading><chapeau>Fees collected pursuant to this subsection for any fiscal year—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idec338df7-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/c/5/A"><num value="A">(A)</num><content> shall be deposited and credited as offsetting collections to the account providing appropriations to the Food and Drug Administration; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idec338df8-0c74-11e6-b5d4-9376778ac99d" identifier="/us/usc/t21/s360n/c/5/B"><num value="B">(B)</num><content> shall not be collected for any fiscal year except to the extent provided in advance in appropriation Acts.</content>
