L. 103–80, § 4(a)(2), Aug. 13, 1993, 107 Stat. 779.)","seq_in_title":227,"parent_identifier":"/us/usc/t21/ch9/schV/ptC","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9","level":"chapter","num":"CHAPTER 9—","heading":"FEDERAL FOOD, DRUG, AND COSMETIC ACT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schV","level":"subchapter","num":"SUBCHAPTER V—","heading":"DRUGS AND DEVICES","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schV/ptC","level":"part","num":"Part C—","heading":"Electronic Product Radiation Control","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id7d378fd0-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s360oo\"><num value=\"360oo\">§ 360oo.</num><heading> Prohibited acts</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7d37b6e1-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s360oo/a\"><num value=\"a\">(a)</num><chapeau> It shall be unlawful—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7d37b6e2-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s360oo/a/1\"><num value=\"1\">(1)</num><content> for any manufacturer to introduce, or to deliver for introduction, into commerce, or to import into the United States, any electronic product which does not comply with an applicable standard prescribed pursuant to <ref href=\"/us/usc/t21/s360kk\">section 360kk of this title</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7d37b6e3-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s360oo/a/2\"><num value=\"2\">(2)</num><content> for any person to fail to furnish any notification or other material or information required by section 360<i>ll</i> or 360nn of this title; or to fail to comply with the requirements of section 360<i>ll</i>(f) of this title;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7d37b6e4-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s360oo/a/3\"><num value=\"3\">(3)</num><content> for any person to fail or to refuse to establish or maintain records required by this part or to permit access by the Secretary or any of his duly authorized representatives to, or the copying of, such records, or to permit entry or inspection, as required by or pursuant to <ref href=\"/us/usc/t21/s360nn\">section 360nn of this title</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7d37b6e5-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s360oo/a/4\"><num value=\"4\">(4)</num><content> for any person to fail or to refuse to make any report required pursuant to <ref href=\"/us/usc/t21/s360nn/b\">section 360nn(b) of this title</ref> or to furnish or preserve any information required pursuant to <ref href=\"/us/usc/t21/s360nn/f\">section 360nn(f) of this title</ref>; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7d37b6e6-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s360oo/a/5\"><num value=\"5\">(5)</num><content> for any person (A) to fail to issue a certification as required by <ref href=\"/us/usc/t21/s360kk/h\">section 360kk(h) of this title</ref>, or (B) to issue such a certification when such certification is not based upon a test or testing program meeting the requirements of <ref href=\"/us/usc/t21/s360kk/h\">section 360kk(h) of this title</ref> or when the issuer, in the exercise of due care, would have reason to know that such certification is false or misleading in a material respect.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7d37b6e7-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s360oo/b\"><num value=\"b\">(b)</num><content> The Secretary may exempt any electronic product, or class thereof, from all or part of subsection (a), upon such conditions as he may find necessary to protect the public health or welfare, for the purpose of research, investigations, studies, demonstrations, or training, or for reasons of national security.</content>\n</subsection>\n<sourceCredit id=\"id7d37b6e8-81bc-11eb-b838-b6993269d559\">(<ref href=\"/us/act/1938-06-25/ch675/s538\">June 25, 1938, ch. 675, § 538</ref>, formerly <ref href=\"/us/act/1944-07-01/ch373/tIII/s538\">act July 1, 1944, ch. 373, title III, § 538</ref>, formerly § 360B, as added <ref href=\"/us/pl/90/602/s2/3\">Pub.
