L. 102–571, title I, § 107(12), Oct. 29, 1992, 106 Stat. 4499.)","seq_in_title":253,"parent_identifier":"/us/usc/t21/ch9/schVI","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9","level":"chapter","num":"CHAPTER 9—","heading":"FEDERAL FOOD, DRUG, AND COSMETIC ACT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schVI","level":"subchapter","num":"SUBCHAPTER VI—","heading":"COSMETICS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idae5e3068-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s362\"><num value=\"362\">§ 362.</num><heading> Misbranded cosmetics</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">A cosmetic shall be deemed to be misbranded—</chapeau><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idae5e3069-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s362/a\"><num value=\"a\">(a)</num><content> If its labeling is false or misleading in any particular.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idae5e306a-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s362/b\"><num value=\"b\">(b)</num><content> If in package form unless it bears a label containing (1) the name and place of business of the manufacturer, packer, or distributor; and (2) an accurate statement of the quantity of the contents in terms of weight, measure, or numerical count: <i>Provided</i>, That under clause (2) of this paragraph reasonable variations shall be permitted, and exemptions as to small packages shall be established, by regulations prescribed by the Secretary.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idae5e306b-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s362/c\"><num value=\"c\">(c)</num><content> If any word, statement, or other information required by or under authority of this chapter to appear on the label or labeling is not prominently placed thereon with such conspicuousness (as compared with other words, statements, designs, or devices, in the labeling) and in such terms as to render it likely to be read and understood by the ordinary individual under customary conditions of purchase and use.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idae5e306c-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s362/d\"><num value=\"d\">(d)</num><content> If its container is so made, formed, or filled as to be misleading.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idae5e306d-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s362/e\"><num value=\"e\">(e)</num><content> If it is a color additive, unless its packaging and labeling are in conformity with such packaging and labeling requirements, applicable to such color additive, as may be contained in regulations issued under <ref href=\"/us/usc/t21/s379e\">section 379e of this title</ref>. This paragraph shall not apply to packages of color additives which, with respect to their use for cosmetics, are marketed and intended for use only in or on hair dyes (as defined in the last sentence of <ref href=\"/us/usc/t21/s361/a\">section 361(a) of this title</ref>).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idae5e306e-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s362/f\"><num value=\"f\">(f)</num><content> If its packaging or labeling is in violation of an applicable regulation issued pursuant to section 1472 or 1473 of title 15.</content>\n</subsection>\n<sourceCredit id=\"idae5e306f-ec38-11e5-9fc5-818d616f3d7f\">(<ref href=\"/us/act/1938-06-25/ch675\">June 25, 1938, ch. 675</ref>, § 602, <ref href=\"/us/stat/52/1054\">52 Stat. 1054</ref>; <ref href=\"/us/pl/86/618/tI\">Pub.
