class=\"indent0\">In this subchapter:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idf49e6711-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Adverse event</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “adverse event” means any health-related event associated with the use of a cosmetic product that is adverse.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idf49e6712-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Cosmetic product</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “cosmetic product” means a preparation of cosmetic ingredients with a qualitatively and quantitatively set composition for use in a finished product.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idf49e6713-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Facility</heading><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf49e6714-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/3/A\"><num value=\"A\">(A)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>The term “facility” includes any establishment (including an establishment of an importer) that manufactures or processes cosmetic products distributed in the United States.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf49e6715-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/3/B\"><num value=\"B\">(B)</num><chapeau> Such term does not include any of the following:</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf49e6716-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/3/B/i\"><num value=\"i\">(i)</num><content> Beauty shops and salons, unless such establishment manufactures or processes cosmetic products at that location.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf49e6717-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/3/B/ii\"><num value=\"ii\">(ii)</num><content> Cosmetic product retailers, including individual sales representatives, direct sellers (as defined in <ref href=\"/us/usc/t26/s3508/b/2\">section 3508(b)(2) of title 26</ref>), retail distribution facilities, and pharmacies, unless such establishment manufactures or processes cosmetic products that are not sold directly to consumers at that location.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf49e6718-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/3/B/iii\"><num value=\"iii\">(iii)</num><content> Hospitals, physicians’ offices, and health care clinics.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf49e6719-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/3/B/iv\"><num value=\"iv\">(iv)</num><content> Public health agencies and other nonprofit entities that provide cosmetic products directly to the consumer.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf49e671a-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/3/B/v\"><num value=\"v\">(v)</num><content> Entities (such as hotels and airlines) that provide complimentary cosmetic products to customers incidental to other services.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf49e671b-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/3/B/vi\"><num value=\"vi\">(vi)</num><content> Trade shows and other venues where cosmetic product samples are provided free of charge.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf49e671c-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/3/B/vii\"><num value=\"vii\">(vii)</num><content> An establishment that manufactures or processes cosmetic products that are solely for use in research or evaluation, including for production testing and not offered for retail sale.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf49e671d-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/3/B/viii\"><num value=\"viii\">(viii)</num><chapeau> An establishment that solely performs one or more of the following with respect to cosmetic products:</chapeau><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf49e671e-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/3/B/viii/I\"><num value=\"I\">(I)</num><content> Labeling.</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf49e671f-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/3/B/viii/II\"><num value=\"II\">(II)</num><content> Relabeling.</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf49e6720-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/3/B/viii/III\"><num value=\"III\">(III)</num><content> Packaging.</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf49e6721-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/3/B/viii/IV\"><num value=\"IV\">(IV)</num><content> Repackaging.</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf49e6722-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/3/B/viii/V\"><num value=\"V\">(V)</num><content> Holding.</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf49e6723-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/3/B/viii/VI\"><num value=\"VI\">(VI)</num><content> Distributing.</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idf49e6724-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/3/C\"><num value=\"C\">(C)</num><heading> <inline class=\"small-caps\">Clarification</inline>.—</heading><content>For the purposes of subparagraph (B)(viii), the terms “packaging” and “repackaging” do not include filling a product container with a cosmetic product.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idf49e6725-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Responsible person</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “responsible person” means the manufacturer, packer, or distributor of a cosmetic product whose name appears on the label of such cosmetic product in accordance with <ref href=\"/us/usc/t21/s364e/a\">section 364e(a) of this title</ref> or <ref href=\"/us/usc/t15/s1453/a\">section 1453(a) of title 15</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idf49e6726-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Serious adverse event</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “serious adverse event” means an adverse event that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf49e6727-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/5/A\"><num value=\"A\">(A)</num><chapeau> results in—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf49e6728-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/5/A/i\"><num value=\"i\">(i)</num><content> death;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf49e6729-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/5/A/ii\"><num value=\"ii\">(ii)</num><content> a life-threatening experience;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf49e672a-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/5/A/iii\"><num value=\"iii\">(iii)</num><content> inpatient hospitalization;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf49e672b-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/5/A/iv\"><num value=\"iv\">(iv)</num><content> a persistent or significant disability or incapacity;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf49e672c-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/5/A/v\"><num value=\"v\">(v)</num><content> a congenital anomaly or birth defect;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf49e672d-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/5/A/vi\"><num value=\"vi\">(vi)</num><content> an infection; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idf49e672e-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/5/A/vii\"><num value=\"vii\">(vii)</num><content> significant disfigurement (including serious and persistent rashes, second- or third-degree burns, significant hair loss, or persistent or significant alteration of appearance), other than as intended, under conditions of use that are customary or usual; or</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idf49e672f-6371-11ee-b61f-b0ed6a65d7e9\" identifier=\"/us/usc/t21/s364/5/B\"><num value=\"B\">(B)</num><content> requires, based on reasonable medical judgment, a medical or surgical intervention to prevent an outcome described in subparagraph (A).</content>\n</subparagraph>\n</paragraph>\n<sourceCredit
