A responsible person for a coal-tar hair dye shall maintain records related to the safety of such product.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idc985128e-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s364d/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this section:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idc985128f-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s364d/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Adequate substantiation of safety</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “adequate substantiation of safety” means tests or studies, research, analyses, or other evidence or information that is considered, among experts qualified by scientific training and experience to evaluate the safety of cosmetic products and their ingredients, sufficient to support a reasonable certainty that a cosmetic product is safe.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idc9851290-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s364d/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Safe</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “safe” means that the cosmetic product, including any ingredient thereof, is not injurious to users under the conditions of use prescribed in the labeling thereof, or under such conditions of use as are customary or usual. The Secretary shall not consider a cosmetic ingredient or cosmetic product injurious to users solely because it can cause minor and transient reactions or minor and transient skin irritations in some users. L. 117–328</ref>, which enacted this section, to be construed to authorize the disclosure of information that is prohibited from disclosure under <ref href=\"/us/usc/t21/s331/j\">section 331(j) of this title</ref> or <ref href=\"/us/usc/t18/s1905\">section 1905 of title 18</ref> or that is subject to withholding under <ref href=\"/us/usc/t5/s552/b/4\">section 552(b)(4) of title 5</ref>, see <ref href=\"/us/pl/117/328/s3503/c/2\">section 3503(c)(2) of Pub. L. 117–328</ref>, set out as a note under <ref href=\"/us/usc/t21/s364\">section 364 of this title</ref>.</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"idc9851295-f339-11ed-b7d6-eb7e2ad38908\"><heading class=\"centered smallCaps\">Talc-Containing Cosmetics</heading><p><ref href=\"/us/pl/117/328/dFF/tIII/s3505\">Pub. L. 117–328, div.
