Notwithstanding subsection (a), nothing in this section shall be construed to prevent any State from prohibiting the use or limiting the amount of an ingredient in a cosmetic product, or from continuing in effect a requirement of any State that is in effect at the time of enactment of the Modernization of Cosmetics Regulation Act of 2022 for the reporting to the State of an ingredient in a cosmetic product.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idc98782d7-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s364j/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Savings</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Nothing in the amendments to this chapter made by the Modernization of Cosmetics Regulation Act of 2022, nor any standard, rule, requirement, regulation, or adverse event report shall be construed to modify, preempt, or displace any action for damages or the liability of any person under the law of any State, whether statutory or based in common law.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idc98782d8-f339-11ed-b7d6-eb7e2ad38908\" identifier=\"/us/usc/t21/s364j/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Rule of construction</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Nothing in this section shall be construed to amend, expand, or limit the provisions under <ref href=\"/us/usc/t21/s379s\">section 379s of this title</ref>.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idc98782d9-f339-11ed-b7d6-eb7e2ad38908\">(<ref href=\"/us/act/1938-06-25/ch675/s614\">June 25, 1938, ch. 675, § 614</ref>, as added <ref href=\"/us/pl/117/328/dFF/tIII/s3502\">Pub.
