A, title I, § 103(g), June 22, 2009, 123 Stat. 1837.)","seq_in_title":270,"parent_identifier":"/us/usc/t21/ch9/schVII/ptA","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9","level":"chapter","num":"CHAPTER 9—","heading":"FEDERAL FOOD, DRUG, AND COSMETIC ACT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schVII","level":"subchapter","num":"SUBCHAPTER VII—","heading":"GENERAL AUTHORITY","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schVII/ptA","level":"part","num":"Part A—","heading":"General Administrative Provisions","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idc6b56942-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372\"><num value=\"372\">§ 372.</num><heading> Examinations and investigations</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idc6b56943-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Authority to conduct</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idc6b56944-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/a/1\"><num value=\"1\">(1)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idc6b56945-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/a/1/A\"><num value=\"A\">(A)</num><content> The Secretary is authorized to conduct examinations and investigations for the purposes of this chapter through officers and employees of the Department or through any health, food, or drug officer or employee of any State, Territory, or political subdivision thereof, duly commissioned by the Secretary as an officer of the Department.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idc6b56946-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/a/1/B\"><num value=\"B\">(B)</num><clause style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idc6b56947-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/a/1/B/i\"><num value=\"i\">(i)</num><content> For a tobacco product, to the extent feasible, the Secretary shall contract with the States in accordance with this paragraph to carry out inspections of retailers within that State in connection with the enforcement of this chapter.</content>\n</clause>\n<clause style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idc6b56948-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/a/1/B/ii\"><num value=\"ii\">(ii)</num><content> The Secretary shall not enter into any contract under clause (i) with the government of any of the several States to exercise enforcement authority under this chapter on Indian country without the express written consent of the Indian tribe involved.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idc6b56949-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/a/2\"><num value=\"2\">(2)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idc6b5694a-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/a/2/A\"><num value=\"A\">(A)</num><content> In addition to the authority established in paragraph (1), the Secretary, pursuant to a memorandum of understanding between the Secretary and the head of another Federal department or agency, is authorized to conduct examinations and investigations for the purposes of this chapter through the officers and employees of such other department or agency, subject to subparagraph (B). Such a memorandum shall include provisions to ensure adequate training of such officers and employees to conduct the examinations and investigations. The memorandum of understanding shall contain provisions regarding reimbursement. Such provisions may, at the sole discretion of the head of the other department or agency, require reimbursement, in whole or in part, from the Secretary for the examinations or investigations performed under this section by the officers or employees of the other department or agency.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idc6b5694b-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/a/2/B\"><num value=\"B\">(B)</num><content> A memorandum of understanding under subparagraph (A) between the Secretary and another Federal department or agency is effective only in the case of examinations or inspections at facilities or other locations that are jointly regulated by the Secretary and such department or agency.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idc6b5694c-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/a/2/C\"><num value=\"C\">(C)</num><chapeau> For any fiscal year in which the Secretary and the head of another Federal department or agency carries out one or more examinations or inspections under a memorandum of understanding under subparagraph (A), the Secretary and the head of such department or agency shall with respect to their respective departments or agencies submit to the committees of jurisdiction (authorizing and appropriating) in the House of Representatives and the Senate a report that provides, for such year—</chapeau><clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idc6b5694d-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/a/2/C/i\"><num value=\"i\">(i)</num><content> the number of officers or employees that carried out one or more programs, projects, or activities under such memorandum;</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idc6b5694e-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/a/2/C/ii\"><num value=\"ii\">(ii)</num><content> the number of additional articles that were inspected or examined as a result of such memorandum; and</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idc6b5694f-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/a/2/C/iii\"><num value=\"iii\">(iii)</num><content> the number of additional examinations or investigations that were carried out pursuant to such memorandum.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idc6b56950-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/a/3\"><num value=\"3\">(3)</num><content> In the case of food packed in the Commonwealth of Puerto Rico or a Territory the Secretary shall attempt to make inspection of such food at the first point of entry within the United States when, in his opinion and with due regard to the enforcement of all the provisions of this chapter, the facilities at his disposal will permit of such inspection.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idc6b56951-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/a/4\"><num value=\"4\">(4)</num><content> For the purposes of this subsection, the term “United States” means the States and the District of Columbia.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idc6b56952-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Availability to owner of part of analysis samples</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Where a sample of a food, drug, or cosmetic is collected for analysis under this chapter the Secretary shall, upon request, provide a part of such official sample for examination or analysis by any person named on the label of the article, or the owner thereof, or his attorney or agent; except that the Secretary is authorized, by regulations, to make such reasonable exceptions from, and impose such reasonable terms and conditions relating to, the operation of this subsection as he finds necessary for the proper administration of the provisions of this chapter.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idc6b56953-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Records of other departments and agencies</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of enforcement of this chapter, records of any department or independent establishment in the executive branch of the Government shall be open to inspection by any official of the Department duly authorized by the Secretary to make such inspection.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idc6b56954-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Information on patents for drugs</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary is authorized and directed, upon request from the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office, to furnish full and complete information with respect to such questions relating to drugs as the Director may submit concerning any patent application. The Secretary is further authorized, upon receipt of any such request, to conduct or cause to be conducted, such research as may be required.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idc6b56955-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Powers of enforcement personnel</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Any officer or employee of the Department designated by the Secretary to conduct examinations, investigations, or inspections under this chapter relating to counterfeit drugs may, when so authorized by the Secretary—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idc6b56956-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/e/1\"><num value=\"1\">(1)</num><content> carry firearms;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idc6b56957-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/e/2\"><num value=\"2\">(2)</num><content> execute and serve search warrants and arrest warrants;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idc6b56958-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/e/3\"><num value=\"3\">(3)</num><content> execute seizure by process issued pursuant to libel under <ref href=\"/us/usc/t21/s334\">section 334 of this title</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idc6b56959-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/e/4\"><num value=\"4\">(4)</num><content> make arrests without warrant for offenses under this chapter with respect to such drugs if the offense is committed in his presence or, in the case of a felony, if he has probable cause to believe that the person so arrested has committed, or is committing, such offense; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idc6b7d95a-a9f2-11ec-bee8-e0d8ce96928f\" identifier=\"/us/usc/t21/s372/e/5\"><num value=\"5\">(5)</num><content> make, prior to the institution of libel proceedings under <ref href=\"/us/usc/t21/s334/a/2\">section 334(a)(2) of this title</ref>, seizures of drugs or containers or of equipment, punches, dies, plates, stones, labeling, or other things, if they are, or he has reasonable grounds to believe that they are, subject to seizure and condemnation under such section 334(a)(2).
