value=\"379aa\">§ 379aa.</num><heading> Serious adverse event reporting for nonprescription drugs</heading><subsection class=\"indent0\" id=\"id1d24a3ee-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/a\"><num value=\"a\">(a)</num><heading> Definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"blockIndent0\">In this section:</chapeau><paragraph class=\"indent1\" id=\"id1d24a3ef-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/a/1\"><num value=\"1\">(1)</num><heading> Adverse event</heading>\n<chapeau style=\"-uslm-lc:I12\" class=\"blockIndent1\">The term “adverse event” means any health-related event associated with the use of a nonprescription drug that is adverse, including—</chapeau><subparagraph class=\"indent2\" id=\"id1d24a3f0-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/a/1/A\"><num value=\"A\">(A)</num><content> an event occurring from an overdose of the drug, whether accidental or intentional;</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1d24cb01-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/a/1/B\"><num value=\"B\">(B)</num><content> an event occurring from abuse of the drug;</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1d24cb02-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/a/1/C\"><num value=\"C\">(C)</num><content> an event occurring from withdrawal from the drug; and</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1d24cb03-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/a/1/D\"><num value=\"D\">(D)</num><content> any failure of expected pharmacological action of the drug.</content>\n</subparagraph>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1d24cb04-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/a/2\"><num value=\"2\">(2)</num><heading> Nonprescription drug</heading>\n<chapeau style=\"-uslm-lc:I12\" class=\"blockIndent1\">The term “nonprescription drug” means a drug that is—</chapeau><subparagraph class=\"indent2\" id=\"id1d24cb05-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/a/2/A\"><num value=\"A\">(A)</num><content> not subject to <ref href=\"/us/usc/t21/s353/b\">section 353(b) of this title</ref>; and</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1d24cb06-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/a/2/B\"><num value=\"B\">(B)</num><content> not subject to approval in an application submitted under <ref href=\"/us/usc/t21/s355\">section 355 of this title</ref>.</content>\n</subparagraph>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1d24cb07-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/a/3\"><num value=\"3\">(3)</num><heading> Serious adverse event</heading>\n<chapeau style=\"-uslm-lc:I12\" class=\"blockIndent1\">The term “serious adverse event” is an adverse event that—</chapeau><subparagraph class=\"indent2\" id=\"id1d24cb08-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/a/3/A\"><num value=\"A\">(A)</num><chapeau> results in—</chapeau><clause class=\"indent3\" id=\"id1d24cb09-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/a/3/A/i\"><num value=\"i\">(i)</num><content> death;</content>\n</clause>\n<clause class=\"indent3\" id=\"id1d24cb0a-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/a/3/A/ii\"><num value=\"ii\">(ii)</num><content> a life-threatening experience;</content>\n</clause>\n<clause class=\"indent3\" id=\"id1d24cb0b-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/a/3/A/iii\"><num value=\"iii\">(iii)</num><content> inpatient hospitalization;</content>\n</clause>\n<clause class=\"indent3\" id=\"id1d24cb0c-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/a/3/A/iv\"><num value=\"iv\">(iv)</num><content> a persistent or significant disability or incapacity; or</content>\n</clause>\n<clause class=\"indent3\" id=\"id1d24f21d-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/a/3/A/v\"><num value=\"v\">(v)</num><content> a congenital anomaly or birth defect; or</content>\n</clause>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1d24f21e-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/a/3/B\"><num value=\"B\">(B)</num><content> requires, based on reasonable medical judgment, a medical or surgical intervention to prevent an outcome described under subparagraph (A).</content>\n</subparagraph>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1d24f21f-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/a/4\"><num value=\"4\">(4)</num><heading> Serious adverse event report</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “serious adverse event report” means a report that is required to be submitted to the Secretary under subsection (b).</p>\n</content>\n</paragraph>\n</subsection>\n<subsection class=\"indent0\" id=\"id1d24f220-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/b\"><num value=\"b\">(b)</num><heading> Reporting requirement</heading><paragraph class=\"indent1\" id=\"id1d24f221-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/b/1\"><num value=\"1\">(1)</num><heading> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The manufacturer, packer, or distributor whose name (pursuant to <ref href=\"/us/usc/t21/s352/b/1\">section 352(b)(1) of this title</ref>) appears on the label of a nonprescription drug marketed in the United States (referred to in this section as the “responsible person”) shall submit to the Secretary any report received of a serious adverse event associated with such drug when used in the United States, accompanied by a copy of the label on or within the retail package of such drug.</p>\n</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1d24f222-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/b/2\"><num value=\"2\">(2)</num><heading> Retailer</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A retailer whose name appears on the label described in paragraph (1) as a distributor may, by agreement, authorize the manufacturer or packer of the nonprescription drug to submit the required reports for such drugs to the Secretary so long as the retailer directs to the manufacturer or packer all adverse events associated with such drug that are reported to the retailer through the address or telephone number described in <ref href=\"/us/usc/t21/s352/x\">section 352(x) of this title</ref>.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection class=\"indent0\" id=\"id1d251933-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/c\"><num value=\"c\">(c)</num><heading> Submission of reports</heading><paragraph class=\"indent1\" id=\"id1d251934-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/c/1\"><num value=\"1\">(1)</num><heading> Timing of reports</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The responsible person shall submit to the Secretary a serious adverse event report no later than 15 business days after the report is received through the address or phone number described in <ref href=\"/us/usc/t21/s352/x\">section 352(x) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1d251935-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/c/2\"><num value=\"2\">(2)</num><heading> New medical information</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The responsible person shall submit to the Secretary any new medical information, related to a submitted serious adverse event report that is received by the responsible person within 1 year of the initial report, no later than 15 business days after the new information is received by the responsible person.</p>\n</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1d251936-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/c/3\"><num value=\"3\">(3)</num><heading> Consolidation of reports</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall develop systems to ensure that duplicate reports of, and new medical information related to, a serious adverse event shall be consolidated into a single report.</p>\n</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1d254047-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/c/4\"><num value=\"4\">(4)</num><heading> Exemption</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary, after providing notice and an opportunity for comment from interested parties, may establish an exemption to the requirements under paragraphs (1) and (2) if the Secretary determines that such exemption would have no adverse effect on public health.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection class=\"indent0\" id=\"id1d254048-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/d\"><num value=\"d\">(d)</num><heading> Contents of reports</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Each serious adverse event report under this section shall be submitted to the Secretary using the MedWatch form, which may be modified by the Secretary for nonprescription drugs, and may be accompanied by additional information.</p>\n</content>\n</subsection>\n<subsection class=\"indent0\" id=\"id1d254049-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/e\"><num value=\"e\">(e)</num><heading> Maintenance and inspection of records</heading><paragraph class=\"indent1\" id=\"id1d25404a-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/e/1\"><num value=\"1\">(1)</num><heading> Maintenance</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The responsible person shall maintain records related to each report of an adverse event received by the responsible person for a period of 6 years.</p>\n</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1d25404b-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/e/2\"><num value=\"2\">(2)</num><heading> Records inspection</heading><subparagraph class=\"indent2\" id=\"id1d25404c-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/e/2/A\"><num value=\"A\">(A)</num><heading> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The responsible person shall permit an authorized person to have access to records required to be maintained under this section, during an inspection pursuant to <ref href=\"/us/usc/t21/s374\">section 374 of this title</ref>.</p>\n</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1d25675d-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/e/2/B\"><num value=\"B\">(B)</num><heading> Authorized person</heading>\n<chapeau style=\"-uslm-lc:I13\" class=\"blockIndent2\">For purposes of this paragraph, the term “authorized person” means an officer or employee of the Department of Health and Human Services who has—</chapeau><clause class=\"indent3\" id=\"id1d25675e-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/e/2/B/i\"><num value=\"i\">(i)</num><content> appropriate credentials, as determined by the Secretary; and</content>\n</clause>\n<clause class=\"indent3\" id=\"id1d25675f-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/e/2/B/ii\"><num value=\"ii\">(ii)</num><content> been duly designated by the Secretary to have access to the records required under this section.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection class=\"indent0\" id=\"id1d256760-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/f\"><num value=\"f\">(f)</num><heading> Protected information</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"blockIndent0\">A serious adverse event report submitted to the Secretary under this section, including any new medical information submitted under subsection (c)(2), or an adverse event report voluntarily submitted to the Secretary shall be considered to be—</chapeau><paragraph class=\"indent1\" id=\"id1d256761-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/f/1\"><num value=\"1\">(1)</num><content> a safety report under <ref href=\"/us/usc/t21/s379v\">section 379v of this title</ref> and may be accompanied by a statement, which shall be a part of any report that is released for public disclosure, that denies that the report or the records constitute an admission that the product involved caused or contributed to the adverse event; and</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1d256762-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/f/2\"><num value=\"2\">(2)</num><content> a record about an individual under <ref href=\"/us/usc/t5/s552a\">section 552a of title 5</ref> (commonly referred to as the “Privacy Act of 1974”) and a medical or similar file the disclosure of which would constitute a violation of section 552 of such title 5 (commonly referred to as the “Freedom of Information Act”), and shall not be publicly disclosed unless all personally identifiable information is redacted.</content>\n</paragraph>\n</subsection>\n<subsection class=\"indent0\" id=\"id1d258e73-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/g\"><num value=\"g\">(g)</num><heading> Rule of construction</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The submission of any adverse event report in compliance with this section shall not be construed as an admission that the nonprescription drug involved caused or contributed to the adverse event.</p>\n</content>\n</subsection>\n<subsection class=\"indent0\" id=\"id1d258e74-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/h\"><num value=\"h\">(h)</num><heading> Preemption</heading><paragraph class=\"indent1\" id=\"id1d258e75-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/h/1\"><num value=\"1\">(1)</num><heading> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">No State or local government shall establish or continue in effect any law, regulation, order, or other requirement, related to a mandatory system for adverse event reports for nonprescription drugs, that is different from, in addition to, or otherwise not identical to, this section.</p>\n</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1d258e76-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/h/2\"><num value=\"2\">(2)</num><heading> Effect of section</heading><subparagraph class=\"indent2\" id=\"id1d258e77-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/h/2/A\"><num value=\"A\">(A)</num><heading> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Nothing in this section shall affect the authority of the Secretary to provide adverse event reports and information to any health, food, or drug officer or employee of any State, territory, or political subdivision of a State or territory, under a memorandum of understanding between the Secretary and such State, territory, or political subdivision.</p>\n</content>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1d25b588-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/h/2/B\"><num value=\"B\">(B)</num><heading> Personally-identifiable information</heading>\n<chapeau style=\"-uslm-lc:I13\" class=\"blockIndent2\">Notwithstanding any other provision of law, personally-identifiable information in adverse event reports provided by the Secretary to any health, food, or drug officer or employee of any State, territory, or political subdivision of a State or territory, shall not—</chapeau><clause class=\"indent3\" id=\"id1d25b589-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/h/2/B/i\"><num value=\"i\">(i)</num><content> be made publicly available pursuant to any State or other law requiring disclosure of information or records; or</content>\n</clause>\n<clause class=\"indent3\" id=\"id1d25b58a-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/h/2/B/ii\"><num value=\"ii\">(ii)</num><content> otherwise be disclosed or distributed to any party without the written consent of the Secretary and the person submitting such information to the Secretary.</content>\n</clause>\n</subparagraph>\n<subparagraph class=\"indent2\" id=\"id1d25b58b-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/h/2/C\"><num value=\"C\">(C)</num><heading> Use of safety reports</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Nothing in this section shall permit a State, territory, or political subdivision of a State or territory, to use any safety report received from the Secretary in a manner inconsistent with subsection (g) or <ref href=\"/us/usc/t21/s379v\">section 379v of this title</ref>.</p>\n</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection class=\"indent0\" id=\"id1d25dc9c-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379aa/i\"><num value=\"i\">(i)</num><heading> Authorization of appropriations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">There are authorized to be appropriated to carry out this section such sums as may be necessary.</p>\n</content>\n</subsection>\n<sourceCredit
