<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" id="id1ce7e8ed-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s379f"><num value="379f">§ 379f.</num><heading> Recovery and retention of fees for freedom of information requests</heading><subsection class="indent0" id="id1ce80ffe-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s379f/a"><num value="a">(a)</num><heading> In general</heading>
<chapeau style="-uslm-lc:I11" class="blockIndent0">The Secretary, acting through the Commissioner of Food and Drugs, may—</chapeau><paragraph class="indent1" id="id1ce80fff-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s379f/a/1"><num value="1">(1)</num><content> set and charge fees, in accordance with <ref href="/us/usc/t5/s552/a/4/A">section 552(a)(4)(A) of title 5</ref>, to recover all reasonable costs incurred in processing requests made under <ref href="/us/usc/t5/s552">section 552 of title 5</ref> for records obtained or created under this chapter or any other Federal law for which responsibility for administration has been delegated to the Commissioner by the Secretary;</content>
</paragraph>
<paragraph class="indent1" id="id1ce81000-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s379f/a/2"><num value="2">(2)</num><content> retain all fees charged for such requests; and</content>
</paragraph>
<paragraph class="indent1" id="id1ce81001-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s379f/a/3"><num value="3">(3)</num><content> establish an accounting system and procedures to control receipts and expenditures of fees received under this section.</content>
</paragraph>
</subsection>
<subsection class="indent0" id="id1ce81002-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s379f/b"><num value="b">(b)</num><heading> Use of fees</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary and the Commissioner of Food and Drugs shall not use fees received under this section for any purpose other than funding the processing of requests described in subsection (a)(1) of this section. Such fees shall not be used to reduce the amount of funds made to carry out other provisions of this chapter.</p>

<subsection class="indent0" id="id1ce83713-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s379f/c"><num value="c">(c)</num><heading> Waiver of fees</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this section shall supersede the right of a requester to obtain a waiver of fees pursuant to <ref href="/us/usc/t5/s552/a/4/A">section 552(a)(4)(A) of title 5</ref>.</p>
