<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id6f36f910-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r"><num value="379r">§ 379r.</num><heading> National uniformity for nonprescription drugs</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6f36f911-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau>Except as provided in subsection (b), (c)(1), (d), (e), or (f) of this section, no State or political subdivision of a State may establish or continue in effect any requirement—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6f36f912-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/a/1"><num value="1">(1)</num><content> that relates to the regulation of a drug that is not subject to the requirements of section 353(b)(1) or 353(f)(1)(A) of this title; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6f36f913-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/a/2"><num value="2">(2)</num><content> that is different from or in addition to, or that is otherwise not identical with, a requirement under this chapter, the Poison Prevention Packaging Act of 1970 (<ref href="/us/usc/t15/s1471">15 U.S.C. 1471</ref> et seq.), or the Fair Packaging and Labeling Act (<ref href="/us/usc/t15/s1451">15 U.S.C. 1451</ref> et seq.).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6f36f914-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/b"><num value="b" class="bold">(b)</num><heading class="bold"> Exemption</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6f36f915-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau>Upon application of a State or political subdivision thereof, the Secretary may by regulation, after notice and opportunity for written and oral presentation of views, exempt from subsection (a) of this section, under such conditions as may be prescribed in such regulation, a State or political subdivision requirement that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6f36f916-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/b/1/A"><num value="A">(A)</num><content> protects an important public interest that would otherwise be unprotected, including the health and safety of children;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6f36f917-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/b/1/B"><num value="B">(B)</num><content> would not cause any drug to be in violation of any applicable requirement or prohibition under Federal law; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6f36f918-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/b/1/C"><num value="C">(C)</num><content> would not unduly burden interstate commerce.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6f36f919-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Timely action</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall make a decision on the exemption of a State or political subdivision requirement under paragraph (1) not later than 120 days after receiving the application of the State or political subdivision under paragraph (1).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6f36f91a-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/c"><num value="c" class="bold">(c)</num><heading class="bold"> Scope</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6f36f91b-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau>This section shall not apply to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6f36f91c-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/c/1/A"><num value="A">(A)</num><content> any State or political subdivision requirement that relates to the practice of pharmacy; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6f36f91d-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/c/1/B"><num value="B">(B)</num><content> any State or political subdivision requirement that a drug be dispensed only upon the prescription of a practitioner licensed by law to administer such drug.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6f36f91e-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Safety or effectiveness</heading><content><p style="-uslm-lc:I12" class="indent1">For purposes of subsection (a) of this section, a requirement that relates to the regulation of a drug shall be deemed to include any requirement relating to public information or any other form of public communication relating to a warning of any kind for a drug.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6f36f91f-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/d"><num value="d" class="bold">(d)</num><heading class="bold"> Exceptions</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6f36f920-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau>In the case of a drug described in subsection (a)(1) of this section that is not the subject of an application approved under <ref href="/us/usc/t21/s355">section 355 of this title</ref> or <ref href="/us/usc/t21/s357">section 357 of this title</ref> (as in effect on the day before <date date="1997-11-21">November 21, 1997</date>) or a final regulation promulgated by the Secretary establishing conditions under which the drug is generally recognized as safe and effective and not misbranded, subsection (a) of this section shall apply only with respect to a requirement of a State or political subdivision of a State that relates to the same subject as, but is different from or in addition to, or that is otherwise not identical with—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6f36f921-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/d/1/A"><num value="A">(A)</num><content> a regulation in effect with respect to the drug pursuant to a statute described in subsection (a)(2) of this section; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6f36f922-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/d/1/B"><num value="B">(B)</num><content> any other requirement in effect with respect to the drug pursuant to an amendment to such a statute made on or after <date date="1997-11-21">November 21, 1997</date>.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6f36f923-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> State initiatives</heading><content><p style="-uslm-lc:I12" class="indent1">This section shall not apply to a State requirement adopted by a State public initiative or referendum enacted prior to <date date="1997-09-01">September 1, 1997</date>.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6f36f924-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/e"><num value="e" class="bold">(e)</num><heading class="bold"> No effect on product liability law</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this section shall be construed to modify or otherwise affect any action or the liability of any person under the product liability law of any State.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6f36f925-6123-11e3-9d46-8388bf8dcc60" identifier="/us/usc/t21/s379r/f"><num value="f" class="bold">(f)</num><heading class="bold"> State enforcement authority</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this section shall prevent a State or political subdivision thereof from enforcing, under any relevant civil or other enforcement authority, a requirement that is identical to a requirement of this chapter.</p>
