L. 105–115, title IV, § 412(d), Nov. 21, 1997, 111 Stat. 2376.)","seq_in_title":280,"parent_identifier":"/us/usc/t21/ch9/schVII/ptF","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9","level":"chapter","num":"CHAPTER 9—","heading":"FEDERAL FOOD, DRUG, AND COSMETIC ACT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schVII","level":"subchapter","num":"SUBCHAPTER VII—","heading":"GENERAL AUTHORITY","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schVII/ptF","level":"part","num":"Part F—","heading":"National Uniformity for Nonprescription Drugs and Preemption for Labeling or Packaging of Cosmetics","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" id=\"id1d24079d-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379s\"><num value=\"379s\">§ 379s.</num><heading> Preemption for labeling or packaging of cosmetics</heading><subsection class=\"indent0\" id=\"id1d24079e-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379s/a\"><num value=\"a\">(a)</num><heading> In general</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Except as provided in subsection (b), (d), or (e) of this section, no State or political subdivision of a State may establish or continue in effect any requirement for labeling or packaging of a cosmetic that is different from or in addition to, or that is otherwise not identical with, a requirement specifically applicable to a particular cosmetic or class of cosmetics under this chapter, the Poison Prevention Packaging Act of 1970 (<ref href=\"/us/usc/t15/s1471\">15 U.S.C. 1471</ref> et seq.), or the Fair Packaging and Labeling Act (<ref href=\"/us/usc/t15/s1451\">15 U.S.C. 1451</ref> et seq.).</p>\n</content>\n</subsection>\n<subsection class=\"indent0\" id=\"id1d242eaf-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379s/b\"><num value=\"b\">(b)</num><heading> Exemption</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"blockIndent0\">Upon application of a State or political subdivision thereof, the Secretary may by regulation, after notice and opportunity for written and oral presentation of views, exempt from subsection (a) of this section, under such conditions as may be prescribed in such regulation, a State or political subdivision requirement for labeling or packaging that—</chapeau><paragraph class=\"indent1\" id=\"id1d242eb0-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379s/b/1\"><num value=\"1\">(1)</num><content> protects an important public interest that would otherwise be unprotected;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1d242eb1-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379s/b/2\"><num value=\"2\">(2)</num><content> would not cause a cosmetic to be in violation of any applicable requirement or prohibition under Federal law; and</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1d242eb2-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379s/b/3\"><num value=\"3\">(3)</num><content> would not unduly burden interstate commerce.</content>\n</paragraph>\n</subsection>\n<subsection class=\"indent0\" id=\"id1d242eb3-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379s/c\"><num value=\"c\">(c)</num><heading> Scope</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of subsection (a) of this section, a reference to a State requirement that relates to the packaging or labeling of a cosmetic means any specific requirement relating to the same aspect of such cosmetic as a requirement specifically applicable to that particular cosmetic or class of cosmetics under this chapter for packaging or labeling, including any State requirement relating to public information or any other form of public communication.</p>\n</content>\n</subsection>\n<subsection class=\"indent0\" id=\"id1d2455c4-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379s/d\"><num value=\"d\">(d)</num><heading> No effect on product liability law</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Nothing in this section shall be construed to modify or otherwise affect any action or the liability of any person under the product liability law of any State.</p>\n</content>\n</subsection>\n<subsection class=\"indent0\" id=\"id1d2455c5-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s379s/e\"><num value=\"e\">(e)</num><heading> State initiative</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">This section shall not apply to a State requirement adopted by a State public initiative or referendum enacted prior to <date date=\"1997-09-01\">September 1, 1997</date>.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id1d2455c6-f63b-11e2-8470-abc29ba29c4d\">\n(<ref href=\"/us/act/1938-06-25/ch675/s752\">June 25, 1938, ch. 675, § 752</ref>, as added <ref href=\"/us/pl/105/115/s412/d\">Pub.
