L. 111–353, title III, § 306(a), Jan. 4, 2011, 124 Stat. 3958.)","seq_in_title":323,"parent_identifier":"/us/usc/t21/ch9/schVIII","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9","level":"chapter","num":"CHAPTER 9—","heading":"FEDERAL FOOD, DRUG, AND COSMETIC ACT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schVIII","level":"subchapter","num":"SUBCHAPTER VIII—","heading":"IMPORTS AND EXPORTS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idae81e603-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s384c\"><num value=\"384c\">§ 384c.</num><heading> Inspection of foreign food facilities</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idae81e604-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s384c/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Inspection</heading><chapeau>The Secretary—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idae81e605-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s384c/a/1\"><num value=\"1\">(1)</num><content> may enter into arrangements and agreements with foreign governments to facilitate the inspection of foreign facilities registered under <ref href=\"/us/usc/t21/s350d\">section 350d of this title</ref>; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idae81e606-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s384c/a/2\"><num value=\"2\">(2)</num><content> shall direct resources to inspections of foreign facilities, suppliers, and food types, especially such facilities, suppliers, and food types that present a high risk (as identified by the Secretary), to help ensure the safety and security of the food supply of the United States.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idae81e607-ec38-11e5-9fc5-818d616f3d7f\" identifier=\"/us/usc/t21/s384c/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Effect of inability to inspect</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Notwithstanding any other provision of law, food shall be refused admission into the United States if it is from a foreign factory, warehouse, or other establishment of which the owner, operator, or agent in charge, or the government of the foreign country, refuses to permit entry of United States inspectors or other individuals duly designated by the Secretary, upon request, to inspect such factory, warehouse, or other establishment. For purposes of this subsection, such an owner, operator, or agent in charge shall be considered to have refused an inspection if such owner, operator, or agent in charge does not permit an inspection of a factory, warehouse, or other establishment during the 24-hour period after such request is submitted, or after such other time period, as agreed upon by the Secretary and the foreign factory, warehouse, or other establishment.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idae81e608-ec38-11e5-9fc5-818d616f3d7f\">(<ref href=\"/us/act/1938-06-25/ch675\">June 25, 1938, ch. 675</ref>, § 807, as added <ref href=\"/us/pl/111/353/tIII\">Pub.
