<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idc9b98ffd-f339-11ed-b7d6-eb7e2ad38908" identifier="/us/usc/t21/s384e"><num value="384e">§ 384e.</num><heading> Recognition of foreign government inspections</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc9b98ffe-f339-11ed-b7d6-eb7e2ad38908" identifier="/us/usc/t21/s384e/a"><num value="a" class="bold">(a)</num><heading class="bold"> Inspection</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idc9b98fff-f339-11ed-b7d6-eb7e2ad38908" identifier="/us/usc/t21/s384e/a/1"><num value="1">(1)</num><content> may enter into arrangements and agreements with a foreign government or an agency of a foreign government to recognize the inspection of foreign establishments registered under <ref href="/us/usc/t21/s360/i">section 360(i) of this title</ref> in order to facilitate preapproval or risk-based inspections in accordance with the schedule established in paragraph (2) or (3) of <ref href="/us/usc/t21/s360/h">section 360(h) of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idc9b99000-f339-11ed-b7d6-eb7e2ad38908" identifier="/us/usc/t21/s384e/a/2"><num value="2">(2)</num><content> may enter into arrangements and agreements with a foreign government or an agency of a foreign government under this section only with a foreign government or an agency of a foreign government that the Secretary has determined as having the capability of conducting inspections that meet the applicable requirements of this chapter; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idc9b99001-f339-11ed-b7d6-eb7e2ad38908" identifier="/us/usc/t21/s384e/a/3"><num value="3">(3)</num><content> shall perform such reviews and audits of drug safety programs, systems, and standards of a foreign government or agency for the foreign government as the Secretary deems necessary to determine that the foreign government or agency of the foreign government is capable of conducting inspections that meet the applicable requirements of this chapter.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc9bbd8f2-f339-11ed-b7d6-eb7e2ad38908" identifier="/us/usc/t21/s384e/b"><num value="b" class="bold">(b)</num><heading class="bold"> Results of inspection</heading><chapeau style="-uslm-lc:I11" class="indent0">The results of inspections performed by a foreign government or an agency of a foreign government under this section may be used as—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idc9bbd8f3-f339-11ed-b7d6-eb7e2ad38908" identifier="/us/usc/t21/s384e/b/1"><num value="1">(1)</num><content> evidence of compliance with <ref href="/us/usc/t21/s351/a/2/B">section 351(a)(2)(B) of this title</ref> or <ref href="/us/usc/t21/s381/r">section 381(r) of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idc9bbd8f4-f339-11ed-b7d6-eb7e2ad38908" identifier="/us/usc/t21/s384e/b/2"><num value="2">(2)</num><content> for any other purposes as determined appropriate by the Secretary.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idc9bbd8f5-f339-11ed-b7d6-eb7e2ad38908" identifier="/us/usc/t21/s384e/c"><num value="c" class="bold">(c)</num><heading class="bold"> Periodic review</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idc9bbd8f6-f339-11ed-b7d6-eb7e2ad38908" identifier="/us/usc/t21/s384e/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Beginning not later than 1 year after <date date="2022-12-29">December 29, 2022</date>, the Secretary shall periodically assess whether additional arrangements and agreements with a foreign government or an agency of a foreign government, as allowed under this section, are appropriate.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idc9bbd8f7-f339-11ed-b7d6-eb7e2ad38908" identifier="/us/usc/t21/s384e/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Reports to Congress</heading><content><p style="-uslm-lc:I12" class="indent1">Beginning not later than 4 years after <date date="2022-12-29">December 29, 2022</date>, and every 4 years thereafter, the Secretary shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate a report describing the findings and conclusions of each review conducted under paragraph (1).</p>
