L. 115–271, title III, § 3022(a), Oct. 24, 2018, 132 Stat. 3938.)","seq_in_title":358,"parent_identifier":"/us/usc/t21/ch9/schVIII","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9","level":"chapter","num":"CHAPTER 9—","heading":"FEDERAL FOOD, DRUG, AND COSMETIC ACT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schVIII","level":"subchapter","num":"SUBCHAPTER VIII—","heading":"IMPORTS AND EXPORTS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id7d81df9e-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s384g\"><num value=\"384g\">§ 384g.</num><heading> Restricting entrance of illicit drugs</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id7d81df9f-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s384g/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Food and Drug Administration and U.S. Customs and Border Protection cooperation</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id7d81dfa0-81bc-11eb-b838-b6993269d559\" identifier=\"/us/usc/t21/s384g/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary of Health and Human Services (referred to in this section as the “Secretary”), acting through the Commissioner of Food and Drugs and in consultation with the U.S. Customs and Border Protection, shall develop and periodically update a mutually agreed upon list of the controlled substances that the Secretary will refer to U.S. Customs and Border Protection, unless the Secretary and U.S. Customs and Border Protection agree otherwise, when such substances are offered for import via international mail and appear to violate the Controlled Substances Act (<ref href=\"/us/usc/t21/s801\">21 U.S.C. 801</ref> et seq.), the Controlled Substances Import and Export Act (<ref href=\"/us/usc/t21/s951\">21 U.S.C. 951</ref> et seq.), the Federal Food, Drug, and Cosmetic Act (<ref href=\"/us/usc/t21/s301\">21 U.S.C. 301</ref> et seq.), or any other applicable law. The Secretary shall transfer controlled substances on such list to the U.S. Customs and Border Protection. If the Secretary identifies additional packages that appear to be the same as such package containing a controlled substance, such additional packages may also be transferred to U.S. Customs and Border Protection.
