<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ide50055b0-ec7d-11e6-944b-93361b188886" identifier="/us/usc/t21/s387t"><num value="387t">§ 387t.</num><heading> Labeling, recordkeeping, records inspection</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ide50055b1-ec7d-11e6-944b-93361b188886" identifier="/us/usc/t21/s387t/a"><num value="a" class="bold">(a)</num><heading class="bold"> Origin labeling</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ide50055b2-ec7d-11e6-944b-93361b188886" identifier="/us/usc/t21/s387t/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Requirement</heading><content><p style="-uslm-lc:I12" class="indent1">Beginning 1 year after <date date="2009-06-22">June 22, 2009</date>, the label, packaging, and shipping containers of tobacco products other than cigarettes for introduction or delivery for introduction into interstate commerce in the United States shall bear the statement “sale only allowed in the United States”. Beginning 15 months after the issuance of the regulations required by <ref href="/us/usc/t15/s1333/d">section 1333(d) of title 15</ref>, as amended by section 201 of Family <ref class="footnoteRef" idref="fn002089">1</ref><note type="footnote" id="fn002089"><num>1</num> So in original. Probably should be “the Family”.</note> Smoking Prevention and Tobacco Control Act, the label, packaging, and shipping containers of cigarettes for introduction or delivery for introduction into interstate commerce in the United States shall bear the statement “Sale only allowed in the United States”.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ide502c5b3-ec7d-11e6-944b-93361b188886" identifier="/us/usc/t21/s387t/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Effective date</heading><content><p style="-uslm-lc:I12" class="indent1">The effective date specified in paragraph (1) shall be with respect to the date of manufacture, provided that, in any case, beginning 30 days after such effective date, a manufacturer shall not introduce into the domestic commerce of the United States any product, irrespective of the date of manufacture, that is not in conformance with such paragraph.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ide502c5b4-ec7d-11e6-944b-93361b188886" identifier="/us/usc/t21/s387t/b"><num value="b" class="bold">(b)</num><heading class="bold"> Regulations concerning recordkeeping for tracking and tracing</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ide502c5b5-ec7d-11e6-944b-93361b188886" identifier="/us/usc/t21/s387t/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall promulgate regulations regarding the establishment and maintenance of records by any person who manufactures, processes, transports, distributes, receives, packages, holds, exports, or imports tobacco products.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ide502c5b6-ec7d-11e6-944b-93361b188886" identifier="/us/usc/t21/s387t/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Inspection</heading><content><p style="-uslm-lc:I12" class="indent1">In promulgating the regulations described in paragraph (1), the Secretary shall consider which records are needed for inspection to monitor the movement of tobacco products from the point of manufacture through distribution to retail outlets to assist in investigating potential illicit trade, smuggling, or counterfeiting of tobacco products.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ide502c5b7-ec7d-11e6-944b-93361b188886" identifier="/us/usc/t21/s387t/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Codes</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary may require codes on the labels of tobacco products or other designs or devices for the purpose of tracking or tracing the tobacco product through the distribution system.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ide502c5b8-ec7d-11e6-944b-93361b188886" identifier="/us/usc/t21/s387t/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Size of business</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall take into account the size of a business in promulgating regulations under this section.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ide502c5b9-ec7d-11e6-944b-93361b188886" identifier="/us/usc/t21/s387t/b/5"><num value="5" class="bold">(5)</num><heading class="bold"> Recordkeeping by retailers</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall not require any retailer to maintain records relating to individual purchasers of tobacco products for personal consumption.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ide502c5ba-ec7d-11e6-944b-93361b188886" identifier="/us/usc/t21/s387t/c"><num value="c" class="bold">(c)</num><heading class="bold"> Records inspection</heading><content><p style="-uslm-lc:I11" class="indent0">If the Secretary has a reasonable belief that a tobacco product is part of an illicit trade or smuggling or is a counterfeit product, each person who manufactures, processes, transports, distributes, receives, holds, packages, exports, or imports tobacco products shall, at the request of an officer or employee duly designated by the Secretary, permit such officer or employee, at reasonable times and within reasonable limits and in a reasonable manner, upon the presentation of appropriate credentials and a written notice to such person, to have access to and copy all records (including financial records) relating to such article that are needed to assist the Secretary in investigating potential illicit trade, smuggling, or counterfeiting of tobacco products. The Secretary shall not authorize an officer or employee of the government of any of the several States to exercise authority under the preceding sentence on Indian country without the express written consent of the Indian tribe involved.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ide502c5bb-ec7d-11e6-944b-93361b188886" identifier="/us/usc/t21/s387t/d"><num value="d" class="bold">(d)</num><heading class="bold"> Knowledge of illegal transaction</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ide502c5bc-ec7d-11e6-944b-93361b188886" identifier="/us/usc/t21/s387t/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Notification</heading><chapeau>If the manufacturer or distributor of a tobacco product has knowledge which reasonably supports the conclusion that a tobacco product manufactured or distributed by such manufacturer or distributor that has left the control of such person may be or has been—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ide502c5bd-ec7d-11e6-944b-93361b188886" identifier="/us/usc/t21/s387t/d/1/A"><num value="A">(A)</num><content> imported, exported, distributed, or offered for sale in interstate commerce by a person without paying duties or taxes required by law; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ide502c5be-ec7d-11e6-944b-93361b188886" identifier="/us/usc/t21/s387t/d/1/B"><num value="B">(B)</num><content> imported, exported, distributed, or diverted for possible illicit marketing,</content>
</subparagraph>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">the manufacturer or distributor shall promptly notify the Attorney General and the Secretary of the Treasury of such knowledge.</continuation>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ide502c5bf-ec7d-11e6-944b-93361b188886" identifier="/us/usc/t21/s387t/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Knowledge defined</heading><chapeau>For purposes of this subsection, the term “knowledge” as applied to a manufacturer or distributor means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ide502c5c0-ec7d-11e6-944b-93361b188886" identifier="/us/usc/t21/s387t/d/2/A"><num value="A">(A)</num><content> the actual knowledge that the manufacturer or distributor had; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ide502c5c1-ec7d-11e6-944b-93361b188886" identifier="/us/usc/t21/s387t/d/2/B"><num value="B">(B)</num><content> the knowledge which a reasonable person would have had under like circumstances or which would have been obtained upon the exercise of due care.</content>
</subparagraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ide502c5c2-ec7d-11e6-944b-93361b188886" identifier="/us/usc/t21/s387t/e"><num value="e" class="bold">(e)</num><heading class="bold"> Consultation</heading><content><p style="-uslm-lc:I11" class="indent0">In carrying out this section, the Secretary shall consult with the Attorney General of the United States and the Secretary of the Treasury, as appropriate.</p>
