L. 112–144, title V, § 511, July 9, 2012, 126 Stat. 1050.)","seq_in_title":323,"parent_identifier":"/us/usc/t21/ch9/schX","ancestors":[{"identifier":"/us/usc/t21","level":"title","num":"Title 21—","heading":"FOOD AND DRUGS","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9","level":"chapter","num":"CHAPTER 9—","heading":"FEDERAL FOOD, DRUG, AND COSMETIC ACT","status":null,"is_section":false},{"identifier":"/us/usc/t21/ch9/schX","level":"subchapter","num":"SUBCHAPTER X—","heading":"MISCELLANEOUS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" id=\"id1d6221ec-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s393a\"><num value=\"393a\">§ 393a.</num><heading> Office of Pediatric Therapeutics</heading><subsection class=\"indent0\" id=\"id1d6221ed-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s393a/a\"><num value=\"a\">(a)</num><heading> Establishment</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary of Health and Human Services shall establish an Office of Pediatric Therapeutics within the Food and Drug Administration.</p>\n</content>\n</subsection>\n<subsection class=\"indent0\" id=\"id1d6221ee-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s393a/b\"><num value=\"b\">(b)</num><heading> Duties</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Office of Pediatric Therapeutics shall be responsible for coordination and facilitation of all activities of the Food and Drug Administration that may have any effect on a pediatric population or the practice of pediatrics or may in any other way involve pediatric issues, including increasing pediatric access to medical devices.</p>\n</content>\n</subsection>\n<subsection class=\"indent0\" id=\"id1d6248ff-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s393a/c\"><num value=\"c\">(c)</num><heading> Staff</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"blockIndent0\">The staff of the Office of Pediatric Therapeutics shall coordinate with employees of the Department of Health and Human Services who exercise responsibilities relating to pediatric therapeutics and shall include—</chapeau><paragraph class=\"indent1\" id=\"id1d624900-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s393a/c/1\"><num value=\"1\">(1)</num><content> one or more additional individuals with expertise concerning ethical issues presented by the conduct of clinical research in the pediatric population;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1d624901-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s393a/c/2\"><num value=\"2\">(2)</num><content> subject to subsection (d), one or more additional individuals with necessary expertise in a pediatric subpopulation that is, as determined through consideration of the reports and recommendations issued by the Institute of Medicine and the Comptroller General of the United States, less likely to be studied as a part of a written request issued under <ref href=\"/us/usc/t21/s355a\">section 355a of this title</ref> or an assessment under <ref href=\"/us/usc/t21/s355c\">section 355c of this title</ref>;</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1d624902-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s393a/c/3\"><num value=\"3\">(3)</num><content> one or more additional individuals with expertise in pediatric epidemiology; and</content>\n</paragraph>\n<paragraph class=\"indent1\" id=\"id1d627013-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s393a/c/4\"><num value=\"4\">(4)</num><content> one or more additional individuals with expertise in pediatrics as may be necessary to perform the activities described in subsection (b) of this section.</content>\n</paragraph>\n</subsection>\n<subsection class=\"indent0\" id=\"id1d627014-f63b-11e2-8470-abc29ba29c4d\" identifier=\"/us/usc/t21/s393a/d\"><num value=\"d\">(d)</num><heading> Neonatology expertise</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">For the 5-year period beginning on <date date=\"2012-07-09\">July 9, 2012</date>, at least one of the individuals described in subsection (c)(2) shall have expertise in neonatology.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id1d627015-f63b-11e2-8470-abc29ba29c4d\">\n(<ref href=\"/us/pl/107/109/s6\">Pub.
