<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" id="id1d77f49c-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472"><num value="472">§ 472.</num><heading> Interstate shipment of poultry inspected by Federal and State agencies for certain small establishments</heading><subsection class="indent0" id="id1d77f49d-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/a"><num value="a">(a)</num><heading> Definitions</heading><paragraph class="indent1" id="id1d77f49e-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/a/1"><num value="1">(1)</num><heading> Appropriate State agency</heading><content><p style="-uslm-lc:I12" class="indent1">The term “appropriate State agency” means a State agency described in <ref href="/us/usc/t21/s454/a/1">section 454(a)(1) of this title</ref>.</p>

</paragraph>
<paragraph class="indent1" id="id1d77f49f-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/a/2"><num value="2">(2)</num><heading> Designated personnel</heading><content><p style="-uslm-lc:I12" class="indent1">The term “designated personnel” means inspection personnel of a State agency that have undergone all necessary inspection training and certification to assist the Secretary in the administration and enforcement of this chapter, including rules and regulations issued under this chapter.</p>
</content>
</paragraph>
<paragraph class="indent1" id="id1d781bb0-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/a/3"><num value="3">(3)</num><heading> Eligible establishment</heading>
<chapeau style="-uslm-lc:I12" class="blockIndent1">The term “eligible establishment” means an establishment that is in compliance with—</chapeau><subparagraph class="indent2" id="id1d781bb1-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/a/3/A"><num value="A">(A)</num><content> the State inspection program of the State in which the establishment is located; and</content>
</subparagraph>
<subparagraph class="indent2" id="id1d781bb2-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/a/3/B"><num value="B">(B)</num><content> this chapter, including rules and regulations issued under this chapter.</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id1d781bb3-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/a/4"><num value="4">(4)</num><heading> Poultry item</heading>
<chapeau style="-uslm-lc:I12" class="blockIndent1">The term “poultry item” means—</chapeau><subparagraph class="indent2" id="id1d781bb4-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/a/4/A"><num value="A">(A)</num><content> a portion of poultry; and</content>
</subparagraph>
<subparagraph class="indent2" id="id1d781bb5-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/a/4/B"><num value="B">(B)</num><content> a poultry product.</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id1d781bb6-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/a/5"><num value="5">(5)</num><heading> Selected establishment</heading><content><p style="-uslm-lc:I12" class="indent1">The term “selected establishment” means an eligible establishment that is selected by the Secretary, in coordination with the appropriate State agency of the State in which the eligible establishment is located, under subsection (b) to ship poultry items in interstate commerce.</p>
</content>
</paragraph>
</subsection>
<subsection class="indent0" id="id1d7842c7-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b"><num value="b">(b)</num><heading> Authority of Secretary to allow shipments</heading><paragraph class="indent1" id="id1d7842c8-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/1"><num value="1">(1)</num><heading> In general</heading>
<chapeau style="-uslm-lc:I12" class="blockIndent1">Subject to paragraph (2), the Secretary, in coordination with the appropriate State agency of the State in which an establishment is located, may select the establishment to ship poultry items in interstate commerce, and place on each poultry item shipped in interstate commerce a Federal mark, stamp, tag, or label of inspection, if—</chapeau><subparagraph class="indent2" id="id1d7842c9-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/1/A"><num value="A">(A)</num><content> the poultry item qualifies for the Federal mark, stamp, tag, or label of inspection under the requirements of this chapter;</content>
</subparagraph>
<subparagraph class="indent2" id="id1d7842ca-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/1/B"><num value="B">(B)</num><content> the establishment is an eligible establishment; and</content>
</subparagraph>
<subparagraph class="indent2" id="id1d7842cb-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/1/C"><num value="C">(C)</num><content> inspection services for the establishment are provided by designated personnel.</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id1d7842cc-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/2"><num value="2">(2)</num><heading> Prohibited establishments</heading>
<chapeau style="-uslm-lc:I12" class="blockIndent1">In carrying out paragraph (1), the Secretary, in coordination with an appropriate State agency, shall not select an establishment that—</chapeau><subparagraph class="indent2" id="id1d7842cd-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/2/A"><num value="A">(A)</num><content> on average, employs more than 25 employees (including supervisory and nonsupervisory employees), as defined by the Secretary;</content>
</subparagraph>
<subparagraph class="indent2" id="id1d7869de-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/2/B"><num value="B">(B)</num><content> as of the date of the enactment of this section, ships in interstate commerce carcasses, portions of carcasses, or poultry items that are inspected by the Secretary in accordance with this chapter;</content>
</subparagraph>
<subparagraph class="indent2" id="id1d7869df-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/2/C"><num value="C">(C)</num><clause class="indent2" id="id1d7869e0-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/2/C/i"><num value="i">(i)</num><content> is a Federal establishment;</content>
</clause>
<clause class="indent2" id="id1d7869e1-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/2/C/ii"><num value="ii">(ii)</num><content> was a Federal establishment as of the date of the enactment of this section, and was reorganized on a later date under the same name or a different name or person by the person, firm, or corporation that controlled the establishment as of the date of the enactment of this section; or</content>
</clause>
<clause class="indent2" id="id1d7869e2-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/2/C/iii"><num value="iii">(iii)</num><chapeau> was a State establishment as of the date of the enactment of this section that—</chapeau><subclause class="indent3" id="id1d7869e3-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/2/C/iii/I"><num value="I">(I)</num><content> as of the date of the enactment of this section, employed more than 25 employees; and</content>
</subclause>
<subclause class="indent3" id="id1d7869e4-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/2/C/iii/II"><num value="II">(II)</num><content> was reorganized on a later date by the person, firm, or corporation that controlled the establishment as of the date of the enactment of this section;</content>
</subclause>
</clause>
</subparagraph>
<subparagraph class="indent2" id="id1d7890f5-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/2/D"><num value="D">(D)</num><content> is in violation of this chapter;</content>
</subparagraph>
<subparagraph class="indent2" id="id1d7890f6-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/2/E"><num value="E">(E)</num><content> is located in a State that does not have a State inspection program; or</content>
</subparagraph>
<subparagraph class="indent2" id="id1d7890f7-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/2/F"><num value="F">(F)</num><content> is the subject of a transition carried out in accordance with a procedure developed by the Secretary under paragraph (3)(A).</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id1d7890f8-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/3"><num value="3">(3)</num><heading> Establishments that employ more than 25 employees</heading><subparagraph class="indent2" id="id1d7890f9-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/3/A"><num value="A">(A)</num><heading> Development of procedure</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may develop a procedure to transition to a Federal establishment any establishment under this section that, on average, consistently employs more than 25 employees.</p>
</content>
</subparagraph>
<subparagraph class="indent2" id="id1d7890fa-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/3/B"><num value="B">(B)</num><heading> Eligibility of certain establishments</heading><clause class="indent3" id="id1d7890fb-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/3/B/i"><num value="i">(i)</num><heading> In general</heading><content><p style="-uslm-lc:I14" class="indent3">A State establishment that employs more than 25 employees but less than 35 employees as of the date of the enactment of this section may be selected as a selected establishment under this subsection.</p>
</content>
</clause>
<clause class="indent3" id="id1d78b80c-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/b/3/B/ii"><num value="ii">(ii)</num><heading> Procedures</heading><content><p style="-uslm-lc:I14" class="indent3">A State establishment shall be subject to the procedures established under subparagraph (A) beginning on the date that is 3 years after the effective date described in subsection (i).</p>

</subparagraph>
</paragraph>
</subsection>
<subsection class="indent0" id="id1d78b80d-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/c"><num value="c">(c)</num><heading> Reimbursement of State costs</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall reimburse a State for costs related to the inspection of selected establishments in the State in accordance with Federal requirements in an amount of not less than 60 percent of eligible State costs.</p>
</content>
</subsection>
<subsection class="indent0" id="id1d78b80e-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/d"><num value="d">(d)</num><heading> Coordination between Federal and State agencies</heading><paragraph class="indent1" id="id1d78b80f-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/d/1"><num value="1">(1)</num><heading> In general</heading>
<chapeau style="-uslm-lc:I12" class="blockIndent1">The Secretary shall designate an employee of the Federal Government as State coordinator for each appropriate State agency—</chapeau><subparagraph class="indent2" id="id1d78b810-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/d/1/A"><num value="A">(A)</num><content> to provide oversight and enforcement of this section; and</content>
</subparagraph>
<subparagraph class="indent2" id="id1d78b811-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/d/1/B"><num value="B">(B)</num><content> to oversee the training and inspection activities of designated personnel of the State agency.</content>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id1d78b812-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/d/2"><num value="2">(2)</num><heading> Supervision</heading><content><p style="-uslm-lc:I12" class="indent1">A State coordinator shall be under the direct supervision of the Secretary.</p>
</content>
</paragraph>
<paragraph class="indent1" id="id1d78de23-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/d/3"><num value="3">(3)</num><heading> Duties of State coordinator</heading><subparagraph class="indent2" id="id1d78de24-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/d/3/A"><num value="A">(A)</num><heading> In general</heading><content><p style="-uslm-lc:I13" class="indent2">A State coordinator shall visit selected establishments with a frequency that is appropriate to ensure that selected establishments are operating in a manner that is consistent with this chapter (including regulations and policies under this chapter).</p>
</content>
</subparagraph>
<subparagraph class="indent2" id="id1d78de25-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/d/3/B"><num value="B">(B)</num><heading> Quarterly reports</heading><content><p style="-uslm-lc:I13" class="indent2">A State coordinator shall, on a quarterly basis, submit to the Secretary a report that describes the status of each selected establishment that is under the jurisdiction of the State coordinator with respect to the level of compliance of each selected establishment with the requirements of this chapter.</p>
</content>
</subparagraph>
<subparagraph class="indent2" id="id1d78de26-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/d/3/C"><num value="C">(C)</num><heading> Immediate notification requirement</heading>
<chapeau style="-uslm-lc:I13" class="blockIndent2">If a State coordinator determines that any selected establishment that is under the jurisdiction of the State coordinator is in violation of any requirement of this chapter, the State coordinator shall—</chapeau><clause class="indent3" id="id1d78de27-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/d/3/C/i"><num value="i">(i)</num><content> immediately notify the Secretary of the violation; and</content>
</clause>
<clause class="indent3" id="id1d78de28-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/d/3/C/ii"><num value="ii">(ii)</num><content> deselect the selected establishment or suspend inspection at the selected establishment.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph class="indent1" id="id1d790539-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/d/4"><num value="4">(4)</num><heading> Performance evaluations</heading><content><p style="-uslm-lc:I12" class="indent1">Performance evaluations of State coordinators designated under this subsection shall be conducted by the Secretary as part of the Federal agency management control system.</p>
</content>
</paragraph>
</subsection>
<subsection class="indent0" id="id1d79053a-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/e"><num value="e">(e)</num><heading> Audits</heading><paragraph class="indent1" id="id1d79053b-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/e/1"><num value="1">(1)</num><heading> Periodic audits conducted by Inspector General of the Department of Agriculture</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 2 years after the effective date described in subsection (i), and not less often than every 3 years thereafter, the Inspector General of the Department of Agriculture shall conduct an audit of each activity taken by the Secretary under this section for the period covered by the audit to determine compliance with this section.</p>
</content>
</paragraph>
<paragraph class="indent1" id="id1d79053c-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/e/2"><num value="2">(2)</num><heading> Audit conducted by Comptroller General of the United States</heading>
<chapeau style="-uslm-lc:I12" class="blockIndent1">Not earlier than 3 years, nor later than 5 years, after the date of the enactment of this section, the Comptroller General of the United States shall conduct an audit of the implementation of this section to determine—</chapeau><subparagraph class="indent2" id="id1d792c4d-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/e/2/A"><num value="A">(A)</num><content> the effectiveness of the implementation of this section; and</content>
</subparagraph>
<subparagraph class="indent2" id="id1d792c4e-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/e/2/B"><num value="B">(B)</num><content> the number of selected establishments selected by the Secretary to ship poultry items under this section.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection class="indent0" id="id1d792c4f-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/f"><num value="f">(f)</num><heading> Transition grants</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary may provide grants to appropriate State agencies to assist the appropriate State agencies in helping establishments covered by this chapter to transition to selected establishments.</p>
</content>
</subsection>
<subsection class="indent0" id="id1d792c50-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/g"><num value="g">(g)</num><heading> Violations</heading><content><p style="-uslm-lc:I11" class="indent0">Any selected establishment that the Secretary determines to be in violation of any requirement of this chapter shall be transitioned to a Federal establishment in accordance with a procedure developed by the Secretary under subsection (b)(3)(A).</p>

</subsection>
<subsection class="indent0" id="id1d792c51-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/h"><num value="h">(h)</num><heading> Effect</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this section limits the jurisdiction of the Secretary with respect to the regulation of poultry and poultry products under this chapter.</p>

</subsection>
<subsection class="indent0" id="id1d792c52-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/i"><num value="i">(i)</num><heading> Effective date</heading><paragraph class="indent1" id="id1d792c53-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/i/1"><num value="1">(1)</num><heading> In general</heading><content><p style="-uslm-lc:I12" class="indent1">This section takes effect on the date on which the Secretary, after providing a period of public comment (including through the conduct of public meetings or hearings), promulgates final regulations to carry out this section.</p>

</paragraph>
<paragraph class="indent1" id="id1d795364-f63b-11e2-8470-abc29ba29c4d" identifier="/us/usc/t21/s472/i/2"><num value="2">(2)</num><heading> Requirement</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 18 months after the date of the enactment of this section, the Secretary shall promulgate final regulations in accordance with paragraph (1).</p>
